1.0 Call to Order
The Council meeting was called to order at 6:00 p.m. by Mayor Gretchen Fagan. Other

7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to
approve the Minutes of the July 1, 2013 Special City Council Meeting and the July 1,
2013 Regular City Council Meeting.
Motion carried unanimously.
8.0 New Business:
8.1 Motion was made by Councilman Townsend, second by Councilman Stoll, to
read Ordinance No. 2013-08 by caption only on First Reading.
Motion carried unanimously.
Motion was made by Councilman Townsend, second by Councilman Dodson, to
adopt, on First Reading, Ordinance No. 2013-08, an Ordinance of the City of
Tomball, Texas, Establishing the Tomball Legacy Fund, Inc. for the Purpose of
Receiving Private and/or Corporate Grant Funds; said Funds to be used on Behalf
of the City of Tomball, Texas for Projects serving the Tomball Community;
Providing for the Selection of Six (6) Seven (7) Members to Comprise the Tomball
Legacy Fund, Inc. Board of Directors and for the Manner of Selection and Period of
Service of Such Members; Providing for Duties and Procedures for the Tomball
Legacy Fund, Inc. Board of Directors; Containing Recitations; Finding that the
Meetings at which This Ordinance is Considered are open to the Public; Providing
for Severability and the Repeal of Conflicting Ordinances; and Providing Other
Details Relating to the Passage of This Ordinance. Vote was as follows:

Motion carried unanimously.
8.2 Motion was made by Councilman Dodson, second by Councilman Stoll, to
approve RALEIGH CREEK SECTION ONE FINAL PLAT: A subdivision of
142.8407 Acres in the Joseph Miller Survey, Abstract Number 50, Harris County,
Texas.
Motion carried unanimously.
8.5 Discussion was held regarding Section 14-490(g)(4) of the Tomball Code of
Ordinances and Zoning Ordinance regarding Non-conforming Lots. City staff
presented information regarding current regulations for non-conforming lots.

Monique Dermaux, 2531 S. Cherry Street, presented information regarding
her request to build on a non-conforming lot.
Council requested that City staff draft suggested changes to the code of
ordinances, based on direction given by Council.
No action taken.
8.3 Executive Session: The Tomball City Council did not meet in Executive Session
as Authorized by Title 5, Chapter 551, Government Code, the Texas Open
Meetings Act, for the Following Purpose:
● Sec. 551.071 – Private Consultation with Attorney in Closed Meeting
regarding Pending or Threatened Litigation or a Matter that the Duty of
the Attorney Requires be Discussed in Closed Session.
8.4 The Tomball City Council did not continue with the Workshop Session regarding
the Fiscal Year 2013-2014 Budget.
9.0 Motion was made by Councilman Townsend, second by Councilman Brown, to adjourn.
Motion carried unanimously.

Monday, July 15, 2013 at 6:00 p.m., City Hall, 401 Market Street, Tomball, Texas 77375,

action. The Tomball City Council reserves the right to meet in a closed session for
consultation with attorney on any agenda item should the need arise and if applicable
