MINUTES OF REGULAR CITY COUNCIL MEETING CITY OF TOMBALL, TEXAS MONDAY, JULY 15, 2013 6:00 P.M. 1.0 Call to Order The Council meeting was called to order at 6:00 p.m. by Mayor Gretchen Fagan. Every Monday, Wednesday and Friday, from 11:00 a.m. to 1:00 p.m. at MLK Park, 403 Chestnut Street – Sponsors: H-E-B, Buffalo Wild Wings, Cisco’s Salsa Company, Salem Lutheran Ministries and Tomball Bible Church ● July 19, 2013 – Friday Night Creature Feature – Invasion of the Body Snatchers ● August 5, 2013 – Public Hearing on FY 2013-2014 Budget – 6:00 p.m. ● August 6, 2013 – Mayor’s Coffee – 5:00 p.m.-7:00 p.m. – 207 Commerce (Sol de Luna) ● August 16, 2013 – Friday Night Creature Feature – THEM! ● August 19, 2013 – Appoint/Reappoint Members to the Tomball Regional Health Foundation Board of Directors for Terms Expiring September 1, 2013 ● September 28, 2013 – Bugs, Brew & Barbecue, VW Show and MusicFest – 9:00 a.m.-6:00 p.m. ● October 26, 2013 – Tomball Bluegrass Festival – 11:00 a.m.-7:00 p.m. ● Walk Tomball! – Every Saturday at 8:00 a.m. at the Depot (New Time) ● Reports by City staff and members of council about items of community interest on which no action will be taken ○ Randy Parr presented a report regarding the City of Tomball July 4th Celebration ○ David Kauffman presented an update regarding Baker Street Water Well Rehabilitation. Minutes Regular City Council Meeting July 15, 2013 Page 3 of 4 7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the Minutes of the July 1, 2013 Special City Council Meeting and the July 1, 2013 Regular City Council Meeting. Motion carried unanimously. 8.0 New Business: 8.1 Motion was made by Councilman Townsend, second by Councilman Stoll, to read Ordinance No. 2013-08 by caption only on First Reading. Motion carried unanimously. Motion was made by Councilman Townsend, second by Councilman Dodson, to adopt, on First Reading, Ordinance No. 2013-08, an Ordinance of the City of Tomball, Texas, Establishing the Tomball Legacy Fund, Inc. for the Purpose of Receiving Private and/or Corporate Grant Funds; said Funds to be used on Behalf of the City of Tomball, Texas for Projects serving the Tomball Community; Providing for the Selection of Six (6) Seven (7) Members to Comprise the Tomball Legacy Fund, Inc. Board of Directors and for the Manner of Selection and Period of Service of Such Members; Providing for Duties and Procedures for the Tomball Legacy Fund, Inc. Board of Directors; Containing Recitations; Finding that the Meetings at which This Ordinance is Considered are open to the Public; Providing for Severability and the Repeal of Conflicting Ordinances; and Providing Other Details Relating to the Passage of This Ordinance. Vote was as follows: Councilman Stoll Aye Councilman Brown Aye Councilman Townsend Aye Councilman Dodson Aye Councilman Hudgens Aye Motion carried unanimously. 8.2 Motion was made by Councilman Dodson, second by Councilman Stoll, to approve RALEIGH CREEK SECTION ONE FINAL PLAT: A subdivision of 142.8407 Acres in the Joseph Miller Survey, Abstract Number 50, Harris County, Texas. Motion carried unanimously. 8.5 Discussion was held regarding Section 14-490(g)(4) of the Tomball Code of Ordinances and Zoning Ordinance regarding Non-conforming Lots. City staff presented information regarding current regulations for non-conforming lots. Minutes Regular City Council Meeting July 15, 2013 Page 4 of 4 Monique Dermaux, 2531 S. Cherry Street, presented information regarding her request to build on a non-conforming lot. Council requested that City staff draft suggested changes to the code of ordinances, based on direction given by Council. No action taken. 8.3 Executive Session: The Tomball City Council did not meet in Executive Session as Authorized by Title 5, Chapter 551, Government Code, the Texas Open Meetings Act, for the Following Purpose: ● Sec. 551.071 – Private Consultation with Attorney in Closed Meeting regarding Pending or Threatened Litigation or a Matter that the Duty of the Attorney Requires be Discussed in Closed Session. 8.4 The Tomball City Council did not continue with the Workshop Session regarding the Fiscal Year 2013-2014 Budget. 9.0 Motion was made by Councilman Townsend, second by Councilman Brown, to adjourn.
