MINUTES OF REGULAR CITY COUNCIL MEETING CITY OF TOMBALL, TEXAS MONDAY, MAY 4, 2015 6:00 P.M. 1.0 Call to Order The Council meeting was called to order at 6:00 p.m. by Mayor Fagan. Other members present: Councilman Townsend Councilman Klein Quinn Councilman Hudgens Councilman Degges Councilman Stoll Others present: City Manager – George Shackelford City Secretary – Doris Speer City Attorney – Loren Smith Police Chief – Billy Tidwell Fire Chief – Randy Parr Marketing Director – Mike Baxter Finance Director – Glenn Windsor Public Works Director – David Esquivel Director of Community Development – Craig Meyers City Engineer – Lori Lakatos Fire Marshal – Doug Sanguedolce Building Official – Ken Cole Executive Director-TEDC – Kelly Violette NWEMS Director – Brian Bayani 2.0 The invocation was led by Arthur Torres, American Legion Post 127 3.0 The pledges to U. S. and Texas Flags were led by U. S. Army Recruiters Pierce and Lee. 4.0 No public comments were received. Minutes Regular City Council Meeting May 4, 2015 Page 2 of 4 5.0 Presentations: • Mayor Fagan presented a Proclamation for May 4-10, 2015 is “Texas Travel and Tourism Week – Tomball, Texas” to Mike Baxter and announced that Mike Baxter is now a Certified Festivals and Events Executive. 6.0 Reports and Announcements:  May 9, 2015 – 2nd Saturday at the Depot  May 17, 2015 –Lions Club Car Show at the Depot  May 23, 2015 – 4th Annual Memorial Day Weekend Chili Challenge  June 1 through July 30 – Meetings of the City Council, Planning and Zoning Commission, Board of Adjustments, Tourism Advisory Committee, and Tomball Municipal Court Sessions will be held at the Public Works Building, 501 James Street, due to renovations at City Hall.  Walk Tomball! – Every Saturday at 8:00 a.m. at the Depot  Reports by City staff and members of Council about items of community interest on which no action will be taken: ◦ Glenn Windsor presented the Quarterly Investment Report for the Quarter ending March 31, 2015. The Public Funds Investment Act requires that a report of the City's investments be presented to Council on a quarterly basis. The investment report includes a listing of all investments together with information relating to diversification, cost vs. market values, yield information, and weighted average maturities. On March 31, 2015, the City had total cash equivalents and investments totaling $55,712,077. A copy of the report is attached for review. ◦ Mike Baxter presented a report on the success of the Rails and Tails Mudbug Festival, with “Roux Run” at Depot Downs ◦ David Esquivel presented a report on the success of the Annual Spring Clean- Up and Chipping Week and Tomball Consolidated Recycling Day ◦ Billy Tidwell reported on the successful cleanup performed at 411 Fannin by Sgt. Rebecca Carlisle and the Explorers; he also invited Council and the members of the audience to attend “Tip a Cop” on Wednesday, May 6, at Pecos Grilling Company, from 6 p.m. to 9 p.m., a fundraising event for the Special Olympics that will be coming through Tomball on Wednesday, May 20. ◦ Mayor Fagan announced that the Memorial Service for Ken Walden, volunteer Depot Station Agent, will be held on Saturday, May 16, 2015 at 10:00 a.m. ◦ Councilman Townsend suggested a photo of Ken Walden be framed and mounted in the Depot. 7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the Minutes of the April 20, 2015 Regular City Council Meeting. Motion carried unanimously. Minutes Regular City Council Meeting May 4, 2015 Page 3 of 4 8.0 Old Business: 8.1 Motion was made by Councilman Townsend, second by Councilman Klein Quinn, to adopt, on Second Reading, Ordinance No. 2015-08, an Ordinance of the City of Tomball, Texas, Authorizing the Redemption Prior to Maturity of Outstanding City of Tomball, Texas Waterworks and Sewer System Revenue Bonds, Series 1999. Vote was as follows: Councilman Hudgens Aye Councilman Stoll Aye Councilman Degges Aye Councilman Townsend Aye Councilman Klein Quinn Aye Motion carried unanimously. 9.0 New Business: 9.1 Mayor Fagan opened the Public Hearing regarding a Proposed STRATEGIC PARTNERSHIP AGREEMENT between the City of Tomball, Texas and Harris County Municipal Utility District No. 27 at 6:17 p.m. Receiving no public comments, Mayor Fagan closed the Public Hearing at 6:17 p.m. 9.2 Mayor Fagan opened the Public Hearing regarding a Proposal to Adopt an Ordinance Creating Reinvestment Zone No. 5; said Reinvestment Zone No. 5 is Proposed to Include a Tract of Land Containing 17.387 Acres, More or Less (Packers Plus) at 6:20 p.m. Receiving no public comments, Mayor Fagan closed the Public Hearing at 6:20 p.m. 9.3 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve Resale Deed for Property acquired by Foreclosure Tax Sale in Cause No. 1998-28221, styled City of Tomball, vs. Hester, Hattie, Miss, said Property being described as: Lot 50, Block 103, Tomball, Located in Harris County, Texas and being More Particularly Described in Volume 375, Page 72 of the Real Property Records of Harris County, Texas (Account No. 035-281-004-0050) Motion carried unanimously. 9.4 Motion was made by Councilman Townsend, second by Councilman Klein Quinn, to approve the trade-in of 10-year-old Hydraulic Equipment no longer being used in Front- line Service for a Mid-size New 28-Inch Spreader. Motion carried unanimously. Minutes Regular City Council Meeting May 4, 2015 Page 4 of 4 9.5 Consideration to Authorize the Mayor to Sign the Updated Harris County Emergency Management Plan Basic Plan Document was withdrawn at the request of the City Manager. No action taken. 9.6 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve and authorize the City Manager to Execute Pipeline Relocation/Reimbursement Agreement with Tortuga Operating Company ("Tortuga"), in the Amount of $313,028.00. Motion carried unanimously. 9.7 Motion was made by Councilman Stoll, second by Councilman Townsend, to approve P D & J Enterprises: Being a subdivision of 0.3213 acre of land situated in the William Hurd Survey, Abstract Number 371, of Harris County, Texas, and being a replat of Lots 20, 21, 22 and 23, in Block 81 of Revised Map of Tomball, according to the map or plat thereof recorded in Volume 4, Page 25 of the Map Records of Harris County, Texas. Motion carried unanimously. 9.8 Motion was made by Councilman Degges, second by Councilman Klein Quinn, to approve Additional Services with GMS Home Inspection Service, LLC to Perform On- Call Residential and Commercial Plan Review and Inspection Services for an Amount Not to Exceed $75,000. Motion carried unanimously. 10.0 Motion was made by Councilman Hudgens, second by Councilman Stoll, to adjourn. Motion carried unanimously. Meeting adjourned.
