MINUTES OF REGULAR CITY COUNCIL MEETING CITY OF TOMBALL, TEXAS MONDAY, NOVEMBER 7, 2016 6:00 P.M. 1.0 Call to Order The Council meeting was called to order at 6:00 p.m. by Mayor Fagan. Other members present: Councilman Hudgens Councilman Stoll Councilman Degges Councilman Townsend Councilman Klein Quinn Others present: City Manager – George Shackelford Assistant City Manager – Robert Hauck City Secretary – Doris Speer City Attorney – Loren Smith Fire Chief – Randy Parr Marketing Director – Mike Baxter HR Director – Lisa Coe Director of Public Works – David Esquivel Director of Community Development – Craig Meyers Assistant City Planner – Amelia Lindley IT Manager – Doug Tippey IT Specialist – Ben Lato Executive Director-TEDC – Kelly Violette Police Detective – James Harral 2.0 The invocation was led by Steve Allison, Chaplain, VFW 2427. 3.0 Pledges to U. S. and Texas Flags were led by Alanna Ford and Garrett Minor, members of Tomball Memorial High School Student Council. Minutes Regular City Council Meeting November 7, 2016 Page 2 of 5 4.0 The following public comment was received: Rodney Hutson - Expressed his support for the restoration of the Old 9431 Rosie Lane, 77354 City Hall and his opposition to leasing the building to a for-profit organization. 5.0 Mayor Fagan made the following presentations:  Proclamation – “Dovie Taylor - 95th Birthday” Celebration Day  Eagle Scout Heinze Emil Weidmann – Presentation of Eagle Scout Letter 6.0 Reports and Announcements:  November 12, 2016 – 2nd Saturday at the Depot  November 18, 2016 – "Downtown Holiday Lamp Post Stroll"  November 19, 2016 – 51st Annual Tomball Holiday Parade  November 24-25 – Thanksgiving Holidays; City offices will be closed  December 9-11, 2016 – Tomball German Christmas Market  December 10, 2016 – “Christmas on Commerce” – a 2nd Saturday at the Depot Event  December 23 and 26, 2016 – Christmas Holidays – City offices closed  January 2, 2017 – New Year’s Day Holiday – City offices closed  Reports by City staff and members of Council about items of community interest on which no action will be taken: ◦ Lisa Coe reported on the success of the “4th Annual “Paces4Pink” 5K Run/Walk and 1 Mile Run/Walk”. Mayor Fagan presented a check in the amount of $8,065.94 to LeeAnn Kroon, Executive Director of TOMAGWA. ◦ Mike Baxter – Report on the success of the “5th Annual Tomball Bluegrass Festival” ◦ Doug Tippey – Update regarding GIS Project ◦ Kelly Violette – The Tomball Economic Development Corporation received a Merit Recognition Award at the Texas Economic Development Council's 2016 Community Economic Development Awards (CEDA) Luncheon on October 20, 2016 ◦ Craig Meyers – Community Development Department received the “Planning Excellence Award” 7.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the Minutes of the October 17, 2016 Regular Council Meeting. Motion carried unanimously. Minutes Regular City Council Meeting November 7, 2016 Page 3 of 5 8.0 Old Business: 8.1 Motion was made by Councilman Townsend, second by Councilman Stoll, to adopt, on Second Reading, Ordinance No. 2016-27, an Ordinance of the City of Tomball, Texas, Amending Chapter 50 (Zoning) of the Tomball Code of Ordinances by Changing the Zoning District Classification of Approximately 11.898 Acres of Land, Legally Described as 11.898 Acres of Land Situated in the Sam Lewis Survey, Abstract Number 1704, City of Tomball, Harris County, Texas, Being a Portion of That Certain Called 160.3 Acres of Land Described in Deed and Recorded under Volume 942, Page 191 of the Deed Records of Harris County, Texas, within the City of Tomball, Harris County, Texas, from the Agricultural District to the Commercial District; Said Property Being Generally Located at the Southeast Corner of SH 249 Bypass and Alice Road; Providing for the Amendment of the Official Zoning Map of the City; Providing for Severability; Providing for a Penalty of an Amount Not to Exceed $2,000 for Each Day of Violation of Any Provision Hereof, Making Findings of Fact; and Providing for Other Related Matters. Vote was as follows: Councilman Hudgens Aye Councilman Stoll Aye Councilman Degges Aye Councilman Townsend Aye Councilman Klein Quinn Aye Motion carried unanimously. 9.0 New Business: 9.1 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve Request by The Houston Repertoire Ballet (HRB) for Financial Support for Six Performances of "The Nutcracker" Ballet, held December 2 - 4, 2016 at the Tomball High School Theatre, in the Amount of $12,500. Motion carried unanimously. 9.2 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve an Agreement with the Tomball Sports Association for the City of Tomball to Reimburse Expenditures for Improvements at the Wayne Stovall Sports Complex. Motion carried unanimously. Minutes Regular City Council Meeting November 7, 2016 Page 4 of 5 9.3 Motion was made by Councilman Townsend, second by Councilman Quinn, to proceed with the necessary remediation activities for the Old City Hall Building, Located at 107 N. Cherry Street. Additional consideration regarding the future of the building will be considered following remediation. Motion carried unanimously. 9.4 Motion was made by Councilman Stoll, second by Councilman Townsend, to approve the recommended amendments to Administrative Policy No. 23, entitled “Park Reservation Policy”. Motion carried unanimously. 9.5 Motion was made by Councilman Townsend, second by Councilman Stoll, to authorize the City Manager to Execute the Renewal of the Public Safety Corporation (Crywolf) Contract for an Additional Three-Year Term with Two (2) One-Year Extensions. Motion carried unanimously. 9.6 Executive Session: The City Council recessed at 7:10 p.m. into Executive Session as Authorized by Title 5, Chapter 551, Government Code, the Texas Open Meetings Act, for the Following Purpose(s): • Sec. 551.071 - Consultation with the City Attorney regarding a matter that the Attorney’s duty requires to be discussed in closed session. Upon reconvening into Regular Session at 7:55 p.m., the following action was taken: 9.7 Consideration to Terminate the Professional Services Agreement with LJA Engineering and Approve the Professional Services Agreement for Engineering Services to Gunda Corporation for the M121 East & West Drainage Channels & Detention Basin Final Design was postponed, at the request of Council. No action taken. 10.0 Motion was made by Councilman Townsend, second by Councilman Degges, to adjourn. Motion carried unanimously. Meeting adjourned.
