1.0 Call to Order
The Council meeting was called to order at 6:00 p.m. by Mayor Fagan. Other members present:

5.0 Reports and Announcements:
● March 22, 2018 – Tomball Comprehensive Plan Update Open House – Public
Works Building, 501 James Street, 5:00 p.m. to 8:00 p.m.
● March 29, 2018 – Public Retirement Reception Honoring George
Shackelford, City Manager, at the Community Center, from 3:00 p.m. to 5:00
p.m.
● April 14, 2018 – 2nd Saturday at the Depot
● April 28, 2018 – Lions Club Car Show – Lone Star College-Tomball
● Reports by City staff and members of council about items of community interest
on which no action will be taken:
◦ Denise Fiore and Larrissa Roberts presented a report of the plans for Kids
Club 2018. Councilman Townsend requested possible consideration by
Council for the use of a City-owned surplus lot to create a Community
Garden.
6.0 Motion was made by Councilman Townsend, second by Councilman Stoll, to approve the
Minutes of the following Tomball City Council Meetings:

Motion carried unanimously.
7.0 Old Business:
7.1 Motion was made by Councilman Townsend, second by Councilman Stoll, to adopt, on
Second Reading, Ordinance No. 2018-13, an Ordinance of the City of Tomball, Texas,
Finding and Determining that the Public Convenience and Necessity no longer require
the Continued Existence of a Certain Portion of a City of Tomball Utility Easement
across a Certain 0.129 Acre Tract of Land Being Out of Lot 1 in Block 1 of the Fourteen
Six Hundred Business Park Subdivision of Which is Recorded in Film Code 680728 of
the Map Records of Harris County, Texas; Vacating, Abandoning, and Closing Said
Portion of Such City of Tomball Utility Easement; Authorizing the City Manager to
Execute and the City Secretary to Attest a Quitclaim Deed Quitclaiming the City’s
Interest in Said Abandoned Easement; and Containing Other Provisions Relating to the
Subject. Vote was as follows:

8.0 New Business:
8.1 Glenn Windsor and Amanda Eaves, CPA-BKD, LLP presented the Comprehensive
Annual Financial Report (CAFR) for the Fiscal Year Ending September 30, 2017.
No action was taken.
8.2 Mayor Fagan opened the Public Hearing of the City Council of the City of Tomball to
Consider the Advisability of the Creation of a Public Improvement District to make
Certain Improvements over Certain Property located within the Corporate Limits of the
City of Tomball (TPID 7 – Grand Junction Subdivision) at 6:30 p.m.
Receiving no public comments, Mayor Fagan closed the public hearing at 6:30 p.m.
8.3 Motion was made by Councilman Klein Quinn, second by Councilman Ford, to approve
Resolution No. 2018-07, a Resolution Making Findings in Connection with the Proposed
Public Improvement District Number Seven Related to the Advisability of the
Improvements, the Nature of the Improvements, the Estimated Cost of the Improvements,
the Boundaries of the Proposed District, the Method of Assessment and the
Apportionment of Cost Between the District and the City as a Whole; and Making Other
Findings Related to the District.
Motion carried unanimously.
8.4 Motion was made by Councilman Ford, second by Councilman Stoll, to approve
Resolution No. 2018-08, a Resolution Authorizing the Establishment of the Public
Improvement District Number Seven in the City of Tomball, Texas; Authorizing
Publication of This Resolution, Providing for the Preparation of a Service and
Assessment Plan; and Making Other Provisions Related to the Subject.
Motion carried unanimously.
8.5 Motion was made by Councilman Stoll, second by Councilman Townsend, to approve
Development Agreement between the City of Tomball and Tomball Grand Junction, LLC
for the Construction of Improvements in Tomball Public Improvement District Number
Seven (TPID 7), Grand Junction Subdivision.

8.6 Motion was made by Councilman Stoll, second by Councilman Townsend, to approve
Resolution No. 2018-09, a Resolution Declaring the Intention of the City of Tomball,
Texas, to Institute Proceedings to Annex Certain Territory; Describing Such Territory;
Setting the Dates, Times, and Places for Two Public Hearings at Which All Interested
Parties Shall Have an Opportunity to be Heard; Providing for Publication of Notices of
Such Public Hearings; and Directing Preparation of a Municipal Service Plan for the
Territory Proposed to be Annexed (Being a 2.844-Acre Tract of Land in the Jesse Pruitt
Survey, Abstract No. 629, Harris County Texas, Out of and a Part of that Certain 4.8914-
Acre Tract of Land Described in Deed Recorded under Clerk’s File No. 2013-0036029 of
the Official Public Records of Real Property of Harris County, Texas, Located at 22828
Hufsmith-Kohrville Road).
Motion carried unanimously.
8.7 No consideration or possible action was taken regarding a Joint Venture between
Tomball Sports Medicine Center, Tomball Regional Hospital, the City of Tomball, Harris
County, and Tomball Regional Health Foundation for a Community Wellness Center.
An item will be placed on the April 2, 2018 agenda to appoint a City representative to the
workgroup.
8.8 Motion was made by Councilman Townsend, second by Councilman Klein Quinn, to
approve Resolution No. 2018-10, a Resolution of the City Council of the City of
Tomball, Texas, Sponsoring the July 4th Celebration, to be Held in Tomball on
Wednesday, July 4, 2018, Closing State Highway Business 249 from Hicks Street to the
North Entrance to the Kroger Parking Lot from 3:00 PM until 11:00 PM, and Authorizing
the City Manager to Issue a Letter to TxDOT Requesting the Closure of the Designated
Portion of State Highway Business 249.
Motion carried unanimously.
8.9 Motion was made by Councilman Townsend, second by Councilman Stoll, to award
Contract for E&P CIP No. 2017-10031, Project No. 2018-01, City of Tomball Broussard
Community Park Site Improvements, to Diffco, LLC in the Amount of $853,616.52.
Motion carried unanimously.
8.10 Motion was made by Councilman Townsend, second by Councilman Stoll, to read
Ordinance No. 2018-14 by caption only on First Reading.
Motion carried unanimously.
Motion was made by Councilman Townsend, second by Councilman Stoll, to adopt, on
First Reading, Ordinance No. 2018-14, an Ordinance Altering the Prima FacieSpeed
Limits Established for Vehicles under the Provisions of §545.356, Texas Transportation

Code, upon the Basis of an Engineering and Traffic Investigation, upon Certain Streets
and Highways, or Parts Thereof, within the Corporate Limits of The City of Tomball, as

Exceed Two Hundred Dollars ($200.00) for the Violation of this Ordinance. Vote was as
follows:
