Notice is hereby given of a Regular meeting of the Tomball City Council, to be held on
Monday, February 15, 2021 at 6:00 PM, City Hall, 401 Market Street, Tomball, Texas 77375,
for the purpose of considering the following agenda items. All agenda items are subject to
action. The Tomball City Council reserves the right to meet in a closed session for
consultation with attorney on any agenda item should the need arise and if applicable
pursuant to authorization by Title 5, Chapter 551, of the Texas Government Code.
IN ACCORDANCE WITH ORDER OF THE OFFICE OF THE GOVERNOR ISSUED
MARCH 16, 2020, THE CITY COUNCIL OF THE CITY OF TOMBALL, TEXAS, WILL
CONDUCT THE MEETING SCHEDULED FOR FEBRUARY 15, 2021, 6:00 PM, AT 401
MARKET STREET, TOMBALL, TEXAS, 77375. IN ORDER TO ADVANCE THE
PUBLIC HEALTH GOAL OF LIMITING FACE-TO-FACE MEETINGS (ALSO
CALLED “SOCIAL DISTANCING”) TO SLOW THE SPREAD OF THE
CORONAVIRUS (COVID-19), THERE WILL BE LIMITED PUBLIC ACCESS TO THE

I. Luisa Taylor – Quarterly Investment Report for Period Ending December
31, 2020. The Public Funds Investment Act requires that a report of the
City's Investments be presented to Council on a quarterly basis. The
investment report includes a listing of all investments together with
information relating to diversification, cost vs. market values at the end of
the quarter, yield information, and weighted average maturities. On
December 31, 2020, the City had total cash and cash equivalents in the
amount of $57,727,800.

1. Approve the Minutes of the February 1, 2021 Regular Tomball City Council
Meeting
G. Old Business
1. Adopt on Second Reading, Ordinance No. 2021-11, an Ordinance of the City
Council of Tomball, Texas, Levying an Assessment against Section Seven and
Eight Properties within the City of Tomball Public Improvement District Number
Two (Raleigh Creek Subdivision); and Making Certain Findings Related Thereto.
H. New Business
1. Consideration to approve Zoning Case P21-011: Request by David Weekley
Homes to amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by
rezoning approximately 13.4 acres of land legally described as Tracts 17H, 17J,
17H-1, 17H-2, 17J-1 Abstract 34 J House, from the Planned Development (PD-1)
and Single-Family 20 Estate Districts to the Planned Development (PD-16)
District. The property is generally located on the south side of Brown Road
between SH 249 and Quinn Road, within the City of Tomball, Harris County,
Texas.

City of Tomball, Texas, amending Chapter 50 (Zoning) of the Tomball
Code of Ordinances by changing the zoning district classification of
approximately 13.4 acres of land, legally described as tracts 17H, 17J,
17H-1, 17H-2, 17J-1 abstract 34 J House, within the city of Tomball,
Harris County, Texas, from the Planned Development (PD-1) and Single-
Family 20 Estate Districts to the Planned Development (PD-16) District;
said property being generally located on the south side of Brown Road
between SH 249 and Quinn Road; providing for the amendment of the
Official Zoning Map of the City; providing for severability; providing for
a penalty of an amount not to exceed $2,000 for each day of violation of
any provision hereof, making findings of fact; and providing for other

2. Conduct Public Hearing for the Purpose of Considering the Following

3. Adopt, on First Reading, Ordinance No. 2021-03, An Ordinance Of The City Of
Tomball, Texas, Extending The City Limits Of Said City To Include All Of The
Territory Within Certain Limits And Boundaries And Annexing To The City Of
Tomball All Of The Territory Within Such Limits And Boundaries; Approving A
Service Plan For All Of The Area Within Such Limits And Boundaries;
Containing Other Provisions Relating To The Subject; And Providing A Savings
And Severability Clause (Being A Tract Or Parcel Containing 6.5681 Acres Of
Land Known As Tracts 1 & 2 Out Of That Certain Call 40.1148 Acre Tract Of

4. Consideration to approve Zoning Case P20-436: Request by Paul Hicks to amend
Chapter 50 (Zoning) of the Tomball Code of Ordinances by establishing the
zoning district of approximately 6.5681 acres of land legally described as Tract 12
Abstract 375 J M Hooper, as Commercial District. The property is generally
located at the southwest corner of SH 249 and Alice Road, Harris County, Texas.

of Tomball, Texas, amending Chapter 50 (Zoning) of the Tomball Code of

Ordinances by establishing the zoning district of approximately 6.5681

within the city of Tomball, Harris County, Texas, as Commercial District;
said property being generally located at the southwest corner of SH 249
and Alice Road; providing for the amendment of the Official Zoning Map
of the City; providing for severability; providing for a penalty of an
amount not to exceed $2,000 for each day of violation of any provision
hereof, making findings of fact; and providing for other related matters.
5. Consideration and possible action to approve, as a Project of the Tomball Economic
Development Corporation, an agreement with Kinsley Armelle to make direct
incentives to, or expenditures for, the creation or retention of primary jobs
associated with the relocation and development of its corporate headquarters to be
located at 21255 Spell Circle, Tomball, Texas 77375. The estimated amount of
expenditures for such Project is $45,000.00.
6. Approve, on First Reading, Resolution No. 2021-07-TEDC, a Resolution of the
City Council of the City of Tomball, Texas, authorizing and approving the Tomball
Economic Development Corporation’s Project to Expend Funds in accordance with
an Economic Development Agreement by and between the Corporation and The
Hutson Group to make direct incentives to, or expenditures for, the construction of
capital improvements, including pedestrian and parking improvements, along
Houston Street and North Elm Street in Old Town Tomball. The estimated amount
of expenditures for such Project is $48,800.00.
7. Accept Donation of a Grant from the Tomball Health Foundation in the Amount
of $490,000 for the Proposed Improvements to Jerry Matheson Park.
8. Approve Resolution No. 2021-09, a Resolution of the City Council of the City of
Tomball, Texas approving a Reimbursement Agreement relating to the Wood
Leaf Reserve Public Improvement District.
9. Approve Resolution No. 2021-10, a Resolution of the City Council of the city of
Tomball, Texas supporting the proposed Tomball Senior Village Housing
Community; approving an application for federal housing tax credits to finance
such project; providing an in kind contribution for such project and providing an
effective date.
10. Consideration to approve Zoning Case P21-010: Request by Daniel Valdez with
META Planning + Design LLC to amend Chapter 50 (Zoning) of the Tomball
Code of Ordinances by rezoning approximately 34.4945 acres of land legally
described as Reserve A & B Block 1 Peck Station, from the Planned Development
(PD-6) District to the Planned Development (PD-15) District. The property is

generally located on the west side of FM 2978 at Winfrey Lane, within the City of
Tomball, Harris County, Texas.
Conduct Public Hearing on Zoning Case P21-010
Adopt, on First Reading, Ordinance No. 2021-08, an Ordinance of the city
of Tomball, Texas, amending Chapter 50 (Zoning) of the Tomball Code of
Ordinances by changing the zoning district classification of approximately
31.7 acres of land, legally described as Reserve A & B Block 1 Peck
Station, within the city of Tomball, Harris County, Texas, from the
Planned Development (PD-6) District to the Planned Development (PD-
15) District; said property being generally located on the west side of FM
2978 at Winfrey Lane; providing for the amendment of the Official
Zoning Map of the City; providing for severability; providing for a penalty
of an amount not to exceed $2,000 for each day of violation of any
provision hereof, making findings of fact; and providing for other related
matters.
11. Consideration to approve Zoning Case P20-442: Request by Joshua Bezzell to
amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by rezoning
approximately 5 acres of land legally described as Lot 280 Tomball Outlots, from
the Single-Family 20 Estate District to the Commercial District. The property is
generally located on the east side of Pitchford Road at 1333 Pitchford Road,
within the City of Tomball, Harris County, Texas.
Conduct Public Hearing on Zoning Case P20-442
Adopt, on First Reading, Ordinance No. 2021-09, an Ordinance of the
City of Tomball, Texas, amending Chapter 50 (Zoning) of the Tomball
Code of Ordinances by changing the zoning district classification of
approximately 5 acres of land legally described Lot 280 Tomball Outlots,
from the Single-Family 20 Estate District to the Commercial District, said
property being generally located on the east side of Pitchford Road at 1333
Pitchford Road, within the City of Tomball, Harris County, Texas;
providing for the amendment of the Official Zoning Map of the City;
providing for severability; providing for a penalty of an amount not to
exceed $2,000 for each day of violation of any provision hereof, making
findings of fact; and providing for other related matters.
12. Consideration to approve Zoning Case P20-420: Request by Sam Dawoudi to
amend Chapter 50 (Zoning) of the Tomball Code of Ordinances by rezoning
approximately 2.844 acres of land legally described as Tracts 467A, 467B &
468A Tomball Outlots, from the Agricultural District to the Commercial District.
The property is generally located on the east side of Hufsmith-Kohrville Road at
22828 Hufsmith-Kohrville Road, within the City of Tomball, Harris County,
Texas.

Adopt, on First Reading, Ordinance No. 2021-10, an Ordinance of the
City of Tomball, Texas, amending Chapter 50 (Zoning) of the Tomball
Code of Ordinances by changing the zoning district classification of
approximately 2.844 acres of land legally described tracts 467A, 467B &
468A Tomball Outlots, from the Agricultural District to the Commercial
District, said property being generally located on the east side of
Hufsmith-Kohrville Road at 22828 Hufsmith-Kohrville road, within the
city of Tomball, Harris County, Texas; providing for the amendment of
the Official Zoning Map of the City; providing for severability; providing
for a penalty of an amount not to exceed $2,000 for each day of violation
of any provision hereof, making findings of fact; and providing for other
related matters.
13. Authorize City Manager to execute a Professional Services Agreement with
Freese & Nichols for the development of the Risk and Resilience Assessment and
Emergency Response Plan required by the American Water Infrastructure Act of
2018.
14. Executive Session: The City Council will meet in Executive Session as
Authorized by Title 5, Chapter 551, Government Code, the Texas Open Meetings
Act, for the Following Purpose(s):
