City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Tuesday, August 21, 2018 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Varney, Council Members Adams, Kelly and Law. Councilwoman Hill was absent but excused. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Engineer Harkins, Chief of Police Hurd, Building Official Estes, Emergency Medical Services (EMS) Executive Director Yates and Deputy City Clerk Anaya. Mayor Varney called the meeting to order. Chief of Police Hurd led the Pledge of Allegiance. Mayor Varney read a thank you card from the Goshen County Task Force on Family Violence and Sexual Assault expressing their gratitude for the City’s ongoing support of the program. Councilman Kelly moved and Councilman Adams seconded to approve the consent agenda which includes the minutes from the 08-07-18 Council meeting as published and all actions therein be ratified. Motion carried unanimously. Councilman Law moved and Councilman Adams seconded to approve the agenda as presented. Motion carried unanimously. Deborah Alden with J&B Liquor requested approval of a catering permit for a Home on the Range “Sip and Shop” Third Thursday Event that was held at 2016 Main Street on August 16, 2018 from 4:30 p.m. to 8:00 p.m. Mayor Varney stated that Ms. Alden inadvertently missed the deadline for the 08-07-18 Council meeting and that the requested approval is a formality to ratify the catering permit that was approved by the Mayor and Council via e-mail on 08-13-18. Councilman Law moved and Councilman Kelly seconded to approve the catering permit that was approved via e-mail on 08-13-18. Motion carried unanimously. Patrick Zimmerer with Table Mountain Vineyards, LLC requested approval of a catering permit for a Goshen County Chamber of Commerce/Economic Development Third Thursday Event that was held at 21st & Main on August 16, 2018 from 4:00 p.m. to 9:00 p.m. Mayor Varney indicated that Mr. Zimmerer also unintentionally missed the deadline for the 08-07-18 Council meeting, thus the requested approval is a formality to ratify the catering permit that was approved by the Mayor and Council via e- mail on 08-15-18. Councilman Law moved and Councilman Kelly seconded to approve the catering permit that was approved via e-mail on 08-15-18. Motion carried unanimously. Mayor Varney declared a conflict of interest and excused himself so that the Council could consider the approval of ordinances on third reading relating to the annexation and zoning of the ATEC Addition located at 3401 West C Street. Attorney Eddington read by title AN ORDINANCE ANNEXING WITHIN THE CORPORATE LIMITS OF THE CITY OF TORRINGTON, WYOMING, REAL PROPERTY TO BE KNOWN AS THE “ATEC ADDITION.” Councilman Law moved and Councilman Kelly seconded to approve Ordinance No. 1200 as presented on third reading. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18-16- 030 OF THE TORRINGTON MUNICIPAL CODE, 2018 REVISIONS, RELATING TO THE CITY OF TORRINGTON, WYOMING, AMENDING THE ZONING DISTRICT MAP BY ESTABLISHING “A-L” ZONING FOR A TRACT OF LAND. Councilman Kelly moved and Councilman Law seconded to approve Ordinance No. 1201 as presented on third reading. Motion carried unanimously. EMS Executive Director Yates presented for approval revised EMS Charges. He commented that charges have not been revised in four years and indicated that if approved, the new charges will become effective September 1, 2018. He stated that he is proposing a $50.00 increase to both basic life support (BLS) and advanced life support (ALS) rates, and a $1.00 increase to the mileage rate. Other revisions include increases to rates to compensate for expenses. Councilman Adams inquired about the new charges that are listed. EMS Executive Director Yates responded that the charges are associated with new practices that are now being followed and a new piece of equipment that is now being carried. Councilman Adams questioned why the charges for Narcan and Glucagon doubled in price. EMS Executive Director Yates replied that there has been such an increase in demand for the two items which in turn inflates the cost, the proposed charges will be sufficient to cover the increase in cost. Councilman Adams moved and Councilman Kelly seconded to approve the EMS Charges to be effective September 1, 2018 as presented. Motion carried unanimously. Mayor Varney noted the time had arrived for the Council to adjourn from regular session and convene as a Board of Adjustment. Mayor Varney stated Kendal Richards at 2928 West A Street requested a Conditional Use Permit for an in-home daycare allowing a maximum of up to 10 unrelated children. He opened the public hearing for consideration of the permit and asked for public comments for or against the approval of the permit, none were heard. The public hearing was closed. Building Official Estes indicated the Planning Commission approved the request at their 08-14-18 meeting, staff recommends approval and he has Page | 1 received no public comment. Councilman Law moved and Councilman Adams seconded to approve the permit for Kendal Richards as presented. Motion carried unanimously. Mayor Varney stated Larry Rice at 1101 East 28th Avenue requested a Conditional Use Permit to be allowed to operate a small office in an unattached building located on the same property as the main residence. He opened the public hearing for consideration of the permit and asked for public comments for approval of the permit. Larry Rice addressed the Mayor and Council. He commented that he is moving the headquarters for his ranching operation to this property and indicated that an important aspect of purchasing the property from former owner, Bill Rueb, was the historical use of the office at the location. Mr. Rice stated that the office would strictly be utilized as a bookkeeping control center for Flag Ranch, LLC. His employees, which will at a maximum be two, will access the office from the north entrance on East 28th Avenue. Councilman Adams inquired if Mr. Rice anticipated to have people in connection with the business going to conduct business at the proposed location. Mr. Rice replied no, it will strictly be used as the headquarters site. Councilman Kelly questioned why a Conditional Use Permit is required in this instance. Building Official Estes responded that zoning ordinances do not allow individuals to have an in-home business that is not inside of the home. The small office that Mr. Rice intends to utilize for the business is located within an accessory building on the property, which justifies why the Conditional Use Permit is required. Mayor Varney asked for public comments against the approval of the permit, none were heard. The public hearing was closed. Councilman Adams moved and Councilman Law seconded to approve the permit for Larry Rice as presented. Motion carried unanimously. Mayor Varney stated Alison Reza, Motazedi Firouzeh and Tim Uhrik at 1818 Main Street requested a setback variance on the north side from the required 95’ from the centerline of Highway 26 to 67.3’ for a 27.7’ variance and a setback variance on the south side from the required 24’ to 17.5’ for a 6.5’ variance. Building Official Estes indicated that O’Reilly Auto Parts will be constructing an entirely new building on the property. He explained that both entrances need to be kept to allow for freight trucks to be able to enter and exit. The east entrance, however, will be designated as entrance only. Patron parking will be located on the west and east side of the new building and not the north. Mayor Varney opened the public hearing for consideration of the variance requests. He asked for public comments for or against the approval of the variance requests, none were heard. The public hearing was closed. Councilman Law moved and Councilman Adams seconded to approve the variance requests for the property located at 1818 Main Street as presented. Motion carried unanimously. Mayor Varney returned the Council to regular session. Building Official Estes stated Alison Reza, Motazedi Firouzeh and Tim Uhrik requested a zone change from I-2 to C-S for the property located at 1818 Main Street. He indicated that in order for O’Reilly Auto Parts to be able to construct their new store, the zoning for the property needs to be changed from Industrial (I-2) to Commercial Service District (C-S). Building Official Estes stated the Planning Commission approved the request at their 08-14-18 meeting, staff recommends approval and he has received no public comment. Councilman Kelly moved and Councilman Adams seconded to approve the ordinance on first reading as presented. Motion carried unanimously. The bills from 08-08-18 to 08-21-18 were presented for payment. Councilman Adams moved and Councilman Law seconded to approve the bills for payment as presented. Motion carried unanimously. Chief of Police Hurd introduced Peace Officer Nicholas Jenkins to the Mayor and Council. Councilman Adams moved and Councilman Kelly seconded to adjourn to executive session to discuss personnel. Motion carried unanimously. Councilman Law moved and Councilman Adams seconded to return the Council to regular session. Motion carried unanimously. Councilman Law moved and Councilman Adams seconded to approve the Airport Manager Assistant Operating Contract between the City of Torrington and Jim Walton as presented. Motion carried unanimously.
