City of Torrington ) County of Goshen ) State of Wyoming ) The Torrington City Council met in regular session on Tuesday, November 15, 2022 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Adams, Council Members Kelly, Kinney, Patterson and Steinbock. Also Present: Attorney Eddington, Director of Public Works Harkins, Assistant Chief of Police Connelly, Buildings & Grounds Superintendent Estes, Senior Accounting Clerk Estes and Deputy City Clerk Anaya. Mayor Adams called the meeting to order. Councilman Kinney led the Pledge of Allegiance. Mayor Adams led the session with informational announcements on the following items: 1. Weather updates; 2. COVID-19/Influenza updates; 3. COVID-19 vaccine clinic update; 4. Reminder to the public to be cautious and mindful of the presence of children on the streets. Request to the public to refrain from using their cell phones while driving; 5. Rotary Club/City of Torrington additional crosswalk and signage project update; 6. Reminder to the public that the Elk Eco Cycle Recycling Center is open and is accepting cardboard, separated paper products and aluminum cans. The site is located at 310 Curtis Avenue and is open Monday through Wednesday from 8:00 a.m. to 4:00 p.m.; 7. City project/ARPA funding update; 8. General Election results. Herb Doby was elected as Mayor. Wayne Deahl and Shane Viktorin were elected as Councilmen. The newly elected officials will be sworn in at the 01-03-23 Council meeting; 9. Storm water utility/November 2022 ballot update. The election delivered unfavorable results; and 10. Announcement that Chief of Police Matthew Johnson and Apprentice Lineman IV Michael Schuler have been nominated for Goshen County Economic Development Community Awards. Councilman Kelly moved and Councilman Kinney seconded to approve the consent agenda which includes the minutes from the 11-01-22 Council meeting as published and all actions therein be ratified. Motion carried unanimously. Mayor Adams requested approval to amend the agenda as follows: 1. Add Buck Klemola Request to the Information Item List. 2. Add Wage Study Results to the Action Items List. Councilwoman Steinbock moved and Councilman Patterson seconded to approve the agenda as amended. Motion carried unanimously. Buck Klemola addressed the Mayor and Council. He expressed his concerns in regard to the recent changes to traffic control on Albany Avenue. He stated that stop signs were recently added to the Albany Avenue and Laramie Street intersection, and indicated that he feels the change is unwarranted. Mr. Klemola commented that the speed reduction in conjunction with the addition of the stop signs creates an unjustified inconvenience for the residents west of the intersection. He asked the Mayor and Council to reconsider the change. Mayor Adams thanked Mr. Klemola for the information that he provided and advised that his request would be taken into consideration. Leann Mattis with Goshen County Economic Development (GCED) requested approval of a special event permit for the 2022 Christmas Parade to be held on 12-02-22 from 5:00 p.m. to 7:30 p.m. She indicated that GCED is requesting approval to close the public street on Main Street between 19th Avenue and 25th Avenue and to have the special event permit fee waived due to the request being a community event. Councilman Patterson moved and Councilman Kinney seconded to approve the special event permit and to waive the special event permit fee as presented. Motion carried unanimously. Mayor Adams noted the time had arrived for the Mayor and Council to adjourn from regular session and convene as a Board of Adjustment. Buildings & Grounds Superintendent Estes stated that Volunteers of America (VOA) requested approval of the preliminary plat of the Southwest Wyoming Mental Health Center 3rd Filing of the Halco 1st Addition. He indicated that VOA would like to vacate and replat Lot A of the Southwest Wyoming Mental Health Center 2nd Filing of the Halco 1st Addition. Buildings & Grounds Superintendent Estes commented that VOA is presenting a preliminary plat to subdivide the Lot A subdivision into a three lot subdivision. He stated that the Planning Commission approved the request at their 11-08-22 meeting and that staff recommends approval. Buildings & Grounds Superintendent Estes stated that G.G. Ella Holdings, LLC requested a zone change from R-3 Residential to C-1 Commercial on Lot 9 and 10, Block 5, Torrington 5th Addition. The property is located at 350 West 24th Avenue. He indicated that the property was originally built as a residential home and has been operated in part as a commercial business since the late 1940’s, which was well before any official zoning took place in Torrington. Buildings & Grounds Superintendent Estes commented that in the early 1970’s the entire town was zoned and stated that in that process this specific property was zoned as R-3 Residential. He indicated that ever since then, the property has been classified as a “Legal Non-Conforming Use” and is allowed to continue its same use until such a time that the use is changed. Buildings & Grounds Superintendent Estes commented that the property recently Page | 1 sold and stated that the new owners intend to change the use of the property, therefore they are requesting to change the zoning from R-3 Residential to C-1 Commercial. He indicated that the Planning Commission approved the request at their 11-08-22 meeting, staff recommends approval and he has received no public comment. Mayor Adams opened the public hearing for consideration of the preliminary plat request. He asked for public comments in favor of or against the approval of the preliminary plat request, none were heard. The public hearing was closed. Councilman Kinney moved and Councilman Patterson seconded to approve the preliminary plat of the Southwest Wyoming Mental Health Center 3rd Filing of the Halco 1st Addition as presented. Motion carried unanimously. Mayor Adams opened the public hearing for consideration of the zoning request. He asked for public comments in favor of or against the approval of the zoning request, none were heard. The public hearing was closed. Councilman Patterson moved and Councilman Kelly seconded to approve the zone change on Lot 9 and 10, Block 5, Torrington 5th Addition from R-3 Residential to C-1 Commercial as presented. Motion carried unanimously. Mayor Adams returned the Mayor and Council to regular session. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18.16.020 OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO THE CITY OF TORRINGTON, WYOMING, AMENDING THE ZONING DISTRICT MAP BY ESTABLISHING “C-1” ZONING FOR A TRACT OF LAND. Buildings & Grounds Superintendent Estes stated that the ordinance will establish the zoning for Lot 9 and 10, Block 5, Torrington 5th Addition of the G.G. Ella Holdings, LLC property located at 350 West 24th Avenue. Councilman Kelly moved and Councilman Kinney seconded to approve the ordinance on first reading as presented. Motion carried unanimously. Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 3.04.050. OF THE TORRINGTON MUNICIPAL CODE, 2022 REVISIONS, RELATING TO SANITATION FEES. Director of Public Works (DPW) Harkins briefly summarized the proposed ordinance as it had previously been discussed in depth at a Work Session held by the City Council on 08-31-22. He stated that the major changes made to the ordinance include revisions to the Baler Tipping fees and the conversion of the Landfill Tipping fees to charge per pound instead of charge per ton with a minimum charge. DPW Harkins indicated that the Baler Tipping fees were revised to charge by the type of vehicle bringing in the waste to make it easier for the baler staff to charge the appropriate amounts. He commented that wording throughout the ordinance was also cleaned up and a fuel surcharge fee was added in order to compensate for the inconsistencies in the fuel market. Councilwoman Steinbock moved and Councilman Patterson seconded to approve the ordinance on first reading as presented. Motion carried unanimously. Attorney Eddington read a proclamation declaring 11-26-22 as Small Business Saturday. It celebrates local small businesses and the contributions they make to the local economy and community, and it urges the residents of the community and communities across the country to support small businesses and merchants on Small Business Saturday and throughout the year. Councilman Kinney moved and Councilwoman Steinbock seconded to approve the proclamation as presented. Motion carried unanimously. Director of Public Works (DPW) Harkins presented for approval the wage study results. He briefly summarized the results as they had previously been discussed in depth at a Work Session held by the City Council on 11-14-22. DPW Harkins stated that as a result of the wage study, the Wage Committee came up with recommendations for all of the various positions and a wage scale for all of those positions. He indicated that the FY23 Budget will need to be adjusted an estimated $50,534.00 for the remaining of the fiscal year if the results are approved. DPW Harkins commented that Clerk/Treasurer Strecker has requested that the wage study be made effective with the pay period ending 12-04-22. Councilman Kinney moved and Councilwoman Steinbock seconded to approve the wage study effective with the pay period ending 12-04-22 as presented. Motion carried unanimously. Golf Pro Dent presented the 2023 Golf Rates and Fees for approval. Modifications presented for approval were: Junior/Student - $160.00, Single - $550.00, Couple/Married - $765.00, Family - $860.00, College Student (12 Credit Hours) - $170.00, Senior (62 Years and Older) - $490.00, Senior Couples (Both Must be 62 Years of Age or Older and Married) - $715.00, Daily Fee 18 Holes - $31.00, Trail Fees Annual License - $250.00, Golf Cart Rental 9 Holes (Per Rider) - $10.00, Golf Cart Rental 18 Holes (Per Rider) - $14.00, 1 Year City Cart Lease (1 Person) - $475.00 and 1 Year City Cart Lease (Couple) - $605.00. Councilman Kinney moved and Councilman Patterson seconded to approve the 2023 Golf Rates and Fees as presented. Motion carried unanimously. Golf Pro Dent presented the 2023 Golf Tournament Schedule for approval. Councilman Patterson moved and Councilwoman Steinbock seconded to approve the 2023 schedule as presented. Motion carried unanimously. The bills from 11-02-22 to 11-15-22 were presented for payment. Councilman Patterson moved and Councilman Kinney seconded to approve the bills for payment as presented. Motion carried unanimously. Mayor Adams asked for public comments, questions or concerns.
