The Open Public Meetings Act was announced and a quorum was verified. It will be carried to the March 13th public hearing with no further notice being required. 24-P-359PE: 359 Pennington Ave.-Kush Dispensary Applicant: Kush Dispensary, LLC Property Address: 359 Pennington Ave. Block: 4201 Lot(s): 1 Redevelopment Area: Pennington Avenue Redevelopment Area Plan 2023 Zoning District: Industrial-Mixed Use Landmarks Historic Preservation District: Pennington Avenue Redevelopment Area Project Description: Kush Dispensary, LLC (the Applicant) is returning to the board seeking approval for a Conditional Use Permit to open and operate a recreational cannabis dispensary. The Applicant applying for the Kush Dispensary LLC's Conditional Use Permit to open and operate a cannabis dispensary asked that the matter be carried in order to give them time to engage in conversation with a local school. The Board plans to docket this matter for the March 27th hearing. Ms. Ferrara noted that the school board filed litigation in this matter. The case was heard by the court and dismissed as the litigants are trying to work things out. Last month, the Board appointed their professionals, and tonight, they moved to approve the contracts and memorialize the resolution that codified the terms of agreements for the contracts, inclusive of billable rates from January 1, 2025, to December 31, 2025. Mr. Michael Herbert, the Board’s attorney, provided the Board with his background and experience representing Boards in New Jersey. Ms. Ferrara indicated that the Board is a quasi-judicial entity and as such must have contracts between the Board and the Board’s professionals, not between the Board’s professionals and the City Council. The following vote was set forth: 2 Memorialize the resolutions that approve the contracts for the Board’s professionals; the Traffic Engineers, the Board Attorney, the Planner, and the Engineer.
