The Applicant (a Certified Mechanic) will use the structure for minor auto maintenance, which would include replacement of electrical components, alternators, starters, batteries, tune-ups, and oil changes. Major repairs will be referred out. Structural modifications are to create an opening for a garage bay entry and relocation of the front door with installation of two lifts. Requesting exception to Chapter 315-117 Use with any/all Bulk Requirements (315-120 thru 121 Parking) if applicable. Mr. Leoncio Vazquez (manager of the project), Ms. Ersenia Garcia (Applicant), and Ms. Lesbia Soc (translator and a witness) were sworn in. Mr. Vazquez described the property and what he was contracted to do on this project. He noted that Rockwell, a synthetic concrete, that offers soundproofing as well as a fire block, will be used in this construction. Parking spaces for 4 vehicles that this business can repair at a time will have a place to park on the side of the building with the proposed parking. Requirements are 4 parking spaces for each bay and 1 for each pump, plus 1 for each service vehicle used for the business. As there are no gas pumps or service vehicles planned for this business, this project requires 8 parking spaces. There will not be oil changes or tire installation done on the property. Starters, alternators, brakes, and window regulators will be the repairs performed. There will not be motors, transmissions, engines, and other such large jobs; minor repairs will be their specialty. There will be a torque wrench powered by pressured air that will be on-site for periodic use. It will be inside the garage with closed bay doors to ensure the containment of the sound. There will be an air conditioner installed in order to work inside during the summer with the bay doors down. A ventilation system and exhaust system are needed in order to prevent carbon dioxide build-up. There will be a ventilation capture system with two ‘goosenecks’ that will bring in clean air and exhaust from the air. Regarding leaking fluids from vehicles, that also needs to be addressed. A sketch of where the mechanical equipment will reside with details of the noise abatement and air abatement that is planned. Additionally, the plans for the exhaust system should be provided. The construction plans will show the fire exits and the lighting planned. The light fixtures there will be removed and replaced with updated lighting. The Board also suggested that some research be done to see if that site was a former gas station and if there might be buried oil tanks. The Tax Collection photo project in 1932 may also identify what the site was formerly. Trentoniana collection at the Trenton Public Library can be used. Ms. Soc indicated that she has known this couple for over 10 years, and they are very fastidious, and the property will be well maintained and clean once opened. Mr. Jeffrey Wilkerson, Supervising Planner with the City of Trenton, was sworn in. The City is recommended the denial of this application. Mr. Wilkerson indicated that there are 3-4 properties that abut this property on the backside. Other comments and concerns are articulated in the memo the City provided. Also, gravel is not currently an approved surface for use in the City. Mr. Ray Bucchi, Zoning Officer for the City of Trenton, was sworn in and indicated that he is not in favor of a banner being placed on the building because of difficulty with ongoing maintenance. A permanent sign with or without lighting is preferred. He recommended that the Applicant return for Preliminary and Final Site Plan approval if the use variance is granted. He noted that he would look to see if he has any records that can indicate what this was prior to tonight’s application. Adjourn the application to the Zoning Board’s Next meeting is May 18, 2022 at 7p on this platform, with expectation of revised plans, photographs, and expanded information including previous usage of this property, presence of oil tanks on the property, and the previously requested sketches of plans. Last known use is as a house of worship. STAFF COMMENTS 1. There are presently numerous automobile uses on this block of West Paul Avenue, including automobile repair and towing businesses. 2. There is a single-family residence directly neighboring the proposed garage. 3. Testimony should be provided regarding the unique attributes of the site that makes it “particularly suitable” for the proposed non-permitted use, and how locating the proposed use on this particular site in this zone specifically promotes the purposes of planning. 4. Applicant shall provide testimony to confirm the proposed use has no negative impact or detriment to neighboring residents. 5. Applicant shall provide testimony as to the level of noise during operation. 6. Applicant shall provide testimony as to chemicals and other pollutants that may be present on site. 7. Site plan will need to determine the quantity of impervious surface on the site and drainage off the site. STAFF RECOMMENDED CONDITIONS In the event a motion is made to approve this application, staff recommends the following conditions: 1. All testimony given by the applicant and their expert witnesses in accordance with this application shall be binding. 2. Storage of tires on site will not be permitted on site at any time. 3. Applicant must show how perceived detriments to the neighboring residential properties shall be mitigated to the greatest extent possible. From the Trenton 250 Land Use Element… Applicable Land Use – Neighborhood Residential High Density (NR-3) The Neighborhood Residential High Density (NR-3) zone covers high-density residential areas. Neighborhood densities range from 15 to 40 units/acre, although some larger lot homes do exist. However, this density primarily results from the prevalence of single-family housing (whether semi-attached or attached) on small lots, although multi-family apartment buildings should be permitted on a conditional basis. Adjoining buildings, whether semi- attached or attached, should continue to be predominant. Housing within this zone should have little to no setback; setbacks for new development should be no further than the median setback on the block to minimize setback variation. In addition to residential uses, the NR-3 zone typically contains small neighborhood-serving commercial uses within clusters along corridors or intersections. To promote the community character and vibrancy that currently exists, commercial uses of 5,000 gross leasable square feet or smaller should be permitted by right in the zone. Complete sidewalk networks should exist within the NR-3 zone, and accommodations should be made for multimodal transportation options, such as bike lanes. Parking within the NR-3 zone can be accommodated through driveways on non-primary facades; multi-family structures that require surface parking lots must locate parking in the rear of the building.
