VISITOR'S COMMENTS: To comment on a topic NOT on the Meeting Agenda, please step to the microphone when called upon, state your name and address, and proceed with your comments. You will have three (3) minutes to speak. Mr. David Battle of 740 Broad Oak Drive requested clarification on the Charter amendments. Mr. Battle questioned the section of the Charter stating the salaries of the Mayor and Council. Mayor McDonald deferred to Law Director McHugh, who explained that the Charter includes the salaries of the Mayor and Council first elected under the Charter for historical purposes, similar to the historical references in Section One, which explains the history of the City. Mr. Battle shared that he reads the document as a legal document, not a historical document, and has concerns that Council's salaries will decrease. Mr. Battle then asked why it would take more than a simple majority to remove the City Manager or the Clerk of Council. Law Director McHugh explained that it was the recommendation of the Charter Review Commission and approved by City Council to be placed on the ballot. Mr. Battle asked if revisions to the amendments will be made. Mayor McDonald explained that the amendments are on the ballot for tomorrow (November 2, 2021). Law Director McHugh directed Mr. Battle to the Board of Elections website in order to view a sample of his ballot with the summarized language. IX. Special Presentations and Recognitions PR15-21 Presentation: On behalf of The Kingdom Authority Ministries International, Inc., Bishop John Jennings and Overseer Tina Jennings will present the Esther & Candance Award for Public Service to Mayor Mary McDonald and Council Member Rhonda Finley. Bishop John Jennings and Overseer Tina Jennings presented the Esther & Candance Award for Public Service to Mayor McDonald and Councilmember Rhonda Finley. Bishop Jennings explained that this award from Kingdom Authority Ministries International, Inc. is in honor of their commitment to the betterment of neighborhoods and communities. H33 00217 003, IN A GENERAL BUSINESS (G-B) DISTRICT. Attachments: OR25-21 OR25-21 Attachment Director McDonnell explained that this is the Final PUD Application for this project and a few changes were made from the preliminary application, to include moving the building closer to the road and eliminating the cottages because of wetlands. Councilman Vaughn asked about the timeline for the project. Director McDonnell anticipates they will begin in the spring, once all permits have been secured. Mr. Nick Klein of MVAH Partners explained they are very excited for this project and that the development will fill a need in the Trotwood community. Their $12 million investment will provide affordable, high quality living for those 55 and older. Councilmember Finley asked about the market rate for the units. Mr. Klein explained that while the normal market rate would be around $1,000 per month, these units will start around $385 per month and go up to $875 month. Councilmember Finley asked if this is subsidized housing; Mr. Klein stated they are not subsidized housing units. Mayor McDonald requested a Motion on this item. Attachments: OR26-21 OR26-21 Exhibit A OR26-21 Attachment Director McDonnell shared that several businesses are wanting to rent their space but the area is not zoned to lease to retail establishments. In doing some research, Director McDonnell learned that this corridor was originally designed for retail, but at some point the zoning was changed to business park. The purpose of this amendment is change the zoning back to retail. Councilmember Vaughn asked if there is a minimum square footage requirement. Director McDonnell explained that there is no requirement, but they must be within the footprint of the building and they will still have to adhere to Code in order to establish any business. Councilmember Finley asked if this area is within the TIF district. City Manager Pope stated that the area is not in the TIF district. Mayor McDonald requested a Motion on this item. Old and New Business a. Staff Reports 21-52 A Motion by the Trotwood City Council to schedule a Public Hearing and to authorize the Law Director to prepare legislation proposing a five (5) year income tax levy for an additional one-half of one percent (0.5%) for the purpose of resurfacing roadways. City Manager Pope reminded Council that they had asked him to look at how to address the deteriorating infrastructure in the City. Over two years ago, an engineering company determined that 60% of the roadways were rated fair or poor. Even though the City has been able to make some improvements, help is needed from the voters. City Manager explained this proposal would be for an additional 0.5% for five (5) years, generating a little over $1 million; he feels this is the proper way to address the City's infrastructure needs. Deputy City Manager Kellum stated that the City has one street levy at this time which generates approximately $200,000 per year - not enough to cover 411 lane miles. The City also applies for grants as a way to fund this work. Councilmember Vaughn asked about the income tax and retirement income. Law Director McHugh explained if you are currently paying City of Trotwood income tax, you will pay this additional percentage. Councilmember Vaughn then asked how many surface miles of lanes could be completed with the funds generated by the temporary income tax. Deputy City Manager Kellum explained that it will depend on the condition of the roads. Once the roads are reviewed, the City would do a Request For Proposals, as well as a secondary request in case the initial bid was lower than the funds generated. The secondary bid would cover roads that need repaired but are of lower priority than those in the initial request. This would allow the City to utilize the income generated to capacity. Councilmember Finley asked if there has been consideration of the impact from the federal infrastructure bill that may be passed. Deputy City Manager Kellum stated they have considered the issue; however, the City needs to plan for now and whatever dollars that may be received will only positively impact the number of roads that can be resurfaced, as well as address other infrastructure projects. Mayor McDonald requested a Motion on this item. City Manager Pope shared that Law Director McHugh notified him that he plans to transition to senior status. Law Director McHugh explained his intent is to transition by the end of March (2022). City Manager Pope stated he plans to consider all of the options before moving forward. Mayor McDonald thanked Law Director McHugh for allowing the City to have to the time needed for a smooth transition. Councilmember Kelley asked Law Director McHugh if his organization will remain involved with Council. Law Director McHugh stated per the Charter, that will be a decision for City Manager Pope. c. She also shared that the Easterseals groundbreaking was held and it was a huge success. Mayor McDonald explained that the 20,000 square foot facility will be a $6.8 million investment coming into the Trotwood community. Mayor McDonald thanked City staff for their part in the Trotwood wrap on the RTA bus, which was parked in front of the Community Center prior to the meeting. Lastly, Mayor McDonald reminded everyone that tomorrow is election day and to please be sure to vote. d. Clerk of Council: Announcements There were no announcements. XV.
