Ms. Denise Moore, President of the Trotwood-Madison School Board, thanked the Penn's for supporting the Trotwood community, not just with their new industrial development, but for rebuilding Westbrooke Village apartments after it suffered major damage during the May 2019 tornado. Ms. Moore also thanked Council Members for their support, then recognized other school board members present; Vice President Vanessa Jeter Freeman, Member Sonja Cherry, and CFO Janice Allen. Mayor McDonald invited Mr. Dan Penn to introduce his team, which included his business partner, other family members, and the manager of Westbrooke Village Apartments. VII. Recognition PR04-22 Introduction of Christopher R. Conard, Attorney at Law with Coolidge Wall law firm Law Director McHugh introduced Mr. Chris Conard, who will begin serving as the City's Law Director beginning April 1, 2022. Law Director McHugh will be transitioning into senior status with his law firm. Mr. Conard thanked Law Director McHugh and shared that he is looking forward to working for the City of Trotwood and serving the citizens. He also stated that he appreciates the faith shown in their firm by allowing them to continue the long tradition of excellent legal services provided by Law Director McHugh. Law Director McHugh commented that he has served as Trotwood's Law Director for 20 years and he has enjoyed his time with the City and appreciates the City staff and the work they do. He still loves what he does and is happy to assist in the future; he plans to help Mr. Conard to ensure a smooth transition. Each council member shared a few comments, thanking Law Director McHugh for his service and wishing him the best. VIII. Consent Agenda Mayor McDonald requested a Motion to approve the Consent Agenda. City of Trotwood Page 3 City Council Meeting Minutes - Final March 7, 2022 22-16 A Motion by the Trotwood City Council to schedule a Public Hearing and to authorize the Law Director to prepare legislation repealing old Chapter 1501 “Ohio Fire Code” of the Trotwood Codes of Ordinances and adopting a new Chapter 1501 “Ohio Fire Code” of the Trotwood Codes of Ordinances. This Motion was approved and a Public Hearing will be scheduled. 22-17 A Motion by the Trotwood City Council to schedule a Public Hearing and to authorize the Law Director to prepare legislation accepting the recommendation from the Trotwood Planning Commission to approve an amendment to the official Zoning Map of the City and the classification of approximately 18 acres of vacant land located on Shiloh Springs Road, Parcel No. H33 02112 0178, from Business Park (B-P) to Residential Multi-Family High Density (RMF-H) to accommodate future residential development. This Motion was approved and a Public Hearing will be scheduled. IX. Ordinances OR02-22 AN ORDINANCE BY THE TROTWOOD CITY COUNCIL ACCEPTING THE RECOMMENDATION FROM THE TROTWOOD PLANNING COMMISSION TO APPROVE A PRELIMINARY PLANNED UNIT DEVELOPMENT APPLICATION WITH CONDITIONS FOR A PROPOSED INDUSTRIAL PARK ON APPROXIMATELY 46.37 ACRES OF VACANT LAND, PARCEL NOS. H33 00417 0002, H33 00417 0066, AND H33 00417 0008, SITUATED AT THE SOUTHWEST CORNER OF WOLF CREEK PIKE AND OLIVE ROAD IN A LIGHT INDUSTRIAL 2 (L-I-2) ZONING DISTRICT. Attachments: OR02-22 OR02-22 PC Packet Deputy City Manager Kellum explained that the owner of the land intends to build two or three industrial buildings as part of the Industrial Park development. Director McDonnell shared that the Planning Commission voted unanimously to approve this project with a few conditions, to be completed in phases of the project. She further reviewed a few of the documents contained in the packet attached to the Agenda. Director Downing briefly discussed the abatement agreement stating it is for a 100% real property tax abatement for 15 years, and also the agreement to offer internship opportunities for up to five Trotwood students or to pay $1,000 for each position not filled (up to $5,000) and explained the legislation for these items will come before Council later during the meeting. Mayor McDonald requested a Motion to adopt OR02-22. Attachments: OR04-22 Deputy City Manager Kellum shared that Habitat for Humanity has been in the Trotwood community for several years and are part of the long-term recovery group for homeowners. The City would like to waive some of their fees for this non-profit group. Mayor McDonald requested a Motion to adopt OR04-22. H33 00301 0001, TO THE TROTWOOD COMMUNITY IMPROVEMENT CORPORATION AND DECLARING THE PROPERTY SURPLUS. Attachments: OR06-22 OR06-22 Map Deputy City Manager Kellum commented that this property is part of the side lot program by the TCIC and the owners of 102 East Main Street would like to acquire this property. Director Downing added that the owner plans to redevelop the property at 102 East Main Street and would like to incorporate this underutilized lot as part of the yard. Resolutions R22-14 A RESOLUTION BY THE TROTWOOD CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING AMENDING THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF TROTWOOD, OHIO, AND THE TROTWOOD PROFESSIONAL FIREFIGHTERS IAFF LOCAL 4024 PREVIOUSLY APPROVED BY CITY COUNCIL BY RESOLUTION NO. R21-30 ON JULY 6, 2021. Attachments: R22-14 R22-14 Exhibit A Deputy City Manager Kellum stated that this MOU incorporates the classification of EMT-B, a classification that was not included in the original contract. Mayor McDonald asked if employees in this classification will work toward earning a certification; Deputy City Manager Kellum confirmed that EMT-B employees will work to earn their certification. City of Trotwood Page 9 City Council Meeting Minutes - Final March 7, 2022 SR22-10 New Liquor Permit Request from Main Street Food Market, LLC, 728 East Main Street, Trotwood, Ohio 45426. Attachments: SR22-10 Attachment Chief Wilson addressed City Council stating this is a new liquor permit request, Class C-1 and C-2, and the Police Department has no objection to the request. Old and New Business XV. Comments City of Trotwood Page 10 City Council Meeting Minutes - Final March 7, 2022 A. Council Members: Each Council Member will have three (3) minutes to speak about topics relating to the City of Trotwood that are not on the Meeting Agenda. Councilmember Brown shared that she is excited about our new Law Director and thanked Law Director McHugh for his years of service. She also thanked Director Downing as he continues to evolve the City. She stressed the importance of the City's partnership with the Penn's and shared that she is excited to be a part of it. Councilmember Vaughn shared that he believes the entire region is on the upswing and has managed to do well even during this difficult time. He thanked the citizens of the Trotwood community for their support and allowing him to be included. Vice Mayor Page thanked the Penn's for choosing the City of Trotwood. She also reminded citizens about the RETREET Program through MVRPC, which is still offering free trees during the month of April. Vice Mayor Page congratulated the 7th and 8th grade girls basketball team who won first place in their tournament; the 7th grade boys basketball team who won first place in their tournament; the 8th grade boys basketball team who placed 2nd in their tournament; and the 5th and 6th grade girls basketball teams who each won first place in their tournament. Councilmember Gales thanked the Penn's and shared her appreciation for the school board members in attendance. She also congratulated Mayor McDonald for being named a Woman of Influence by the YWCA and she welcomed Mr. Conard. Councilmember Gales expressed concern with how some drivers are treating the roadways and has concerns with the amount of litter in the community. Councilmember Finley thanked everyone for attending the meeting and the school board for their support. She thanked the Penn's for their commitment to the City of Trotwood and shared that the impact the internship opportunities will have on Trotwood student's lives will be irreplaceable, allowing them to obtain new skills in order to help the community, as well as to become gainfully employed. Councilmember Finley thanked the Mayor and Vice Mayor for attending the kick-off event for the inauguration of the 9th President of Central State University held at Mount Calvary Missionary Baptist Church. She further shared that the Mount Calvary family and the CSU family will be offering students of Trotwood an opportunity for a full scholarship. She directed those interested to reach out to Clerk Landis. Lastly, she wanted to recognize International Women's Day, which celebrates the achievements of women, and encouraged others to support women-owned businesses or to simply send a note to a woman who is very special. Councilmember Kelley commented that he is more than pleased with the Industrial Park project and he is excited for living wage jobs coming to the community, along with the internship opportunities for Trotwood students. Mayor McDonald thanked staff for working so hard to bring development to the City of Trotwood and reiterated the importance of reaching out and developing relationships in order to move Trotwood forward.
