PUBLIC COMMENTS: To comment on a topic not scheduled for a Public Hearing, please fill out a Speaker Form and return it to the Clerk of Council BEFORE the start of the meeting. When called upon, proceed to the microphone, state your name and address, and proceed with your comments. You will have three (3) minutes to speak. Mr. James Wright approached Council to discuss 926 Olive Road as he is in the process of taking ownership of the property and he knows there have been some problems in the past. He explained that he has obtained a permit from the County and is currently working to bring the electric up to code. Mr. Wright shared that the Planning and Development Department has identified this property as inhabitable; however, he believes it is in good shape and he was planning to move in with his family. Mr. Wright would like permission to go back onto the property in order to finish the electric work for the final inspection and added that he failed to obtain a City permit, but that he plans to do so. Mayor McDonald asked Deputy City Manager Kellum about the property. Deputy City Manager Kellum shared that before Mr. Wright became involved, the property was abandoned and the utilities were turned off; the property meets the criteria for condemnation and demolition. Deputy City Manager Kellum added that the City's Planning and Development Director and Zoning Administrator have been working with Mr. Wright; however the City must follow the proper legal process and further, he does not own the property. Mayor McDonald advised Mr. Wright that Council does not make the determination and that he must work with City staff to address the matter. She then deferred to Deputy City Manager Kellum and Law Director Conard. Councilmember Vaughn asked Mr. Wight about his willingness to invest money into this property. Mr. Wright explained that he attempted to purchase the home prior to the previous owner's death. Councilmember Vaughn asked about a timeline to become the legal owner of the property. Mr. Wright stated that he is waiting on final signatures from the current owners to file the Deed. Deputy City Manager Kellum advised that this is a very complicated matter. Councilmember Vaughn thanked Mr. Wright for trying to circumvent a property from being an empty lot with no source of revenue. Deputy City Manager Kellum advised Mr. Wright that City staff would speak with him after the meeting. Mr. Larry Bryant of 4576 Lotus Drive asked Council if it would be possible to make homeowner's responsible for clearing around fire hydrants. He also suggested adding hometown hero plaques in the community. VII. Consent Agenda Mayor McDonald requested a Motion to approve the Consent Agenda. Sub.H.B. No. 33 (Budget Bill 2024-2025) passed and signed by the Governor of Ohio to take effect on January 1, 2024. This Motion was approved and a Public Hearing will be scheduled. VIII. Attachments: OR29-23 OR29-23 Exhibit A Deputy City Manager Kellum advised that due to taking over the operations of Bear Creek-Hillgrove Cemetery, it is necessary to update the Code to reflect the new ownership and to also ensure that maintenance procedures are in compliance with grass and weed regulations. Attachments: OR30-23 OR30-23 Exhibit A City Planner Max Fuller shared that the Code Enforcement Department receives a number of complaints regarding trash cans not being removed from the curbside as required. He explained that the City will have a grace period of 60 days before fines are charged. Deputy City Manager Kellum stated that the fine will be $100 for the first offense and it escalates for continued violations; she added that the purpose of this legislation is to deter the practice. Mayor McDonald asked that information be placed on the City's website and Facebook page so residents can become familiar with the change. Councilmember Finley suggested that the information be placed in the next newsletter and asked City Planner Fuller where trash receptacles should be placed. Planner Fuller stated they should be placed on the side of the house; behind the setback. Councilmember Finley suggested using simple language to present this to residents, then asked how it will be enforced. City Planner Fuller stated that Code Enforcement Officers will not only respond to calls, they will also address violations in plain sight. Attachments: OR31-23 OR31-23 Exhibit A Planning and Development Director Debbie McDonnell stated that this legislation will allow the City to recoup the cost of demolitions; last year the City demolished 30 properties and this year there are 55 scheduled to be demolished. Director McDonnell explained that fees are submitted to the Montgomery County Auditor to be placed on the tax duplicate for collection. Attachments: OR32-23 OR32-23 Exhibit A Planning and Development Director Debbie McDonnell advised that this legislation expands the definition of who is to be notified when a property is being considered for demolition. Law Director Chris Conard explained that among the things done to make sure all interested persons are notified, notices are posted on the property and a title search is completed; a good faith effort is always made. Councilmember Vaughn asked about the impact of this new language and any future programs that benefit the City because demolitions are costly to taxpayers. Law Director Conard shared that this is a program through the State of Ohio and he expects the program will be short term so the City is taking full advantage of the opportunity so not to bear the sole expense of demolitions. However, Law Director Conard believes it is safe to assume that the monies will be exhausted in the near future, similar to the tornado relief funds. Director McDonnell added that to her knowledge, last year was the first year the State offered this funding program. Councilmember Vaughn reiterated that Council must maintain the control to move forward; if circumstances change, Council can reverse the action, the City doesn't have to move forward simply because funding was requested. Director McDonnell shared that last year, six property owners came forward during the process and the properties were eventually removed from the list. Councilmember Finley acknowledged that this is an opportunity to address the City's strategic vision of additional housing while only having to pay 12.5% of the expense and she appreciates the Department's efforts. Resolutions R23-50 A RESOLUTION BY THE TROTWOOD CITY COUNCIL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH STRYKER FOR THE PURCHASE OF SIX (6) CHEST COMPRESSION SYSTEMS AND ACCESSORIES, FOR THE TOTAL SUM OF $116,752.24, TO BE PAID FOR WITH GRANT FUNDS IN THE AMOUNT OF $99,081.81 FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY ASSISTANCE TO FIREFIGHTERS GRANT, AND THE MINIMUM REQUIRED MATCH OF 10% FROM THE CITY OF TROTWOOD. Attachments: R23-66 TCIC Executive Director Chad Downing shared that this agreement addresses grant funding through Montgomery County that will assist Gordon Food Services, Inc. (GFS) with some of their larger expense items; refrigerators and similar types of equipment. Councilmember Kelley, Jr. asked when the store is scheduled to open. Director Downing anticipates the store will open in late October or early November and a Grand Opening event will be held for the community. Councilmember Finley congratulated Director Downing and City staff for obtaining a Community Development Block Grant as it is a very competitive process. R21-48 ON NOVEMBER 1, 2021. Attachments: R23-68 R23-68 Amended CBA 2022-2024 (Police Officers) Prior to the reading of the caption of Resolution No. R23-68, Vice Mayor Page announced that she conferred with Law Director Conard and is recusing herself from Resolution Nos. R23-68 and R23-69 as her son works for the Trotwood Police Department. Vice Mayor Page stepped off the Dais and exited the Community Room. Law Director Conard added that Ohio Ethics law is very clear that when a matter comes before an elected official that potentially involves compensation to a family member, that elected official cannot participate or deliberate in those discussions. Deputy City Manager Stephanie Kellum explained that this legislation allows the City to reopen union contracts with Police Officers and Sergeants in order to renegotiate more competitive wages. Police Chief Erik Wilson shared that throughout the country, the law enforcement field is going through a difficult time and that higher wages will allow the City to attract quality officers and maintain those officers the City has already invested in. Mayor McDonald asked about the commitment from officers hired. Chief Wilson explained that the City requires a four (4) year commitment and should an officer leave before then, the officer will be required to reimburse the City for the training they received. Mayor McDonald asked if officers attending the academy are salaried employees. Chief Wilson answered that they are paid a salary, but at a reduced rate; he added that the academy takes approximately 5 months to complete and further, all new officers have a 90-day field training period. Councilmember Vaughn wants officers to look at Trotwood as a department to go to, not a department used as for training and that the Trotwood community supports law enforcement. Councilmember Finley added that she believes money is not the only motivating factor and hopes Chief is looking at other important factors to retain officers. Deputy City Manager Kellum reminded Council how Chief Wilson came before them not too long ago with a change to the dress code allowing facial hair. Council Members: Each Council Member will have three (3) minutes to speak about topics relating to the City of Trotwood that are not on the Meeting Agenda. (Vice Mayor Page returned to the Community Room and took her seat on the Dais.) Councilmember Kelley, Jr. encouraged the audience to vote at the upcoming election as there are a lot of important issues on the ballot. He shared that he appreciates everyone who contacted him thanking him for assisting in the opening of the road/bridge at Free Pike and State Route 49 as he felt many suffered a lot. He reminded everyone about the residents who came forward at the Council Meeting on April 3rd and he appreciated them and was glad they understood that the County was dragging their feet. Councilmember Finley enjoyed the Trotwood Family Days and she was happy to see local food vendors and all the other businesses who came out to support the community. She also thanked Johnny and his team, as well as the Police Department and Fire Department, as they all worked very hard, and she thanked Mr. Wheeler for all of his hard work planning the event. Councilmember Finley shared that she attended the 100 year celebration event for the Sisters of the Precious Blood on Sunday. Lastly, she announced that October 7th is the HarvestFest, and October 10th is the last day to register to vote as early voting begins on October 11th. She ended by thanking Mr. Wright and Mr. Bryant for their comments. Councilmember Gales commented that she is also grateful the road is open and she is very excited about Gordon Food Services opening a grocery store. She agreed with Councilmember Kelley, Jr. that this is an important election and she hopes to see a nice, clean race and does not want to be in the paper for anything negative. Vice Mayor Page thanked the ladies of Alpha Kappa Alpha for planting mums at John Wolfe Park, which they've done since 2005. She also thanked Brian Martin, Executive Director of MVRPC, who held a closing event for the Retreet program. Vice Mayor Page shared that she very much enjoyed the entertainment and the food this weekend and that it was an outstanding occasion for the community. She explained that these events are planned by the City for citizens. Lastly, Vice Mayor Page shared that she too attended the 100 year anniversary event for the Sisters of the Precious Blood and she very much enjoyed the singing and fellowship. She added that the Sisters are a pillar in the Trotwood community and personally thanked them. Councilmember Vaughn shared that this is his sixth four-year term and in his 22 years on Council he has seen council members, mayors, and city managers come and go. He stated that he cannot say a negative comment about anyone currently on Council or anyone wanting to become a Council Member. He stated that Mayor McDonald's service, dedication, life, and all the different events have led to her ability to communicate with both parties at a time when the City was looked upon as the enemy. He added that he believes in is 43 years as a resident of Trotwood, her abilities and the benefits realized are unsurpassed by any leader Trotwood has ever had. He thanked Mayor McDonald and he is glad to see people who are interested in becoming a part of a growing, successful community. City of Trotwood Page 17 City Council Meeting Minutes - Final October 2, 2023 Councilmember Brown acknowledged the Mayor of Drexel in attendance. She commented that it was great to engage with residents at the Smoke, Sizzle and Sound event, then stated that she wanted to address leadership, which is about cultivating leaders at every level; it is someone who embodies qualities such as courage, humility, integrity, kindness and creativity. She added that she believes this is the magic that the City has and working together, the City will continue to grow. Councilmember Brown commented that being a leader is not about the title, it's about togetherness and working together for the good. C. City Manager Deputy City Manager Stephanie Kellum wanted to thank those citizens who participated in the public launch for the Community Communications Strategy Project held on September 9th and 10th. She shared that approximately 100 residents attended between the two days and the City has received approximately 150 surveys. Deputy City Manager Kellum added that the City will be conducting focus groups at the Goodwill Easterseals Building on October 12th through the 14th; additional information is on the City's website and Facebook page. She then encouraged residents to participate as their input is vital in learning how the City can keep residents informed and updated. D. Mayor Mayor McDonald reiterated that many good things happened in the community over this past weekend and she reminded everyone that October is breast cancer awareness month, which affects both women and men. She also shared that the Family Reunion Weekend was a great and fun time and she thanked Pastor McIntosh of West Acres Nazarene Church for providing food Friday evening. Mayor McDonald wanted everyone to know that the concert held Saturday evening was not paid for by the City of Trotwood, it was provided by the Levitt Pavilion as part of their pop-up concert series. Lastly, Mayor McDonald invited everyone to Phillips Temple on October 4th at 6:00 p.m. for Candidates Night and that all candidates have been invited to attend so they can share why they are running for office.
