City of Troy, NY Police Objective Review Board Meeting Minutes Meeting Date: April 3, 2023 Present: Marcus Nix Starletta Smith Elijah Scott Jeff Anderson Michael Tuttman Taneisha Harris Mayor Patrick Madden Captain Anthony Conyers Richard Morrisey, Esq. Excused: The April 2023 Police Objective Review Board meeting was called to order by Chairman Marcus Nix at 6:38pm on April 3rd. The roll was called and a quorum was established. Richard Morrisey, Esq. discussed the status of the New York Civil Liberties Union’s request for documents from the Troy Police Department. He stated that the city is currently appealing the decision and that it will take some time before a decision is made regarding the appeal. The city responded to the NYCLU, providing all documentation with the exception of unfounded not sustained, and exonerated complaints. This position is consistent with long standing advice from the NYS Commission on Open Government. He also provided a brief description of the Freedom of Information Law (FOIL), what type of information the public can request, and what conditions may apply at times (for example, case reviews where certain information is redacted to protect all parties involved). Jeff Anderson stated that we have received six applications so far to fill the two vacancies. The deadline for applications was April 30th. We received six applications and are expecting to interview the candidates in early May. Jeff Anderson sent PORB members the resumes via email so we can get an idea of who the candidates are. Chairman Marcus Nix suggested that the entire PORB are present for the interview and if you have any suggested questions for the interview, you can send email them to Elijah Scott and/or Marcus Nix. We will likely have another discussion about the interview process during our May meeting. Lastly, it was suggested that after interviewing the candidates next month, we may invite the two new members to the final regular monthly meeting in June. The PORB was invited to the March meeting with the Little Italy Quality of Life Committee at the Italian Community Center. The PORB was invited to speak to the committee along with other members of the community about the PORB. Chairman Nix provided the committee with an over view of what the PORB is, summary of our meetings, what we have learned so far, and our stated goals. Chairman Nix stated that we will reach out to TPD to see if there is any information that provides hot spots in the city (ex. Map). Captain Conyers presented us with case #23-01, which was a violation of civil rights complaint. The PORB agreed with the findings that the officer acted in good faith by ensuring the safety of the subjects involved in the dispute (unfounded and exonerated). Captain Conyers also showed us a few portions of General Order 08.12. We will see if we can get copies of that general order. The meeting adjourned at 7:53pm until May 1st.
