(aka Sigma Alpha Epsilon Fraternity) seeks a Special Use Permit for expansion of nonconforming use, as well as an Area Variance for setback deficiency between principal building and accessory building, related to a proposal to add a 4500 square foot addition (and 3 parking spaces) to a fraternity house, at 12 Myrtle Avenue (ID 112.49-4-5) in an R-2 zone. At the regularly scheduled ZBA meeting, the only agenda item was a revision of a previously presented case. CC clarified the reason for the hearing, explaining how, after legal action was taken against the City, cases only needed 3 votes to pass, rather than 4. CC went on to explain how ZB 2018-17 had a 3-1 vote, and therefore should have passed when originally presented. CC also stated how the board would not be voting on the case, as they cannot change their votes from the original presentation. CC also stated that if certain aspects of the original proposal were changed, the applicant would need to reappear in front of the board. One member of the public, Gary Nelson of Maple Ave, spoke out and submitted a document for “future litigation”, stating the board could not “change the record” without a vote.
