7788 ACTION MINUTES OF TULARE CITY COUNCIL, CITY OF TULARE February 20, 2018 A closed session meeting of the City Council, City of Tulare was held on Tuesday, March 6, 2018, at 6:45 p.m., in the Tulare Public Library & Council Chambers, 491 North “M” Street. COUNCIL PRESENT: Carlton Jones6:51 p.m., Maritsa Castellanoz, David Macedo, Greg Nunley, Jose Sigala STAFF PRESENT: Joe Carlini, Heather N. Phillips, Sara Tobias, Steve Bonville, Josh McDonnell, Traci Myers, Roxanne Yoder I. CALL TO ORDER CLOSED SESSION Vice Mayor Castellanoz called the closed session to order at 6:48 p.m. II. CITIZEN COMMENTS - Comments from the public are limited to items listed on the agenda (GC 54954.3a). Speakers will be allowed three minutes. Please begin your comments by stating and spelling your name and providing your city of residence. There were no citizen comments presented. III. ADJOURN TO CLOSED SESSION PURSUANT TO GOVERNMENT CODE SECTION(S): Vice Mayor Castellanoz adjourned to closed session at 6:48 p.m. for item as noted on the agenda. RECONVENE CLOSED SESSION Mayor Jones reconvened from closed session at 7:02 p.m. V. CLOSED SESSION REPORT (if any) Mayor Jones advised that the Council unanimously approved a purchase and sale agreement between the City of Tulare and the Orosco Group. VI. ADJOURN SPECIAL CLOSED SESSION Mayor Jones adjourned closed session at 7:12 p.m. VII. CALL TO ORDER REGULAR SESSION Mayor Jones called the regular meeting to order at 7:12 p.m. VIII. PLEDGE OF ALLEGIANCE AND INVOCATION Coach Bennett led the Pledge of Allegiance and an invocation was given by Mayor Jones. IX. CITIZEN COMMENTS Mayor Jones requested those who wish to speak on matters not on the agenda within the jurisdiction of the Council, or to address or request a matter be pulled from the consent calendar to do so at this time. He further stated comments related to general business matters would be heard at the time that matter is addressed on the agenda. Dawn Cole addressed the Council with concerns over scheduling interviews with Council Members for a COS class and encouraged them to be timely in responding to students so they can complete their course. Anthony Souza addressed the Council regarding social media exchanges with Mayor Jones. Euler Torres addressed the Council in support of Mayor Jones with regard to the concerns expressed over the social media exchanges. Alicia Franco addressed the Council regarding Consent Item 3 and thanked Council Member Sigala and the Council for the support of the Head Start Program’s use of City facilities. 7790 X. COMMUNICATIONS There were no items for this section. XI. CONSENT CALENDAR: It was moved by Council Member Sigala, seconded by Council Member Nunley and unanimously carried that the items on the Consent Calendar be approved as presented. (1) Authorization to read ordinances by title only. (2) Approve minutes of February 20, 2017 regular meeting(s). (3) Approve a request by Council Member Sigala to allocate $360 for discretionary use from 001-4010-2116 to cover rental costs associated with the Tulare County Office of Education Early Childhood Program – Parents Group Quarterly Meeting located in the Tulare Room at the Meitzenheimer Community Center. (4) Receive, review, and file the Monthly Investment Report for January 2018. (5) Award Bid 18-650 to Will Tiesiera Ford in the amount of $76,888.00 for the purchase of two (2) 2018 Ford F250 ¾ Ton Crew Cab Pickup Trucks for the Fire Department. XII. SCHEDULED CITIZEN OR GROUP PRESENTATIONS (1) Presentation to the Tulare Union High School Football Team and Coaches in recognition of the CIF Central Section Division II Valley Championship and special recognition to Kazmeir Allen for securing the National Record for the Most Touchdowns in a single season. Mayor Jones presented the team and coaches with certificates recognizing their accomplishments. (2) Presentation to the Tulare Union High School Cheer Team and Coaches in recognition of their 2018 ICU World Cheerleading Championship. Mayor Jones presented the team and coaches with certificates recognizing their accomplishments. (3) Presentation to Jaskarn Singh in recognition of the Tulare County Spelling Bee Championship. Mayor Jones presented a certificate recognizing Jaskarn Singh’s accomplishment. 7791 XIII. MAYOR’S REPORT (1) Proclamation presentation in recognition of Arbor Day. Mayor Jones presented Parks Manager J.D. Johns with a Proclamation in recognition of Arbor Day. XIV. STUDENT REPORTS There were no items for this section of the agenda. XV. GENERAL BUSINESS Comments related to General Business Items are limited to three minutes per speaker, for a maximum of 30 minutes per item, unless otherwise extended by the Council. Mayor Jones requested a brief break so the certificate honorees could take pictures with their families. (1) Community Development/General Services: a. Presentation by The Orosco Group LLC (‘Orosco”) discussing for consideration potential purchase and development of property owned by the City of Tulare (“City”) of property parcel (APN#169-040-013) and (APN #169-140-014) located on the SWC of Cross and “J” Street (“Property”); Alternatively, subject to decisions rendered in closed session authorize the City Manager to execute all necessary documents to facilitate the purchase and development of property owned by the City of Tulare (“City”) of property parcel (APN#169-040-013) and (APN #169-140-014) located on the SWC of Cross and “J” Street (“Property”), subject only to minor conforming or clarifying changes acceptable to the City Attorney. Community Development Deputy Director Traci Myers introduced Chris Orosco of the Orosco Group who provided a brief presentation of the plans for development. Following the presentation with no further discussion, it was moved by Council Member Sigala, seconded by Council Member Macedo and unanimously carried to authorize the City Manager to execute all necessary documents to facilitate a purchase and development agreement, subject only to minor conforming or clarifying changes acceptable to the City Attorney, as approved and reported out from closed session. 7792 (2) Public Works: a. Receive an update regarding the proposed solid waste rates. Public Works Director Trisha Whitfield provided a PowerPoint slide presentation for the Council’s review and consideration with regard to the City’s proposed increase to solid waste rates. Informational item only. XVI. COUNCIL/STAFF UPDATES, REPORTS OR ITEMS OF INTEREST – GC 54954.2(3) Council Member Sigala requested the Reorganization of the Mayor for the 3/6 agenda, which was seconded by Council Member Macedo and failed by a vote of 2 to 3 (Mayor Jones, Vice Mayor Castellanoz and Council Member Nunley voting no.) Council Member Sigala requested the update of the Council’s Handbook on the 4/3 agenda, which was seconded by Council Member Nunley and carried unanimously. Council Member Nunley requested an item on roll-offs be placed on the 3/20 agenda, which was seconded by Council Member Macedo and carried unanimously. XVII. Comments related to general business/city manager items or public hearing items will be heard at the time the item is discussed or at the time the Public Hearing is opened for comment.
