CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Council Chambers June 12, 2017 491 North M Street COMMISSIONERS PRESENT: Miller, Crase, Rocha, Miguel Herrera, Killion TEENS ON BOARD PRESENT: None STAFF PRESENT: Michael Miller, Interim Community & Economic Development Director Traci Myers, Community & Economic Development Deputy Director Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Killion called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Miller led us in the flag salute. CITIZEN COMMENTS: Council Member Jose Sigala, provided the Commission with a list of items he has been working on and items that he has completed in his district. COMMISSIONER COMMENTS: Chairman Killion wished Deputy Director Myers a Happy Birthday. Commissioner Herrera commended Council Member Sigala on his cleanup efforts on the west side including the parking lot at the corner of Inyo and West Street. She also noted that the first annual Planning Commission Minutes 1 June 12, 2017 Mayor Rib Cook-off held at Zumwalt Park on Saturday was a success and it was nice to see the community together supporting such an event. Commissioner Crase asked about the status of the IRS building that was to be used as a Veteran’s Out Patient clinic. Deputy Director Myers noted that the project is still moving forward. STAFF COMMUNICATIONS: None PRESENTATION- CERTIFICATES OF RECOGNITION FOR TEENS ON BOARD: Chairman Killion noted no Teens on Board were present to receive the certificates and that the Recognition Certificates would be mailed to them. CONSENT CALENDAR: Minutes of the May 22, 2017 meeting: It was motioned by Commissioner Crase and seconded by Commissioner Miller to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: Conditional Use Permit No. 2017-12: Deputy Director Myers, reviewed with the Commission a request by Valley Pump & Dairy Systems to operate a storage yard to be located on the east side of “O” Street, south of Bardsley Avenue in conjunction with an existing business located at 2280 South “K” Street. Chairman Killion opened the public hearing. There being no one else to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Herrera to adopt Resolution 5237approving Conditional Use Permit No. 2017-12 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Miller, Crase, ABSENT: Davis Miguel, Herrera, Killion Planning Commission Minutes 2 June 12, 2017 NOES: None ABSTAIN: None Conditional Use Permit No. 2017-13: Deputy Director Myers, reviewed with the Commission a request by Tacqueria Michoacan (Veronica Ortiz) to continue to operate a stationary mobile vending vehicle on property located at 1414 W. Tulare Avenue. Deputy Director noted that in the staff report it indicates no tables and chairs for outdoor dining, however, the applicant has indicated in an interest on having one table and a few chairs located south of the vending vehicle should the Commission allow this. Chairman Killion opened the public hearing. Council Member Sigala spoke in favor of the project. There being no one else to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Miller to adopt Resolution 5238, approving Conditional Use Permit No. 2017-13 based on the findings and subject to the conditions as listed in the staff report with the addition of condition #8 to read as follows: 8) Applicant may set up 1 table with chairs for outdoor dining. Table and chairs are to be located on the south side of the vending vehicle and must be removed at the end of each business day. COMMISSIONERS AYES: Rocha, Miller, Crase, ABSENT: Davis Miguel, Herrera, Killion NOES: None ABSTAIN: None GENERAL BUSINESS- NON PUBLIC HEARING ITEMS: Design Review No. 1094: Deputy Director Myers, reviewed with the Commission a request by Nasser Yehya (Docs Drive In) to develop an approximate 1,414 sq. ft. restaurant with drive thru on property located at 440 North K Street. Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Crase to adopt Resolution 5239, approving Design Review No. 1094 based on the findings and subject to the conditions as listed in the staff report.
