CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers August 28, 2017 491 North M Street COMMISSIONERS PRESENT: Miller, Crase, Miguel, Herrera, Killion TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Traci Myers, Community & Economic Development Deputy Director Steven Sopp, Associate Planner Dawn Marple, Contract Planner Aaron Carpenter, Contract Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Killion called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Herrera led us in the flag salute. CITIZEN COMMENTS: None Planning Commission Minutes 1 August 28, 2017 COMMISSIONER COMMENTS: Commissioner Herrera announced that she has a restaurant business in Visalia with interest in coming to Tulare and once she has more information she will pass it along to Traci Myers. STAFF COMMUNICATIONS: None CONSENT CALENDAR: (1) Minutes of the August 14, 2017 meeting It was motioned by Commissioner Crase and seconded by Commissioner Herrera to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Mitigated Negative Declaration for Tentative Subdivision Map 2017-07: The Greens at Oak Creek / General Plan Amendment No. 2017-02 and Zone Amendment No.720: (2) General Plan Amendment No. 2017-02: (3) Zone Amendment No. 720: (4) Tentative Subdivision Map 2017-07: The Greens at Oak Creek Director McDonnel clarified for the record that items 1-4 would be covered under one presentation. Dawn E. Marple, Contract Planner, reviewed with the Commission a request by Great Valley Land Builders, LLC to construct an 88-lot single family residential subdivision on 19.5 acres of vacant land, change the land use designations from Community Commercial on the western half of the parcel, and Medium Density Residential on the eastern half of the parcel, to Low Density Residential on the entire parcel and the Zone Amendment is to change the existing zone districts from R-M-2 on the eastern half of the parcel and C-3 on the western half of the parcel to R-1-6 zone district on the entire parcel. The project is located approximately 1,700 feet north of Tulare Avenue, east of Mooney Boulevard (APNs 172-100-001, 172-070-003). Planning Commission Minutes 2 August 28, 2017 Chairman Killion opened the public hearing. Darlene Mata, representative for the applicant, spoke in favor of the project and made herself available to answer any questions. There being no one else to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Miller to adopt Resolution 5245, adopting a Mitigated Negative Declaration for Tentative Subdivision Map 2017-07: The Greens at Oak Creek/ General Plan Amendment No. 2017-02 and Zone Amendment No. 720. COMMISSIONERS AYES: Miguel, Miller, Crase, ABSENT: Rocha Herrera, Killion NOES: None ABSTAIN: None Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Herrera to adopt Resolution 5246, recommending to the City Council approval of General Plan Amendment No. 2017-02. COMMISSIONERS AYES: Miguel, Miller, Crase, ABSENT: Rocha Herrera, Killion NOES: None ABSTAIN: None Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Miller to adopt Resolution 5247, recommending to the City Council approval of Zone Amendment No. 720. COMMISSIONERS AYES: Miguel, Miller, Crase, ABSENT: Rocha Herrera, Killion Planning Commission Minutes 3 August 28, 2017 NOES: None ABSTAIN: None Following Commission discussion it was motioned by Commissioner Miguel and seconded by Commissioner Herrera to adopt Resolution 5248, approving Tentative Subdivision Map 2017- 07: The Greens at Oak Creek based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Miguel, Miller, Crase, ABSENT: Rocha Herrera, Killion NOES: None ABSTAIN: None (5) Mitigated Negative Declaration for Conditional Use Permit No. 2017-15 and Conditional Use Permit No. 2017-15: Aaron Carpenter, Contract Planner, reviewed with the Commision a request by Kraft-Heinz Foods Company (Kraft), in coordination with SolarCity Corporation dba Tesla Energy, to construct an approximately 13.9 megawatt (MW) single-axis tracker ground mounted solar photovoltaic (PV) system on approximately 65 acres . Property project is located at 10800 Avenue 184 (APN 228-100-009, 228-110-025 and 191-230-002). Chairman Killion opened the public hearing. Jessica Sager, representative for Tesla, spoke in favor of the project and made herself available to answer any questions. There being no one else to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Crase and seconded by Commissioner Miller to adopt Resolution 5250, adopting a Mitigated Negative Declaration and approving Conditional Use Permit No. 2017-15 based on the findings and subject to the conditions as listed in the staff report. GENERAL BUSINESS- NON PUBLIC HEARING ITEMS: None TEENS ON BOARD: None Planning Commission Minutes 4 August 28, 2017 ITEMS OF BOARD INTEREST: Deputy Director Myers provided the Commission with a flyer from the Chamber. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
