CALL TO ORDER:
Chairman Killion called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Miguel led us in the flag salute.
CITIZEN COMMENTS:
None
COMMISSIONER COMMENTS:
Commissioner Herrera noted that the apartments on Pleasant Avenue behind Tulare Western
High School have undergone a major remodel and look very nice.

CONSENT CALENDAR:
(1) Minutes of the October 23, 2017 regular meeting
(2) Conditional Use Permit No. 2017-20= Correction to Resolution 5254.
It was motioned by Commissioner Crase and seconded by Commissioner Rocha to
approve the Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2017-23:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Luigi Cristallo
for a Type 47/ABC License (On Sale General—Eating Place) to sell beer, wine and distilled
spirits for consumption on-site in conjunction with an existing restaurant (Rosa’s Italian
Restaurant). Project is located at 210 E. Tulare Avenue. This project is categorically
exempt pursuant to Section 15301 of the California Environmental Quality Act of 1970, as
amended.
Chairman Killion opened the public hearing.
There being no one else to speak in favor of or against the project the public hearing was
closed.
Following Commission discussion it was motioned by Commissioner Miguel and seconded
by Commissioner Miller to adopt Resolution 5259, approving Conditional Use Permit No.
2017-23 based on the findings and subject to the conditions as listed in the staff report.

(2) Conditional Use Permit No. 2017-24:
Steven Sopp, Associate Planner, reviewed with the Commission a request by April Molezzo
for a Conditional Use Permit for a licensed large family day care home (nine of more
children, not to exceed fourteen children). This project is located at 3152 Brickfield
Avenue. This project is exempt pursuant to Section 15274 of the California Environmental
Quality Act of 1970, as amended.
Chairman Killion opened the public hearing.
There being no one else to speak in favor of or against the project the public hearing was
closed.
Following Commission discussion it was motioned by Commissioner Miguel and seconded
by Commissioner Herrera to adopt Resolution 5260, approving Conditional Use Permit No.
2017-24 based upon the findings and subject to the conditions as listed in the staff report.

GENERAL BUSINESS—NON PUBLIC HEARING ITEMS
(1) Design Review No. 1096:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Love’s Travel
Stops and Country Stores to add an additional bay to an existing metal structure which
houses a light mechanical service shop. This project is located at 2700 S. Blackstone Street.
This project is categorically exempt pursuant to Section 15301 (e) of the California
Environmental Quality Act of 1970, as amended.
Following Commission discussion it was motioned by Commissioner Miller and seconded
by Commissioner Crase to adopt Resolution 5262, approving Design Review based on the
findings and subject to the conditions as listed in the staff report.

(2) Design Review No. 1099:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Jose Garcia to
establish a Wayback Burger restaurant within a 2,500 sq. ft. portion of an existing building.
This project is located at 505 E. Tulare Avenue. This project is categorically exempt
pursuant to Section 15301 of the California Environmental Quality Act of 1970, as
amended.
Jose Garcia, Lindsay, spoke in favor of the project and answered any Commissioner
questions.
Commissioner Miller asked about a comment letter from Caltrans regarding this project and
the entrance and exit.
Director McDonnell stated that the planner who prepared the comment letter was relatively
new to Caltrans and that he himself contacted the supervising planner to discuss the
stringent conditions that were being placed on the project regarding cutting off entrance and
exit to the project. He further stated that he was reassured by the supervising planner that
entrance and exit would not be an issue with Caltrans.
Chairman Killion asked if condition number 6 should be amended due to it stating that
applicant shall comply with Caltrans comments/conditions included in the staff report.
It was motioned by Commissioner Miguel and seconded by Commissioner Herrera to adopt
Resolution 5261, approving Design Review No. 1099 based on the findings and subject to
the conditions as listed in the staff report with the correction to Condition number 6 to read
as follows:
6) Applicant shall comply with Engineering, Fire Department and Solid Waste
comments/conditions (Attachments V, VI and VII).

Esmeralda Contreras commented on various school activities.
ITEMS OF BOARD INTEREST/STAFF COMMUNICATIONS:
Director McDonnell reminded the Commission of the Brown Act training that will be held on
Tuesday, November 14th at 6 pm. He also thanked the Commissioners for confirming that they
will be in attendance on November 27th, he stated that we will be having a full agenda for that
meeting and one of the items will be revisions to the Design Review Ordinance.

There being no other items to come before the Commission, the meeting was adjourned at 7:47
p.m.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-
080, decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located
at 411 E. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision
was made. The appeal shall state the name of the person making the appeal, the decision that is being
appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not
supported by the evidence in the record.
