CALL TO ORDER II. PLEDGE OF ALLEGIANCE III. CITIZEN COMMENTS- This is the time for citizens to comment on items within the jurisdiction of the Planning Commission. The Planning Commission cannot legally discuss or take official action on citizen comments that are introduced tonight. Each speaker will be allowed three minutes, with a maximum time of 10 minutes per item, unless otherwise extended by the Planning Commission. IV. COMMISSIONER COMMENTS V. CONSENT CALENDAR: (1) Minutes of the November 13, 2017 Regular Planning Commission Meeting City of Tulare Planning Commission Agenda November 27, 2017 Page 1 VI. GENERAL BUSINESS- PUBLIC HEARING (1) Mitigated Negative Declaration/Tentative Subdivision Map 2017-08- Hidden Ridge and Zone Amendment No. 721: Review and consider adoption of Tentative Subdivision Map 2017-08 a request by Swift Homes to subdivide 9.73 acres into a 43 lot single-family residential subdivision to be zoned R-1-5 (Single Family Residential—5,000 square foot minimum lot area) density in two phases. The Zone Amendment is to change the existing zone from R-1-6 (Single Family Residential—6,000 sq. ft. minimum lot area) to R-1-5 (single Family Residential – 5,000 sq. ft. minimum lot area. This project is located approximately 350 feet west of Morrison Street newar the northwest corner of Morrison Street and Bardsley Avenue. A Mitigated Negative was prepared for this project for public review pursuant to provisions of the Public Resources Code, State of California, Section 210000 to 21177 of the California Environmental Quality Act (CEQA). Project Planner: Steve Brandt, Contract Planner Recommended Motion: Adopt Resolution 5265, approving Tentative Subdivision Map 2017-08—Hidden Ridge and adopting a Mitigated Negative Declaration for Tentative Subdivision Map 2017-08—Hidden Ridge and Zone Amendment No. 721. Recommended Motion: Adopt Resolution 5266, recommending approval of Zone Amendment No. 721 to the City Council for adoption. (2) Conditional Use Permit No. 2017-25: Consider a request by Casa De Adoracion Tulare to establish a nursery school (program devoted to the education or daycare of five or more pre-elementary school aged children other than those residing on the site). The nursery school is proposed to be established within an existing structure located at 136 North “O” Street. This project is exempt pursuant to Section 15301 (Existing Facilities) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Associate Planner Recommended Motion: Adopt Resolution 5264, approving Conditional Use Permit No. 2017-25 based on the findings and subject to the conditions as listed in the staff report. City of Tulare Planning Commission Agenda November 27, 2017 Page 2 (3) Conditional Use Permit No. 2017-26: Consider a request by Kenny Hildebrand of Kaweah Brewing to obtain a Conditional Use Permit for an ABC license (Type 23: Small Beer Manufacturer) associated with the construction of a 7,585 sq. ft. metal building with brewing area, restaurant, outdoor dining area and other improvements. Property is located at the northwest corner of Industrial Avenue and Industrial Place (Private). This project is exempt pursuant to Section 15332 (Infill Development) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Associate Planner Recommended Motion: Adopt Resolution 5263, approving Conditional Use Permit No. 2017-26 based on the findings and subject to the conditions as listed in the staff report. (4) Zone Amendment No. 724: Consider a request by City of Tulare to amend Chapter 10.120 of the Tulare Municipal Code Section 10.120 “Design Review”. The purpose of the amendment would reduce the potential for inconsistencies in the application of the code in its current form, as well as removing the requirement for permitted uses to go before the Planning Commission for review and approval. The proposed Zoning Ordinance Amendment is exempt from Environmental Review under the California Environmental Quality Act (CEQA), pursuant to Section 15061 (B) (3). Project Planner: Josh McDonnell, Director Recommended Motion: Adopt Resolution 5268, recommending Zone Amendment No. 724 to the City Council for adoption. VII. GENERAL BUSINESS-NON PUBLIC HEARING ITEMS (1) Design Review No. 1100: Consider a request by Great Valley Builders, Inc. to construct a 11,322 sq. ft. commercial building with a 81 space parking lot. Property is located in the De Lago Shopping Center on the north side of East Prosperity Avenue between Hillman and Laspina Streets. This project is exempt pursuant to Section 15332 (Infill Development) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Associate Planner Recommended Motion: Adopt Resolution 5267, approving Design Review No. 1100 based on the findings and subject to the conditions as listed in the staff report. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
