CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Olivares led us in the flag salute.
CITIZEN COMMENTS:
None.
COMMISSIONER COMMENTS:
Commissioner Miller asked if there were any current plans for the remaining parcels of
land in the Del Lago Shopping Center.
Director McDonnell stated that at this time he is not aware of any plans for
development.

CONSENT CALENDAR:
(1) Minutes of the February 25, 2019 regular meeting
(2) Oak Tree Estates Tentative Subdivision Map- Extension of Time
It was motioned by Commissioner Rocha and seconded by Commissioner Cox to
approve the Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2019-05:
Steven Sopp, Associate Planner, reviewed with the Commission a request by
Nelida Lopez Garcia to operate a stationary mobile vending vehicle on the property
located at 440 North J Street.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project the public hearing
was closed.
Following Commission discussion it was motioned by Commissioner Miller and
seconded by Commissioner Rocha to adopt Resolution 5313, approving
Conditional Use Permit No. 2019-05, based on the findings and subject to the
conditions as listed in the staff report.

(2) Conditional Use Permit No. 2019-07:
Steven Sopp, Associate Planner, reviewed with the Commission a request by Flor
Guevara and Francisco Osorio to operate a stationary mobile vending vehicle on
the property located at 1301 E. Paige Avenue.
Chairman Miguel opened the public hearing.

There being no one to speak in favor of or against the project, the public hearing
was closed.
Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Olivares to adopt Resolution 5314, approving
Conditional Use Permit No. 2019-07 based on the findings and subject to the
conditions as listed in the staff report.

GENERAL BUSINESS—NON PUBLIC HEARING ITEMS
(1) Housing Element Annual Progress Reports for 2014, 2015, 2016 and 2018:
Mario Anaya, Principal Planner, reviewed with the Commission the Annual
Progress Report (APR) to consider and recommend to the City Council approval
and forward to the State Department of Housing and Community Development.
Following Commission discussion it was motioned by Commissioner Miller and
seconded by Commissioner Rocha to recommend to the City Council approval of
the Annual Progress Report and forward it to the State Department of Housing
and Community Development.

jurisdiction of the Planning Commission. The Planning Commission cannot legally
discuss or take official action on citizen comments that are introduced tonight. Each
speaker will be allowed three minutes, with a maximum time of 10 minutes per item,
unless otherwise extended by the Planning Commission.

VI. GENERAL BUSINESS- PUBLIC HEARING
(1) Mitigated Negative Declaration/ Conditional Use Permit No. 2018-08:
Review and consider adoption of a Mitigated Negative Declaration and Conditional
Use Permit No. 2018-08. A request by Jasvir Singh to construct a service station
and convenience store with lease spaces for future tenants. The application also
includes a request to obtain an ABC license (Type 20: Off Sale beer and wine).
This project is located on the southeast corner of Industrial venue and South “K”
Street. An Initial Study and Mitigated Negative Declaration was prepared for this
project consistent with the California Environmental Quality Act (CEQA).

Recommended Motion: Adopt Resolution 5315, adopting a Mitigated Negative
Declaration and Conditional Use Permit No. 2018-08 based on the findings and
subject to the conditions as listed in the staff report.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-080,
decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located at 411 E.
Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made.
The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the
reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence
in the record.
