CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers February 25, 2019 491 North M Street COMMISSIONERS PRESENT: Miguel, Miller, Rocha, Cox TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Mario Anaya, Principal Planner Steven Sopp, Associate Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Rocha led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: Commissioner Rocha noted her concern with the city streets falling apart with all of the rain we have been having. She asked if staff knew which streets are on the list of repairs for this year. Planning Commission Minutes 1 February 25, 2019 Director McDonnell stated that he will provide the Commission with the CIP (Capital Improvements Program) list of street repairs at the next Planning Commission meeting. Commissioner Cox thanked staff for providing the Commissioners with the Site Plan Review Agenda. Chairman Miguel complimented all involved with the management of additional traffic at this years’ farm show. CONSENT CALENDAR: (1) Minutes of the February 11, 2019 regular meeting It was motioned by Commissioner Miller and seconded by Commissioner Cox to approve the Minutes of the February 11, 2019 meeting as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Mitigated Negative Declaration for City of Tulare 1, 2, 3 – TCP Mitigation Project: Mario Anaya, Senior Planner, reviewed with the Commission a request to consider adoption of a Mitigated Negative Declaration by the City of Tulare to install water treatment vessels, water backwash tanks, and associated pipelines to treat elevated leves of 1, 2, 3 – Trichloropropane (1,2,3 – TCP) in the City’s water supply. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5311, adopting the Mitigated Negative Declaration for the City of Tulare 1,2,3 – TCP Mitigation Project. Planning Commission Minutes 2 February 25, 2019  COMMISSIONERS AYES: Rocha, Miller, Cox, Miguel ABSENT: Olivares NOES: None ABSTAIN: None (2) Conditional Use Permit No. 2019-03: Steven Sopp, Associate Planner, reviewed with the Commission a request by Ana Salcedo to operate a licensed large family day care home (nine or more children, not to exceed fourteen) located at 1745 Peterson Street. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Cox and seconded by Commissioner Rocha to adopt Resolution 5310, approving Conditional Use Permit No. 2019-03 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Cox, Rocha, Miller, Miguel ABSENT: Olivares NOES: None ABSTAIN: None (3) Conditional Use Permit No. 2019-04: Steven Sopp, Associate Planner, reviewed with the Commission a request by Mumtax Sadruddin for a Type 21: Off sale General to sell beer, wine and distilled spirits for consumption off the premises in conjunction with an existing service/ convenience store located at 1095 E. Tulare Avenue. Chairman Miguel opened the public hearing. Planning Commission Minutes 3 February 25, 2019  There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Cox and seconded by Commissioner Rocha to adopt Resolution 5312, approving Conditional Use Permit No. 2019-04 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Cox, Rocha, Miller, Miguel ABSENT: Olivares NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: Chairman Miguel commented that the Mission Oak Girls and the Tulare Western Boys Soccer teams both won their Sectional Championships. DIRECTORS REPORT: Director McDonnell stated that he will be providing the Commission with the CIP list at the next Planning Commission. He noted that the Commission will be seeing activity along Cartmill Avenue as the city begins its widening, water and sewer replacement project. He also noted that on the next agenda the Commission will see the Annual Report that will be provided to the HCD. He further noted that in the future the Commission will see an Ag Mitigation Program that the city will need to create to accompany pending annexations.
