CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers April 8, 2019 491 North M Street COMMISSIONERS PRESENT: Miguel, Miller, Rocha, Cox, Olivares TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Mario Anaya, Principal Planner Steven Sopp, Associate Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Cox led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: Commissioner Ontiveros noted that he is a member of the Tulare Youth Athletic Board and they had their opening day on April 7 th at Mission Oak High School and over 1500 spectators turned out. He stated that there are approximately 330 kids enrolled in the flag football program. Planning Commission Minutes 1 April 8, 2019 CONSENT CALENDAR: (1) Minutes of the March 25, 2019 regular meeting It was motioned by Commissioner Rocha and seconded by Commissioner Cox to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Variance No. 460: Steven Sopp, Associate Planner, reviewed with the Commission a request by Pilot Travel Centers to allow a freeway sign to be located approximately 710 ft away from SR 99 in lieu of the maximum 300 ft. required per City of Tulare Municipal Code on property located at 979 E. Paige Avenue. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Rocha to adopt Resolution 5319, approving Variance No. 460, based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Miller, Rocha, Cox, Olivares ABSENT: None Miguel NOES: None ABSTAIN: None (2) Conditional Use Permit No. 2019-08: Steven Sopp, Associate Planner, reviewed with the Commission a request by Gary Grigoryan to construct an 8,000 sq. ft. Diesel Exhaust Fluid (DEF) manufacturing facility located north of Industrial Avenue on the east side of Industrial Place. Chairman Miguel opened the public hearing. Planning Commission Minutes 2 April 8, 2019  John Atilano, Lane Engineering, spoke in favor of the project and made himself available to answer any questions. There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Olivares and seconded by Commissioner Rocha to adopt Resolution 5318, approving Conditional Use Permit No. 2019-08 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Olivares, Rocha, Cox, Miller ABSENT: None Miguel NOES: None ABSTAIN: None Commissioner Cox recused himself stating that he owns property near project. (3) Conditional Use Permit No. 2019-09: Steven Sopp, Associate Planner, reviewed with the Commission a request by Art Quintero of AQ Designs on behalf of Diego Espinoza to construct a duplex consisting of two 1,749 sq. ft. units to be located at 253 North “M” Street. Chairman Miguel opened the public hearing. Art Quintero, AQ Designs, spoke in favor of the project and made himself available to answer any questions. There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Olivares to adopt Resolution 5316, approving Conditional Use Permit No. 2019-09 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Miller, Olivares, Rocha, Miguel ABSENT: None Planning Commission Minutes 3 April 8, 2019  NOES: None ABSTAIN: Cox Commissioner Cox returned to his seat. (4) Conditional Use Permit No. 2019-10: Steven Sopp, Associate Planner, reviewed with the Commission a request by Varinder Singh to operate a stationary mobile vending vehicle on property located at 2811 S. Blackstone Street. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5317, approving Conditional Use Permit No. 2019-10 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Miller, Olivares, Cox ABSENT: None Miguel NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: None DIRECTORS REPORT: Director McDonnell provided the Commission with an update on the homeless encampment located on the Railroad property between “J” Street and “I” Street. Planning Commission Minutes 4 April 8, 2019 He noted that staff along with several agencies offered services to over 55 of the residents out there and out of the 55 approximately 17 of them took advantage of the services offered.
