CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers April 22, 2019 491 North M Street COMMISSIONERS PRESENT: Miguel, Miller, Rocha, Cox TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Mario Anaya, Principal Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Lucie Brown, Commission Clerk, led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: Commissioner Cox stated he noticed some off-site improvements happening at the new Pilot location and asked staff if they were still planning on opening in May. Director McDonnell confirmed that they are still planning on opening in May. Chairman Miguel noted that he attended the City Council meeting this past week as well as the Ad Hoc Homeless meeting and provided the Commission with a brief update on the Ad Hoc meeting. Planning Commission Minutes 1 April 22, 2019 CONSENT CALENDAR: (1) Minutes of the April 8, 2019 regular meeting It was motioned by Commissioner Cox and seconded by Commissioner Rocha to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Conditional Use Permit No. 2018-30: Mario Anaya, Principal Planner, reviewed with the Commission a request by Geraldine Shaver to construct and approximately 1,300 sq. ft. single family dwelling on the property located at 644 Mariposa Avenue. Chairman Miguel opened the public hearing. Jesus Gutierrez, agent for the applicant, spoke in favor of the project. There being no one else to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5321, approving Conditional Use Permit No. 2018-30, based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Miller, Cox, Miguel ABSENT: Olivares NOES: None ABSTAIN: None (2) Conditional Use Permit No. 2019-11: Mario Anaya, Principal Planner, reviewed with the Commission a request by David Safina to construct an approximately 1,089 sq. ft. single family dwelling on the property located at 439 South “I” Street. Chairman Miguel opened the public hearing. Planning Commission Minutes 2 April 22, 2019 There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Rocha to adopt Resolution 5320, approving Conditional Use Permit No. 2019-11 based on the findings and subject to the conditions as listed in the staff report. GENERAL BUSINESS- PUBLIC HEARING (1) Conditional Use Permit No. 2019-12: Review and consider a request by Heather Ruiz to operate a licensed large family day care home (nine or more children) located at 470 E. Merritt Avenue. This project is exempt pursuant to Section 15274 of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Associate Planner Recommended Motion: Adopt Resolution 5322, approving Conditional Use Permit No. 2019-12 based on the findings and subject to the conditions as listed in the staff report. (2) Conditional Use Permit No. 2019-13: Review and consider a request by TAE, Inc. on behalf of Neal Properties to construct an approximately 17,224 sq. ft. office / warehouse building for Paragon Pharmaceuticals located on the southwest corner of Cedar Avenue and South “H” Street. This project is exempt pursuant to Section 15332 (In-fill Development Projects) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Associate Planner Recommended Motion: Adopt Resolution 5324, approving Conditional Use Permit No. 2019-13 based on the findings and subject to the conditions as listed in the staff report. (3) Conditional Use Permit No. 2019-14: Review and consider a request by Jessica Sotelo to operate a licensed large family day care home (nine or more children) located at 1855 North “M” Street. This project is exempt pursuant to Section 15274 of the California Environmental Quality Act of 1970, as amended. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
