CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers June 10, 2019 491 North M Street COMMISSIONERS PRESENT: Miller, Rocha, Cox, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Mario Anaya, Principal Planner Steven Sopp, Associate Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Rocha led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: None CONSENT CALENDAR: (1) Minutes of the May 13, 2019 Regular Planning Commission Meeting It was motioned by Commissioner Rocha and seconded by Commissioner Cox to approve the Consent Calendar as presented. Planning Commission Minutes 1 June 10, 2019 Motion carried by unanimous vote. PUBLIC HEARING: (1) Conditional Use Permit No. 2019-17: Steven Sopp, Associate Planner, reviewed with the Commission a request by Maria Lopez to operate a licensed large family day care home (nine or more children, not to exceed fourteen) located at 1966 Weyrich Street. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Cox and seconded by Commissioner Miller to adopt Resolution 5325, approving Conditional Use Permit No. 2019-17, based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Cox, Miller, Rocha, Miguel ABSENT: Olivares NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: None DIRECTORS REPORT: Principal Planner Anaya reviewed with the Commission two projects that will be coming to Planning Commission over the next few meetings. The first one is a commercial Planning Commission Minutes 2 June 10, 2019 project on Prosperity as well as a Medical Complex on Cartmill. He also announced that at the last City Council Meeting the budget was passed. CALL TO ORDER II. PLEDGE OF ALLEGIANCE III. CITIZEN COMMENTS- This is the time for citizens to comment on items within the jurisdiction of the Planning Commission. The Planning Commission cannot legally discuss or take official action on citizen comments that are introduced tonight. GENERAL BUSINESS- PUBLIC HEARING (1) Mitigated Negative Declaration/ General Plan Amendment No. 2019-01/ Zone Amendment No. 733 Consider a request by Three Rivers Development, LLC for a General Plan Amendment No. 2019-01 to change the General Plan land use designation for the project site from Office Commercial to Community Commercial and for Zone Amendment No. 733 to change the existing zoning from C-2 (Office Commercial) to C-3 (Retail Commercial). This project is located on approximately 3.83 acres on the south side of Prosperity Avenue between Brentwood and Laspina Streets (APN 171-300-016). A Mitigated Negative Declaration has been prepared in accordance with the California Environmental Quality Act. Project Planner: Steven Sopp, Associate Planner Recommended Motion: Adopt Resolution Recommending to the City Council approval of General Plan Amendment No. 2019-01 and Zone Amendment No. 733 and adoption of the Mitigated Negative Declaration based on the findings and subject to the conditions as listed in the staff report. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
