CALL TO ORDER II. PLEDGE OF ALLEGIANCE III. CITIZEN COMMENTS- This is the time for citizens to comment on items within the jurisdiction of the Planning Commission. The Planning Commission cannot legally discuss or take official action on citizen comments that are introduced tonight. Each speaker will be allowed three minutes, with a maximum time of 10 minutes per item, unless otherwise extended by the Planning Commission. IV. COMMISSIONER COMMENTS V. CONSENT CALENDAR: (1) Minutes of the August 12, 2019 Regular Planning Commission Meeting City of Tulare Planning Commission Agenda August 26, 2019 Page 1 VI. GENERAL BUSINESS- PUBLIC HEARING: (1) Conditional Use Permit No. 2019-21: Consider a request by Verizon Wireless to install and operate a cellular antenna and ground equipment to be located at 2201 E. Bardsley Avenue. This project is exempt pursuant to Section 15303 (d) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5335, approving Conditional Use Permit No. 2019-21 based on the findings and subject to the conditions as listed in the staff report. (2) Variance No. 461: Consider a request by Evergreen Island/ Ruben & Elizabeth Madrid for a variance from the required front yard setback of 35 feet for an existing non-conforming structure. This project is exempt pursuant to Section 15061 (b) (3) of the California Environmental Quality Act of 1970, as amended. Project Planner: Mario Anaya, Principal Planner Recommended Motion: Adopt Resolution 5332, approving Variance No. 461 based on the findings and subject to the conditions as listed in the staff report. (3) Zone Amendment No.737: Consider a request by the City of Tulare to amend Section 10.40 and Section 10.64 of the Tulare Municipal Code to add both roof-mounted solar as well as ground- mounted solar arrays to the list of uses in Sections 10.40 and 10.64. This project is exempt pursuant to Section 15061 (B) (3) of the California Environmental Quality Act of 1970, as amended. Project Planner: Mario Anaya, Principal Planner Recommended Motion: Adopt Resolution 5336, recommending to the City Council adoption of Zone Amendment No.737. City of Tulare Planning Commission Agenda August 26, 2019 Page 2 (4) Zone Amendment No.738: Consider a request by the City of Tulare to amend Section 10.180 of the Tulare Municipal Code pertaining to standards for vendor stands on private property, including sidewalks. This project is exempt pursuant to Section 15061 (B) (3) of the California Environmental Quality Act of 1970, as amended. Project Planner: Mario Anaya, Principal Planner Recommended Motion: Adopt Resolution 5337, recommending to the City Council adoption of Zone Amendment No.738. VII. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
