CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers August 26, 2019 491 North M Street COMMISSIONERS PRESENT: Miller, Rocha, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Mario Anaya, Principal Planner Steven Sopp, Senior Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Rocha led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: None CONSENT CALENDAR: (1) Minutes of the August 12, 2019 Regular Planning Commission Meeting Planning Commission Minutes 1 August 26, 2019 It was motioned by Commissioner Rocha and seconded by Commissioner Miller to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Conditional Use Permit No. 2019-21: Steven Sopp, Senior Planner, reviewed with the Commission a request Verizon Wireless to install and operate a cellular antenna and ground equipment to be located at 2201 E. Bardsley Avenue. Chairman Miguel opened the public hearing. Ben Hackstead, Verizon Representative, spoke in favor of the project. He also wanted to clarify the wording on condition #5 in the staff report that references a fence surrounding the facility. He noted that instead of just a fence it will actually be a wall. There being no one to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5335, approving Conditional Use Permit No. 2019-21 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Miller, Miguel ABSENT: Cox, Olivares NOES: None ABSTAIN: None (2) Variance No. 461; Mario Anaya, Principal Planner, reviewed with the Commission a request by Evergreen Island/ Ruben & Elizabeth Madrid for a variance from the required front yard setback of 35 feet for an existing non-conforming structure. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project the public hearing was closed. Planning Commission Minutes 2 August 26, 2019 Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5332, approving Variance No. 461 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Miller, Miguel ABSENT: Cox, Olivares NOES: None ABSTAIN: None (3) Zone Amendment No. 737: Mario Anaya, Principal Planner, reviewed with the Commission a request by the City of Tulare to amend Section 10.40 and Section 10.64 of the Tulare Municipal Code to add both roof-mounted solar as well as ground-mounted solar arrays to the list of uses in Sections 10.40 and 10.64. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5336, recommending to the City Council adoption of Zone Amendment No. 737. COMMISSIONERS AYES: Rocha, Miller, Miguel ABSENT: Cox, Olivares NOES: None ABSTAIN: None (4) Zone Amendment No. 738: Mario Anaya, Principal Planner, reviewed with the Commission a request by the City of Tulare to amend Section 10.180 of the Tulare Municipal Code pertaining to standards for vendor stands on private property, including sidewalks. Chairman Miguel opened the public hearing. Planning Commission Minutes 3 August 26, 2019 There being no one to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5337, recommending to the City Council adoption of Zone Amendment No. 738. COMMISSIONERS AYES: Rocha, Miller, Miguel ABSENT: Cox, Olivares NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: Although there were no Teens on Board, Chairman Miguel noted that all 3 High School football teams won this past week and encouraged everyone to attend and support our athletic programs. DIRECTORS REPORT: Director McDonnell, congratulated the High School teams and announced to the Commission that there are more Zone Amendments to follow in the near future to clean up our Zoning Ordinance. CONSENT CALENDAR: (1) Minutes of the August 26, 2019 Regular Planning Commission Meeting (2) CEQA Exemption for Pleasant Avenue Improvements Plan- Resolution 5342 City of Tulare Planning Commission Agenda September 9, 2019 Page 1 VI. GENERAL BUSINESS- PUBLIC HEARING: (1) Final Environmental Impact Report/ Annexation 2017-01- Cartmill Crossings, General Plan Amendment No. 2017-03/ Zone Amendment No. 725: Consider a request by West Coast Construction to annex approximately 127 acres within the City’s urban development boundary into the City limits. In addition to the annexation the Planning Commission will also consider a General Plan Amendment and Zoning Amendment for the establishment of the planned multi-use commercial and residential development. The project is located adjacent to and east of State Route 99 and on the north side of Cartmill Avenue. An Environmental Impact Report has been prepared for this project pursuant to the California Environmental Quality Act of 1970, as amended. Project Planner: Mario Anaya, Principal Planner Recommended Motion: Adopt Resolution 5340, recommending to the City Council approval of General Plan Amendment No. 2017-03 based on the findings and subject to conditions listed in the staff report. Recommend4ed Motion: Adopt Resolution 5341, recommending to the City Council adoption of Annexation 2017-01- Cartmill Crossings and Zone Amendment No. 725 and adoption of the Environmental Impact Report based on the findings and subject to the conditions as listed in the staff report. (2) Mitigated Negative Declaration/ Conditional Use Permit No. 2019-20: Consider a request by Saputo Cheese USA to construct a concentrated solar array on an approximately 3-acre vacant portion of a 40-acre parcel that is currently utilized as a cheese production facility. This project is located on the north side of Paige Avenue between Blackstone and South “K” Streets. A Mitigated Negative Declaration has been prepared for this project pursuant to the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5343, approving Conditional Use Permit No. 2019-20 and adoption of the Mitigated Negative Declaration based on the findings and subject to the conditions as listed in the staff report. City of Tulare Planning Commission Agenda September 9, 2019 Page 2 (3) Variance No. 462: Consider a request by Double Eagle Investment for a variance from the minimum off-street parking requirement for a proposed Family Dollar Store. The applicant is proposing to establish 16 parking spaces rather than the minimum 31 required. This project is located at 2121 E. Tulare Avenue and is zoned C-4 (Service Commercial). The proposed project is categorically exempt pursuant to Section 15301, 15311 (b) and 15332 of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5344, approving Variance No. 462 based on the findings and subject to the conditions as listed in the staff report. (4) Conditional Use Permit No. 2019-22: Consider a request by Jose Antonio Martinez to operate a stationary mobile vending vehicle on the property located at 265 S. West Street. This project is exempt pursuant to Section 15304 (e) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5339, approving Conditional Use Permit No. 2019-22, based on the findings and subject to the conditions as listed in the staff report. (5) Conditional Use Permit No. 2019-23: Consider a request by Veronica Ortiz to operate a stationary mobile vending vehicle on the property located at 1414 W. Tulare Avenue. This project is exempt pursuant to Section 15304 (e) of the California Environmental Quality Act of 1970, as amended. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
