CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers September 9, 2019 491 North M Street COMMISSIONERS PRESENT: Cox, Miller, Rocha, Olivares, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Mario Anaya, Principal Planner Steven Sopp, Senior Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Cox led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: Chairman Miguel stated that he presented the Annual Planning Report to the City Council and it was nice to see all that the Planning Commission has done over the last year or so. Planning Commission Minutes 1 September 9, 2019 CONSENT CALENDAR: (1) Minutes of the August 26, 2019 Regular Planning Commission Meeting (2) CEQA Exemption for Pleasant Avenue Improvements Plan- Resolution 5342 It was motioned by Commissioner Rocha and seconded by Commissioner Miller to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Final Environmental Impact Report/ Annexation 2017-01- Cartmill Crossings, General Plan Amendment No. 2017-03/ Zone Amendment No. 725: Mario Anaya, Principal Planner, reviewed with the Commission a request by West Coast Construction to annex approximately 127 acres within the City’s urban development boundary into the City limits. In addition to the annexation the Planning Commission will also consider a General Plan Amendment and Zoning Amendment for the establishment of the planned multi-use commercial and residential development. Steve Brandt, Quad Knopf, spoke in favor of the project and thanked staff for all their work on the project. There being no one else to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Rocha to adopt Resolution 5340, recommending to the City Council adoption of General Plan Amendment No. 2017-03 based on the findings and subject to the conditions listed in the staff report. COMMISSIONERS AYES: Miller, Rocha, Cox, Olivares ABSENT: None Miguel NOES: None ABSTAIN: None Planning Commission Minutes 2 September 9, 2019 It was motioned by Commissioner Miller and seconded by Commissioner Rocha to adopt Resolution 5341, recommending to the City Council adoption of Annexation 2017-01- Cartmill Crossings and Zone Amendment No. 725 and adoption of the Environmental Impact Report based on the findings and subject to the conditions listed in the staff report. COMMISSIONERS AYES: Miller, Rocha, Cox, Olivares ABSENT: None Miguel NOES: None ABSTAIN: None (2) Mitigated Negative Declaration/ Conditional Use Permit No. 2019-20: Steven Sopp, Senior Planner, reviewed with the Commission a request by Saputo Cheese USA to construct a concentrated solar array on an approximately 3-acre vacant portion of a 40-acre parcel that is currently utilized as a cheese production facility. This project is located on the north side of Paige Avenue between Blackstone and South “K” Streets. Chairman Miguel opened the public hearing. Loren Aiton, Teter Architecture, spoke in favor of the project and made himself available to answer any questions. There being no one else to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Olivares to adopt Resolution 5343, approving Conditional Use Permit No. 2019-20 and adoption of the Mitigated Negative Declaration based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Olivares, Cox, Miller ABSENT: None Miguel Planning Commission Minutes 3 September 9, 2019 NOES: None ABSTAIN: None (3) Variance No. 462: Steven Sopp, Senior Planner, reviewed with the Commission a request by Double Eagle Investment for a variance from the minimum off-street parking requirement for a proposed Family Dollar Store. The applicant is proposing to establish 16 parking spaces rather than the minimum 31 required. This project is located at 2121 E. Tulare Avenue. Chairman Miguel opened the public hearing. Chris Ward, Architect, spoke in favor of the project and made himself available to answer any questions. There being no one else to speak in favor of or against the project the public hearing was closed. Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Rocha to adopt Resolution 5344, approving Variance No. 462 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Miller, Rocha, Cox, Olivares ABSENT: None Miguel NOES: None ABSTAIN: None (4) Conditional Use Permit No. 2019-22: Steven Sopp, Senior Planner, reviewed with the Commission a request by Jose Antonio Martinez to operate a stationary mobile vending vehicle on the property located at 265 S. West Street. Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project the public hearing was closed. Planning Commission Minutes 4 September 9, 2019 Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Cox to adopt Resolution 5339, approving Conditional Use Permit No. 2019-22 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Miller, Cox, Rocha, Olivares ABSENT: None Miguel NOES: None ABSTAIN: None (5) Conditional Use Permit No. 2019-23: Steven Sopp, Senior Planner, reviewed with the Commission a request by Veronica Ortiz to operate a stationary mobile vending vehicle on the property located at 1414 W. Tulare Avenue Following Commission discussion it was motioned by Commissioner Cox and seconded by Commissioner Rocha to adopt Resolution 5338, approving Conditional Use Permit No. 2019-23 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Cox, Rocha, Miller, Olivares ABSENT: None Miguel NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: None Planning Commission Minutes 5 September 9, 2019 DIRECTORS REPORT: Director McDonnell, thanked Chairman Miguel for his presentation to the City Council regarding the Annual Planning Report. He further noted that although there will not be a Planning Commission meeting on September 23rd, he invited the Commissioners to attend the “Night at the Library” fundraiser that will be held on September 23 rd. GENERAL BUSINESS- PUBLIC HEARING: (1) Conditional Use Permit No. 2019-25 Consider a request by David Safina of Tulare County Mortgage to construct an approximately 1,350 sq. ft. single-family dwelling to be located at 230 South “E” Street on the east side of “E” Street between Inyo and Kern Avenues. This project is exempt pursuant to Section 15303 (a) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5345, approving Conditional Use Permit No. 2019-25 based on the findings and subject to the conditions as listed in the staff report.
