CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers October 14, 2019 491 North M Street COMMISSIONERS PRESENT: Cox, Miller, Rocha, Olivares, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Josh McDonnell, Community & Economic Development Director Mario Anaya, Principal Planner Steven Sopp, Senior Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Olivares led us in the flag salute. CITIZEN COMMENTS: None. COMMISSIONER COMMENTS: Commissioner Cox asked who to address any traffic related concerns to. Director McDonnell stated that Michael Miller, City Engineer is the contact person. Planning Commission Minutes 1 October 14, 2019 CONSENT CALENDAR: (1) Minutes of the September 9, 2019 Regular Planning Commission Meeting (2) The Greens at Oak Creek Tentative Subdivision Map- Time Extension (3) Hidden Ridge Tentative Subdivision Map- Time Extension (4) CEQA Exemption for Kern-Silva-Latimer-Moraine and Sunset Improvements- Resolution 5346 It was motioned by Commissioner Rocha and seconded by Commissioner Olivares to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Conditional Use Permit No. 2019-25: Steven Sopp, Senior Planner, reviewed with the Commission a request by David Safina of Tulare County Mortgage to construct an approximately 1,350 sq. ft. single- family dwelling to be located at 230 South “E” Street. Commissioner Cox recused himself citing conflict. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Miller to adopt Resolution 5345, approving Conditional Use Permit No. 2019-25 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Rocha, Miller, Olivares, Miguel ABSENT: None NOES: None ABSTAIN: Cox Commissioner Cox returned to his seat. Planning Commission Minutes 2 October 14, 2019 GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: Chairman Miguel noted that all three High School football teams won this past week. DIRECTORS REPORT: Director McDonnell announced that the October 15th City Council meeting has been moved to October 22nd at which time the Cartmill Crossing Annexation will be considered and Council will also be reviewing a Cannabis Ordinance. GENERAL BUSINESS- PUBLIC HEARING: (1) Conditional Use Permit No. 2019-26: Consider a request by Roger Liang to establish an agricultural film recycling business with an existing approximately 14,780 sq. ft. building located at 863 Levin Avenue (the south side of Levin Avenue between Blackstone and South “O” Streets). This project is exempt pursuant to Section 15301 (Existing Facilities) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5348, approving Conditional Use Permit No. 2019-26 based on the findings and subject to the conditions as listed in the staff report. Kern Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
