CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Cox led us in the flag salute.
CITIZEN COMMENTS:
None.
COMMISSIONER COMMENTS:
Commissioner Miller noted that the sprinklers in the common area near her house are causing
dirt to run onto the sidewalk and she is concerned that this could cause someone to slip.
Director Myers stated that she would refer her concerns to the Public Works Director.

Commissioner Miller also asked about the fireworks ordinance noting that there have been a lot
of large explosions lately.
Director Myers stated that any concerns about fireworks should be referred to Fire Marshal Ryan
Leonardo.
CONSENT CALENDAR:
(1) Minutes of the May 11, 2020 Regular Planning Commission Meeting
(2) Extension of Time- Liberty Hill Subdivision
It was motioned by Commissioner Rocha and seconded by Chairman Miller to approve the
Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2020-12:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Carina Gomez
to operate a stationary mobile vending vehicle on property located at 440 North J Street.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was
closed.
Following Commission discussion it was motioned by Commissioner Cox and seconded
by Commissioner Rocha to adopt Resolution 5367, approving Conditional Use Permit
No. 2020-12 based on the findings and subject to the conditions as listed in the staff
report.

GENERAL BUSINESS—NON PUBLIC HEARING ITEMS
(1) Findings of Consistency for SP 20-00- Derrel’s Mini Storage- Blackstone Street:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Derrel’s Mini
Storage for revision to conditions of approval as a result of a Site Plan Review meeting.
Director Myers noted that with the removal of Design Reviews all Site Plan Review
comments or decisions are appealable to the Planning Commission.
Steven Sopp, Senior Planner, noted that although this is not a public hearing the applicant
is in the audience and the Commission has the option to allow the applicant to speak.
It was the consensus of the Commission to allow the applicant to speak.
Bill Robinson, 906 Center #106, Fresno, spoke on behalf of the applicant and provided
the Commission with examples of what Derrel’s proposes to do and reasons for
requesting modification to the Engineering condition # 2. The applicant is requesting that
instead of having to pave the entire area of the project with asphalt concrete they would
pave only the perimeter with the asphalt concrete and use crushed rock for the stalls and
all access isles leading to parking stalls.
Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Miller to grant a variation from the ordinance to allow the
applicant (Derrel’s Mini Storage) to pave only the perimeter of proposed RV parking area
with asphalt/concrete and then the remaining drive isles and parking areas would be
designed with three quarter inch crushed rock (gravel).

DIRECTORS REPORT:
Director Myers presented the Commission with an update on several projects:
Bethel Assisted Living Facility- the applicant is working with the architect to finalize the
on site improvements.

Cartmill/ Hwy 99- Mr. Mouw has submitted for Site Plan Review and will be bringing in
a revised site plan with hopefully tenants.
Southwest corner of Mooney/ Bardsley- Starbucks and Subway are moving along, Taco
Bell should be starting soon as well as an Adult Care Facility.
Northeast corner of Mooney/ Bardsley- Human Bean Coffee kiosk and Little Caesars
Pizza is proposed to go in next to the new Jack in the Box.
Prosperity Mall project next to Evolutions- confirmation of 2 tenants.
New proposed project near the Outlet Mall on Retherford to include various phases of
retail.
Chairman Miguel thanked Director Myers and all the staff for all their hard work.

There being no other items to come before the Commission, the meeting was adjourned at 7:33
p.m.

VI. GENERAL BUSINESS- PUBLIC HEARING:
(1) Zone Amendment No. 741/ Negative Declaration :
Consider a request by Quest Equity, LLC to amend Chapter 10.40 (Permitted and
Conditional Uses in Commercial Zones) of the City of Tulare Municipal Code to
allow storage buildings, mini storage as a conditional use within the C-3 (Retail
Commercial) zoning designation. A Negative Declaration has been prepared in
accordance with the California Environmental Quality Act.

Staff requests the Planning Commission’s consideration and decision on whether to
recommend Zone Amendment No. 741 to the City Council for adoption.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-080,
decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located at 411 E. Kern
Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal
shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the
appeal, including an error, abuse of discretion or a decision that is not supported by the evidence in the record.
