170 REGULAR CITY COUNCIL MEETING MUNICIPAL MINUTES CITY OF TUPELO STATE OF MISSISSIPPI FEBRUARY 15, 2022 Be it remembered that a regular meeting of the Tupelo City Council was held in the Council Chambers in the City Hall building on Tuesday, February 15, 2022, at 6:00 p.m. with the following in attendance: Council Members Chad Mims, Lynn Bryan, Travis Beard, Nettie Davis, Buddy Palmer, Janet Gaston and Rosie Jones; Ben Logan, City Attorney and Missy Shelton, Clerk of the Council. Council Member Buddy Palmer gave the invocation, followed by the pledge of allegiance led by Council Member Janet Gaston. Council President Buddy Palmer called the meeting to order at 6:00 p.m. CONFIRMATION OR AMENDMENT TO THE AGENDA AND AGENDA ORDER Council Member Bryan moved, seconded by Council Member Beard, to confirm the agenda and agenda order, as presented. The vote was unanimous in favor. EMPLOYEE RECOGNITION Mayor Todd Jordan recognized the following employees for their employment with the City of Tupelo: Chris Hogan Fire Department 25 years Bret Moyer Police Department 20 years PUBLIC RECOGNITION Council Member Travis Beard welcomed Ms. Jenny Savely as the new City Planner. Council Member Nettie Davis congratulated the Junior Auxiliary on the recent Charity Ball. She also congratulated Mrs. Doyce Deas for being named “Outstanding Citizen of the Year”. MAYOR'S REMARKS Mayor Todd Jordan welcomed Tupelo School Superintendent Rob Picou, School Board Member Joe Babb and his wife Christy Jordan, a TPSD administrator, to the meeting. CITIZEN HEARING Ms. Chris Van Horn, 2416 William Drive, addressed the Council concerning issues in her neighborhood. She requested that speed bumps be placed on the streets to help slow vehicles down. She also raised concerns about the Residential Group Homes in her neighborhood and the traffic they cause due to employees. 171 Mr. Elliott Johnston, owner of a business located at 2301 West Main Street - Suite C, addressed the Council encouraging them to 'opt in' on the issues concerning the law recently passed allowing cannabis. He asked that they make their decision soon so that those who wish to enter this type business can start making plans and arrangements. IN THE MATTER OF APPROVAL OF MINUTES FOR FEBRUARY 1, 2022 COUNCIL MEETING Council Member Davis moved, seconded by Council Member Beard, to approve the minutes of the Regular City Council meeting held on February 1, 2022. The vote was unanimous in favor. IN THE MATTER OF BILL PAY Bills were reviewed at 4:30 p.m. by Council Members Lynn Bryan, Travis Beard, Buddy Palmer and Chad Mims. Council Member Bryan moved, seconded by Council Member Jones, to approve the payment of the checks, bills, claims and utility adjustments. The vote was unanimous in favor. APPENDIX A IN THE MATTER OF BUDGET AMENDMENT #6 FOR FY 2022 Council Member Beard moved, seconded by Council Member Gaston, to approve budget amendment #6 for FY 2022. The vote was unanimous in favor. APPENDIX B IN THE MATTER OF RATIFICATION OF DEPOSITORY AGREEMENT WITH BANCORPSOUTH (CADENCE BANK) At this time, Council Member Janet Gaston recused herself from the meeting. At the January 18, 2022, Council meeting, the Council gave authorization to the mayor and CFO to execute any and all documents, after legal review, concerning the Depository Agreement with Bancorpsouth (Cadence), subject to ratification in final form. Council Member Beard moved, seconded by Council Member Jones to approve the ratification of the depository agreement with Bancorpsouth (Cadence Bank).The vote was, as follows: Chad Mims Aye Lynn Bryan Aye Travis Beard Aye Nettie Davis Aye Buddy Palme Aye Rosie Jones Aye Janet Gaston Recused. APPENDIX C Council Member Janet Gaston rejoined the meeting. 172 IN THE MATTER OF APPOINTMENT OF HOPE HUEY TO TUPELO PUBLIC SCHOOL BOARD Council Member Bryan moved, seconded by Council Member Mims, to appoint Mrs. Hope Huey to the Tupelo Public School Board for a 5-year term beginning March 1, 2022. The vote was unanimous in favor. APPENDIX D IN THE MATTER OF A RESOLUTION DECLARING PROPERTY AS SURPLUS AND ORDERING THE ABANDONMENT OF A PORTION OF RIGHT OF WAY AND ACCEPTING A DONATION OF REAL PROPERTY Council Member Bryan moved, seconded by Council Member Jones, to approve the Resolution Declaring Property as Surplus and Ordering the Abandonment of a Portion of Right Of Way and Accepting a Donation of Real Property. This action will surplus/abandon a portion of Rea Street right- of-way, no longer needed for governmental or related purposes, transferring it to Gary Sparkman. In addition, the City will accept the donation of .14 acres to the South of Tolbert Street adjacent to Gumtree Park from Gary Sparkman. The vote was unanimous in favor. APPENDIX E. IN THE MATTER OF REJECTION OF BID NUMBER 2021-0042PW, ROADWAY SURFACE TREATMENT IMPROVEMENTS City Engineer Dennis Bonds asked that the Council reject bid # 2021-024PW - Roadway Surface Treatment Improvements, due to no bids being received. Council Member Mims moved, seconded by Council Member Beard, to approve the rejection of the bid. The vote was unanimous in favor. APPENDIX F IN THE MATTER OF BID APPROVAL 2022-001PW CITY STREET MICRO- RESURFACING Bids were received by the City of Tupelo for Bid # 2022-0013PW for City Street Micro-Resurfacing. Council Member Bryan moved, seconded by Council Member Beard, to find the sole bid was commercially reasonable and to award the bid to the lowest and best bid of Vance Brothers, Inc. The vote was unanimous in favor. APPENDIX G IN THE MATTER OF MOU WITH US MARSHALS Council Member Davis moved, seconded by Council Member Jones, to approve a Memorandum of Understanding between the Tupelo Police Department and the U.S. Marshall's Service (GCRFTF), in the amount of $9,800.00. This MOU will be for Task Force Overtime Reimbursement FY 2022 Operation, if needed. The vote was unanimous in favor. Ashton (THS ’13), Eric (THS ’19), and Elise, a 9th grader at THS. Hope grew up in the Mississippi Delta and is a graduate of Amanda Elzy High School. She went on to graduate from Tougaloo College with a BS degree in Biology and then to the University of Mississippi School of Nursing where she obtained a BS degree in Nursing. Hope worked as a nurse coordinator for the University of Mississippi of Medical Center’s Heart Failure and Cardiac Transplant Program. Hope has always been an advocate for children and the public school system. She has been active in various PTO’s as her children matriculated through TPSD. She has also worked with groups such as A.E.E., Antione Tannehill Good Samaritan Free Clinic and Tupelo Academy of Dance Arts to name a few. Hope is a member of St. James Catholic Church and is married to Dr. Roger Huey. APPENDIX I 254 Supply/Installation – Thermoplastic Traffic Marking and Paint Traffic Marking Materials - 12 month 2022-002PW The City of Tupelo Public Works Department is accepting bids for supply and installation of Thermoplastic Traffic Marking materials and Paint Traffic Marking for a twelve month period of time. Sealed bids will be received until 10:00 a.m., Thursday, February 3, 2022, at Tupelo City Hall, 71 East Troy Street, Tupelo, MS 38804. Bids can also be submitted electronically at www.tupelomsbids.com until 10:00 a.m., February 3, 2022. Any questions about the website, bid documents, or electronic bidding should be directed to Plan House at 662-407-0193. Specifications shall conform to the requirements of Sections 626 and 627 of the Mississippi State Highway Department Standards for Road and Bridge Construction, 2017 Edition (Red Book). The Public Works Department will be responsible for preparing streets by sweeping and cleaning. Public Works will remove any temporary tape / markings. The contractor shall provide proper placement of warning devices, necessary for the protection of both parties, meeting and exceeding the regulations of the Manual of Uniform Traffic Control Devices and the Mississippi Standard Road and Bridge Contractor’s Manual. Work to begin within two weeks upon notification by the City with weather permitting. General Bidder Requirements 1. All bids must be submitted on the bid form.
