1 REGULAR CITY COUNCIL MEETING MUNICIPAL MINUTES CITY OF TUPELO STATE OF MISSISSIPPI APRIL 2, 2024 Be it remembered that a regular meeting of the Tupelo City Council was held in the Council Chambers in the City Hall building on Tuesday, April 2, 2024, at 6:00 p.m. with the following in attendance: Council Members Chad Mims, Lynn Bryan, Travis Beard, Nettie Davis and Rosie Jones; Ben Logan, City Attorney and Missy Shelton, Clerk of the Council. Council Member Janet Gaston joined the meeting by phone. Council Member Buddy Palmer was absent. Council Member Travis Beard gave the invocation, and Council Member Lynn Bryan led the pledge of allegiance. Council President Travis Beard called the meeting to order at 6:00 p.m. CONFIRMATION OR AMENDMENT TO THE AGENDA AND AGENDA ORDER Council Member Davis moved, seconded by Council Member Bryan, to approve the agenda and agenda order, as presented. Of those present, the vote was unanimous in favor. IN THE MATTER OF PROCLAMATION FOR NATIONAL JUNIOR AUXILIARY WEEK Mayor Todd Jordan presented a proclamation proclaiming the week of April 7-14, 2024 as National Junior Auxiliary Week. Ginger Harbour and Amy Fagan accepted the proclamation. APPENDIX A PUBLIC RECOGNITION Council Member Nettie Davis said she hoped everyone had a Happy Easter. Council Member Chad Mims invited everyone to attend the upcoming Tupelo Show Choir Home Show. The event is scheduled for 6:00 p.m. on April 5, 6 and 7, 2024. MAYOR'S REMARKS Mayor Todd Jordan told everyone that the Child Abuse Prevention Awareness event is scheduled for Wednesday afternoon in Fairpark and Bud and Burgers is planned for Friday beginning at 5:30. STATE OF THE CITY Mayor Jordan offered highlights of his State of the City address for 2023. A copy of the full document is attached to these minutes as APPENDIX B. CITIZEN HEARING  2 A request to speak form was received by the Council Clerk on Wednesday, March 27. However, the request was diverted to the junk folder and wasn’t brought to light in time to be placed on the agenda. Council Member Bryan moved, seconded by Council Member Mims, to suspend the rules and allow Athen Walton to speak on behalf of his mother Paula Coleman. Of those present, the vote was unanimous in favor. He spoke concerning the danger of pit bulls in the neighborhood. IN THE MATTER OF MINUTES OF MARCH 19, 2024 COUNCIL MEETING Council Member Bryan moved, seconded by Council Member Davis, to approve the minutes of the March 19, 2024, City Council meeting. Of those present, the vote was unanimous in favor. IN THE MATTER OF BILL PAY Bills were reviewed at 4:30 p.m. by Council Members Travis Beard and Nettie Davis. Council Member Bryan moved, seconded by Council Member Davis, to approve the payment of the checks, bills, claims and utility adjustments. Of those present, the vote was unanimous in favor. APPENDIX C IN THE MATTER OF BUDGET AMENDMENT #6 FOR FY 2024 Council Member Bryan moved, seconded by Council Member Davis, to approve budget amendment #6 for FY 2024. Of those present, the vote was unanimous in favor. APPENDIX D IN THE MATTER OF SURPLUS FIXED ASSETS FOR AUCTION – BUDGET & ACCOUNTING Council Member Davis moved, seconded by Council Member Mims, to approve the surplus items for auction, no longer needed for use by the City of Tupelo as follows: Asset 6262 2006 Crown Vic Vin 2FAFP74V26X122556 $22,672.00 Of those present, the vote was unanimous in favor. APPENDIX E IN THE MATTER OF APPROVAL TO SUBMIT FOR LAND AND WATER CONSERVATION FUND GRANT FOR BALLARD PARK LAKE AND APPROVE MAYOR TO SIGN GOVERNING RESOLUTION Grant Writer Abby Christian addressed the Council requesting approval for the submission of ‘Land and Water Conservation Fund (LWCF) Grant’ for Ballard Park Lake and to authorize the Mayor to sign the documents. The grant amount is to be determined, but will be a maximum of $400,000. The City’s match is 50%. Council Member Bryan moved, seconded by Council Member Jones, to approve the submission of the grant. Of those present, the vote was unanimous in favor. APPENDIX F IN THE MATTER OF DEVELOPMENT CODE AMENDMENT – MULTIFAMILY Council Member Davis moved, seconded by Council Member Jones, to take a portion of this amendment code of the table. Of those present, the vote was unanimous in favor. APPENDIX H IN THE MATTER OF APPROVAL OF CONTRACT FOR BID 2024-007PW – MCCULLOUGH BLVD IMPROVEMENTS Bid # 2024-007PW – McCullough Blvd Improvements was awarded at the March 19, 2024, Council meeting. Council Member Davis moved, seconded by Council Member Jones, to approve the contract for this project to Phillips Contracting Co., Inc. in the amount of $387,039.00. APPENDIX I IN THE MATTER OF AWARD OF BID NO 2024-009PW - WARD 7 LAWNDALE LPA SIDEWALK IMPROVEMENTS AND TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE CONTRACT SUBJECT TO SUBSEQUENT RATIFICATION BY THE CITY COUNCIL The City advertised and accepted bids for Bid #2024-009PW – Ward 7 Lawndale LPA Sidewalk Improvements. Two bids were received with the lowest and best bid being from J.M. Duncan, Inc. in the amount of $219,316.00. Council Member Jones moved, seconded by Council Member Bryan, to award the bid to J.M. Duncan Inc. and to authorize the Mayor and City Clerk to execute the contract subject to subsequent ratification by the City Council. Of those present, the vote was unanimous in favor. APPENDIX J IN THE MATTER OF APPROVAL OF MAJOR THOROUGHFARE COMMITTEE MEETING MINUTES OF FEBRUARY 12, 2024 Council Member Davis moved, seconded by Council Member Bryan, to accept the minutes of the Major Thoroughfare Committee meeting held on February 12, 2024. Of those present, the vote was unanimous in favor. APPENDIX K IN THE MATTER OF APPROVAL OF ACCEPTANCE OF FUNDS FROM TUPELO SPORTS COUNCIL Council Member Mims moved, seconded by Council Member Bryan, to accept the donation of $4,885.00 to be used for the purchase of synthetic turf material for the baseball complex from the Tupelo Sports Council. APPENDIX N IN THE MATTER OF BID AWARD FOR GUMTREE AND HANCOCK PARK PAVILION ADDITIONS - BID #2024-006PR The City advertised and accepted bids for Bid #2024-006PR – Gumtree and Hancock Park Pavilion Additions. One bid was received from M & N Construction LLC in the amount of $1,225,800.00. Council Member Palmer moved, seconded by Council Member Gaston, to find that the single bid is responsive and commercially reasonable and to award the bid to M & N Construction LLC. APPENDIX Q IN THE MATTER OF RESOLUTION DETERMINING THE NECESSITY FOR AND INVOKING THE AUTHORITY GRANTED TO MUNICIPALITIES BY THE LEGISLATURE WITH RESPECT TO TAX INCREMENT FINANCING; DETERMINING THAT THE TAX INCREMENT FINANCING PLAN, TUPELO COMMONS PROJECT, TUPELO, MISSISSIPPI, FEBRUARY 2004 OF THE CITY (THE “2004 TIF PLAN”), AS AMENDED AND RESTATED BY THE TAX INCREMENT FINANCING PLAN, TUPELO COMMONS PROJECT, TUPELO,  5 MISSISSIPPI, FEBRUARY 2004, AS AMENDED AND RESTATED APRIL 2024 (THE “AMENDED AND RESTATED TIF PLAN”) PROPOSES A PROJECT THAT IS ELIGIBLE FOR TAX INCREMENT FINANCING UNDER THE LAWS OF THE STATE; AUTHORIZING AND APPROVING THE AMENDED AND RESTATED TIF PLAN FOR THE PURPOSES AS PROVIDED HEREIN; AUTHORIZING AND APPROVING THAT A PUBLIC HEARING BE CONDUCTED IN CONNECTION WITH THE AMENDED AND RESTATED TIF PLAN; AND FOR RELATED PURPOSES City Attorney Ben Logan explained that the 2004 Tupelo Commons TIF project is set to expire on May 1, 2024 when the final payment on the Series 2009 TIF bonds is made. The developer intends to perform additional work on the public improvements within the TIF district before dedicating them to the city. Amendment and Restatement of the TIF plan is necessary to accomplish these objectives. Council Member Bryan moved, seconded by Council Member Davis, to approve the Resolution stating this intent and approving the conduct of a public hearing concerning amending and restating the TIF plan. Of those present, the vote was unanimous in favor. APPENDIX R IN THE MATTER OF APPROVAL OF CONTRACT WITH GOODWYN MILLS CAWOOD FOR CONSULTATION ON THE CITY OF TUPELO 2025-2040 COMPREHENSIVE PLAN UPDATE – PHASE I Council Member Bryan moved, seconded by Council Member Jones, to approve a contract with Goodwin Mills Cawood for consultation on the City of Tupelo 2025-2040 comprehensive plan update – Phase I. This contract is in the amount of $80,000.00 and will be completed in FY 2024. Of those present, the vote was unanimous in favor. APPENDIX S IN THE MATTER OF APPROVAL OF CONTRACT WITH GOODWYN MILLS CAWOOD FOR CONSULTATION ON THE CITY OF TUPELO 2025-2040 COMPREHENSIVE PLAN UPDATE – PHASE II Council Member Davis moved, seconded by Council Member Bryan, to approve a contract with Goodwin Mills Cawood for consultation on the City of Tupelo 2025-2040 comprehensive plan update – Phase II. This contract is in the amount of $95,000.00 and will be completed in FY 2025. Of those present, the vote was unanimous in favor. I am pleased to report that despite economic uncertainty nationally, the City of Tupelo remains a thriving and vibrant community. The State of the City is strong, and 2023 proved to be a solid year of growth. By every measurable standard, the City of Tupelo is robust economically and continues to offer an excellent quality of life for our citizens and visitors. Tupelo’s tax base continues to grow, up more than five percent from FY 2022. Our bond rating continues to be one of the strongest in the state at an Aa2. Sales tax receipts for FY 2023 rose 3.96 percent from the prior year, an almost $1 million increase. Tourism tax receipts increased almost 13 percent, or $723,458. And we reduced our bond debt by $2.7 million in FY 2023. The excess revenue over expenditures for 2023 was $3,614,022. Below please see highlights of 2023 from the city departments. Tupelo Police Department The Tupelo Police Department established a real time intelligence command center. This center allows the TPD to actively monitor license plate readers, city owned cameras, privately owned cameras, gunshot detectors and body worn cameras. Other 2023 highlights included: • The TPD hosted a church safety and security forum. One hundred participants attended this event. • In coordination with the Police Athletic League (PAL), the TPD hosted the following youth events: gun violence forum, drug awareness forum, ACT preparatory seminar, digital media editing class, and several 5th quarter events following home high school football games. • TPD received the 2023 Mississippi Municipal League’s Public Safety award. • TPD Special Weapons and Tactics (SWAT) team was awarded first place in the 2023 Mississippi Tactical Officers Association’s annual competition. The TPD SWAT team competed against thirty other SWAT teams. • Deputy Chief Anthony Hill received the 2023 Mississippi Department of Public Safety’s Law Enforcement Officer of the Year and the 2023 National Association of the Advancement of Colored People (NAACP) Law Enforcement Special Recognition Award. Chief John Quaka received the 2023 Alpha Kappa Alpha Sorority’s Community Service Award. • Criminal Investigative Division (CID) implemented the use of facial recognition software and of technology (Greykey) that is capable of unlocking and retrieving data on a cellular telephone. • In 2023, the North Mississippi Narcotics Unit (NMNU) targeted dealers of Fentanyl. The unit seized thousands of Fentanyl pills in our community. • The TPD initiated 29 safety check points to curb gun violence in the City of Tupelo and certified eight officers in Crisis Intervention (CI). • The TPD Patrol Division responded to 79,758 calls of service from Lee County 911 in 2023. APPENDIX B  11 Tupelo Fire Department The Tupelo Fire Department filled key positions in the Command Staff to better align for future requirements and ensure improved functional areas of emphasis and completed a Career Development Plan to ensure all TFD personnel have a roadmap for their professional growth within the department and ensure TFD is prepared with a future succession plan that has strong leaders ready to step into key positions. Other highlights included: • Throughout the ranks of the TFD, a total of 25 members received a promotion to a higher level of responsibility in 2023. • TFD responded to 5,359 emergency calls in 2023: an approximate 3% increase in call volume over 2022. This past year has been the busiest call volume so far for TFD. • SPRINT Program in service for 9 months to assist in major medical incidents and saving wear and tear on Truck 1, also finalized the SPRINT Emergency Operating Guidelines (EOG). • TFD Fire Marshalls, conducted and/or facilitated yearly business inspections along with the Stations in each territory, and completed over 250 company inspections. • TFD Fire Marshalls, conducted and approved over 230 Certificates of Occupancy to allow new businesses to open and operate in the City of Tupelo. • Annual Fire Protection outreach events/presentations reached approximately 15,500 members of the public ranging from pre-school members to citizens aged 65 and above. Development Services The City of Tupelo’s Development Service Department had $152,887,316 in total new valuations permitted. In 2023, Development Services staff led planning and collaboration efforts to ensure the continuation of these trends. Amongst these efforts, 2023 saw the commencement of Comprehensive Plan 2040. This plan will serve as Tupelo’s roadmap for growth and development spanning the next 15 years. In 2023, 28 new commercial permits were issued, totaling an assessed valuation of $27,162,223. Additionally, 98 commercial remodel permits were issued, totaling an investment of $72,927,154. While there was a decline in new commercial projects, 2023 saw a surge in commercial renovations. The construction of new single-family residential homes has remained consistent. In total, the construction of 157 new single-family residential homes were permitted in 2023 with an assessed valuation totaling $42,730,468. Additionally, 91 single-family residential renovation permits were issued totaling an investment of $4,373,240. Development Services staff managed a successful Redistricting Process, resulting in City Council adoption of an updated City Ward Map. The updated Ward Map reflects 2020 Census data ensuring that city voting districts align with the current population distribution and maintain a fair and representative electoral system. APPENDIX B  12 Tupelo Convention and Visitors Bureau The Tupelo Convention and Visitors Bureau received $1,687,978 in ARPA (American Rescue Plan Act of 2021) funds for tourism recovery to be used in marketing Tupelo as a destination. Tupelo’s plans included replacing marketing funds in our regular budget through 2026 with ARPA funds and re-allocating those regular budget funds to destination development. The Tupelo Convention and Visitors Bureau finished FY ’23 with a 12.88% increase in tax revenue collecting $6.3 million. That equates to $315 million spent in hotels and restaurants for the year. In FY ’23, the bureau’s public relations efforts garnered 1.1 billion impressions with 48 articles generated in publications like U.S. News and World Report, National Geographic, Architectural Digest and Garden & Gun through desk-side visits, proactive pitching, and hosting writers. The Tupelo CVB invested $1.3 million in the development of a new pickleball facility with 12 outdoor courts making it the largest pickleball facility in the state. The Tupelo CVB committed $1.3 million for a new event venue called The Depot in Downtown Tupelo. The facility will be used for the Farmer’s Market, as a food truck lot and will be available for public and private events. The Mississippi Tourism Association bestowed Tupelo with state-wide awards recognizing: • Hotel Tupelo as the best hotel in the state • CHANGE Festival as the best small festival in the state • Hotel Tupelo PR Strategy as the best PR Strategy in the state • Ethel Mae’s as the best restaurant in the state Downtown Tupelo Main Street Association 2023 Private Dollars Invested in Downtown Tupelo Overlay: $15,703,966 2023 Public Dollars Invested in Downtown Tupelo Overlay: $4,058,598 2023 Business Openings in Downtown Tupelo Overlay: 20 2023 New Construction (commercial and residential/Fairpark) in Downtown Tupelo Overlay: 8 total Cadence Bank Arena and Conference Center After the COVID rebound year of 2022, Cadence Bank Arena and Conference Center returned to its historical average number and variety of arena events while showing growth in the conference sector due to the expansion of the conference center supported by a strong marketing campaign. Among the events hosted in 2023 were: APPENDIX B  13 • 12 concerts • 2 rodeos • 2 cheerleading/gymnastics competitions • 12 family shows/sport events • Mississippi State Men’s Basketball Game • Elvis Festival, Blue Suede Cruise, Truckin’ The Trace, Steak Competition • Public Ice Skating • 24 State, 6 Regional & 4 National Conferences Tupelo Water and Light • Completion of the street lighting upgrade on McCullough Boulevard • Completion of the Hwy 45 Sewer Outfall Line (ARPA Project) Tupelo Public Works Here are some of Tupelo Public Works Highlights for the past year: Capital Paving Improvements – $4.55 million Major Thoroughfare Paving Improvements - $1.04 million Right-of-Way Crew Highlights Tree Farm Maintenance 124 Hours ROW Sidemowing 232 Hours Bushhogging ROW/City Lots 836 Hours Litter Pickup of ROW 110 Hours Turf Spraying 280 Hours Turf Mowing 887 Hours Mowing Code Enforcement Lots 80 Hours Concrete spraying Downtown 100 Hours Pressure Washing Downtown 560 Hours Edging curbs 616 Hours Sweepers Street Sweeper routes, Downtown, Metro area, turn lanes, Gum Tree route, Elvis Presley Birthplace, parade route, Call-ins Signs Installed 520 new signs Repaired/Cleaned/Pulled 113 signs and/or posts Replaced 282 signs Replaced 196 sets of blade signs Traffic Control Traffic control was provided: Message Boards, Cones, Barricades, Temporary Signs, and Barrels APPENDIX B  14 Tupelo Parks and Recreation • In 2022/23 Tupelo Parks and Recreation, Aquatic Center, and the Oren Dunn Museum received a total of 2 Awards of Excellence from Mississippi Recreation and Park Association. • During 2022/23 over 310,000 people visited, attended, or participated in our programs/parks as well as rented our facilities. • We put on 14 Community Events in 2022/23 (This includes Park and Rec, Museum, and Aquatic Center). • We ran or hosted 50 athletic events in 2022/23 which generated over 5.0 million dollars of economic contributions to the city. Aquatic Center • In 2022/23 the Economic Contributions of the Aquatic Center was estimated around $730,000. • The center generated income of over $272,000 in 2022/23 (from regular programing, memberships, sponsorships, and birthday parties). • In 2022/23 over 56,000 people either visited, attended, or participated in programs/events, or tournaments at the Aquatic Center. • In 2022/23 the Aquatic Center staff gave 1,575 free swim lessons during our Little Ripples program. • Since 2014, the Aquatic Center has generated over $7.4 million dollars in economic contributions to the City of Tupelo. Oren Dunn City Museum • Attendance for 2022/23 – around 5,000 visitors. • In 2022/23 the Museum put on 10 special exhibits. • The Museum also put on or ran 36 programs/community events. (Ex. Dudie Burger Festival, Fossil and Mineral Show) Tupelo Municipal Court • Successfully transferred away from docket books for a savings of $2,250 per year. • Started with American Municipal Services for court collections, collecting $3,139 through December 2023. • Work Program along with Project Solutions collected 3,081 bags of trash, cleaned 165 roads multiple times, recycled 178 pounds of aluminum with a return to the city of $811.04, and cleaned up 11 homeless encampments. This project includes the construction of new sidewalks and related improvements along Mitchell Road from Lawndale to Green St. and adjacent areas to provide a pedestrian connection between existing apartments /residential areas to Lawndale Elementary School. As represented on the attached tabulation of bids, two (2) bids were received for this project that ranged from $219,316.00 - $247,778.10 for this project. The low bid was from J.M. Duncan, Inc. The bid was reviewed based on the bidding criteria established for the Project and it appears that the proper proposal documentation was submitted as required by the Contract Documents. The pre-bid estimate for the project was $240,415.00. Thus, it is our recommendation that the City award this contract in the amount of $219,316.00 to J.M. Duncan, Inc. for the referenced project, and authorize the Mayor to execute the contract per the conditions set forth in the Contact Documents for this project.
