shall not consist of any personal attacks. Members of the public are expected to maintain a professional,
courteous decorum during their comments. There is a time limitation of three minutes per person. If you haven’t
already done so, please fill out name and address slips and give them to the Planning Commission Secretary.
The Planning Commission is prohibited by the Brown Act (State law) from taking action or discussing at length

Minutes
CALL TO ORDER-Chair Krushat called the meeting to order at 5:00 p.m.
Pledge of Allegiance- Chair Krushat led the Pledge of Allegiance.
Roll Call-The following Commissioners were present: Cure, Garcia, Paahana, Walker, Krushat.

PUBLIC COMMENTS
Alice Lawson, Twentynine Palms commented regarding homelessness.
Veno Nathraj, Twentynine Palms said the City of Twentynine Palms should attract tourism and suggested we outsource to
consultants that are familiar with bringing in tourism.
COMMISSION COMMENTS AND REPORTS OF MEETINGS ATTENDED
Commissioner Paahana wished everyone a Happy New Year 2024. She said she attended the last City Council meeting
where Fire Chief Munsey gave a great presentation on FP5. Commissioner Paahana said she attended the march
honoring Martin Luther King Jr., she thanked the Ministerial Association for organizing it.
Vice Chair Walker said he attended the last City Council meeting of 2023 which was quite interesting.
Chair Krushat said he attended some committee meetings with the Historical Society and the Kiwanis. Welcome to 2024!
He added, this is not an easy job and we try to make the right decisions for the community as a whole. He said he
appreciates fellow Commissioners and staff and is looking forward to a great year.
CONSENT CALENDAR

ACTION: A motion was made by Commissioner Paahana, seconded by Vice Chair Walker, to approve the
consent calendar as submitted.

2. CUP23-000006 a Conditional Use Permit for the establishment of a small beer manufacturer and brewhouse/
brewpub located at 73565 Twentynine Palms Highway
That the Planning Commission conduct the Public Hearing, consider public comment, find the project exempt
from CEQA, adopt the Planning Commission Resolution, and approve the Conditional Use Permit and a finding
of Public Convenience or Necessity, subject to the attached Conditions of Approval.
Community Development Director Gardner announced that Planning Technician Shelley Green give the
presentation.
Planning Technician Green presented the staff report to the Commission.
Chair Krushat opened the Public Hearing.
Veno Nathraj, Twentynine Palms spoke in favor of the item.
Mike Usher, applicant 29 Beer Company LLC spoke in favor of his project.
Chair Krushat closed the Public Hearing.
The Commissioner had a brief discussion of the item.
ACTION: A motion was made by Commissioner Paahana, seconded by Commissioner Cure to find the project
exempt from CEQA, adopt Planning Commission Resolution No. 24-01 and approve the Conditional Use
Permit and a finding of Public Convenience or Necessity, subject to the attached Conditions of Approval.

Director Gardner announced approval of an Administrative Use permit for King Buzzard Tattoo.

3. Housing and Homeless Committee
Updates on previous decisions
Director Gardner said that the mobile showers are on hold. Pastor Mike Maddie is not able to maintain the
showers and has suggested another church that might be interested.

Director Gardner said the Navigation center is also on hold because the proposed location is no longer
available for rent and has been up for sale. Morongo Basin Arch is looking for a new location.
4. Homeless and Housing presentation
Committee Member Andrea Keller gave a presentation on Project Homekey, Adaptive Reuse and new build.
5. Home Revitalization Program
Committee Member Cure gave a presentation on a Home Revitalization program.

BACKGROUND:
The City received a request from NV5 to vacate that portion of Foothill Drive which lies between Bullion
Avenue and Split Rock Avenue. Diagrams of this vacation on the subject property are attached.
This action is an ancillary application to the Reset Hotel project, which, as of the time of this staff report,
is currently under construction. This action would legally connect otherwise discontiguous parcels
owned by the proprietors of the Reset Hotel.
This portion of Foothill Drive is not specifically identified on the General Plan as larger than a local street
(60' Right of Way), therefore, it will not affect the City's Circulation Element.
In its current condition, Foothill Drive does not physically exist at this location, and does not serve any
residences or businesses. Bullion Avenue serves the Public Works Department and Animal Control.
Their operations will not be affected by the removal of Foothill Drive at this location.

The Planning Commission has the authority of these actions pursuant to California Government Code
No. 65402 and Section 19.04.040 of the Development Code.

RESOLUTION NO. 24-XX
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TWENTYNINE PALMS, CALIFORNIA, RECOMMENDING THE CITY COUNCIL
APPROVE VER23-000001, A REQUEST FOR VACATION OF FOOTHILL
AVENUE STREET RIGHT OF WAY BETWEEN BULLION AVENUE AND
SPLIT ROCK AVENUE LOCATED IN THE CITY OF TWENTYNINE PALMS
WHEREAS, on November 21, 2023, an application was received from Vickie Bridenstine
with NV5, Inc. and Wander Hotel JT LLC, requesting the vacation of street right of way of
Foothill Avenue between Bullion Avenue and Split Rock Avenue; and
WHEREAS, the Circulation Element of the General Plan designates this section of
Foothill Drive as a Local Street; and
WHEREAS, no residences, businesses, or city government agency functions will be
affected by this action; and
WHEREAS, this request is ancillary to the Reset Hotel (formerly Wander Hotel) which
had a Mitigated Negative Declaration adopted in November of 2021 and is, therefore,
Categorically Exempt from further environmental review; and
WHEREAS, the Planning Commission finds on the basis of the whole record before it
(including the review of CEQA requirements and any comments received) that there is no
substantial evidence that the project will have a significant effect on the environment and that this
determination reflects the Planning Commission’s independent judgment and analysis: and
WHEREAS, the project is consistent with the Circulation Element of the General Plan
and allapplicable General Plan policies; and
WHEREAS, the street vacation will not negatively impact surrounding properties; and,
WHEREAS, Public Hearing notice for VER23-000001, a Street Vacation was published in
the Desert Trail, a newspaper of record, on January 24, 2024; and
WHEREAS, a Public Hearing was held by the Planning Commission on February 6,
2024, at which time the Commission adopted Planning Commission Resolution No. 24-XX,
recommending that the City Council approve VER23-000001, a vacation of Foothill Drive
between Bullion Avenue and Split Rock Avenue within the City of Twentynine Palms; and

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Twentynine
Palms adopts Planning Commission Resolution No. 24-XX and in so recommends that the City
Council approval of VER23-0001, based up on the finding that the request is consistent with the
General Plan.
