ORDER OF PROCEDURE: ATTACHMENTS: Request Staff Report Commission Question of Staff • Housing Element Annual Request Public Comment Progress Report Commission Discussion Motion/Second Discussion of Motion Call the Question BACKGROUND: Pursuant to State Government Code Section 65400, an annual progress report on the progress towards meeting the goals of the adopted Housing Element is required. This annual report, once approved by the Planning Commission and the City Council, will ultimately be submitted to the State Office of Planning Research and the California Department of Housing and Community Development. This report is meant to give detailed information regarding building permit activity. This includes both planning and building permit applications for housing developments, the type of housing, and the expected income of the future residents. The attachment to this report is the form provided by the State department of housing and Community Development and is standard throughout the State. This report shows the City's progress in meeting the goals set by the State for the Regional Housing Needs Assessment (RHNA). According to the analysis in the form provided by the state, we have 13 residential units in process at this time in both the Planning and Building Department application stage. A total of 27 residential units were constructed last year. A total of 989 more residential units are needed to be constructed by 2029 in order for the City to meet the RHNA goals. ORDER OF PROCEDURE: Request Staff Report Commission Questions of Staff Open the Public Hearing Receive Public Comment Close the Public Hearing Commission Discussion Motion/Second Discussion on Motion Call the Question BACKGROUND: Staff is frequently approached by potential applicants with ideas for campgrounds that are not traditional. In particular, the term “glamping” has been used to describe activities that would include non-permanent structures for temporary habitation – primarily tents. Additionally, other structures that have been presented to staff in the past have included such things as boats, cabooses, rail cars, planes, and large passenger vehicles such as RVs or vans. Currently, City regulations list camping and RV parks under the same section of the development code with the same development standards. The Planning Commission held public hearings on September 19th, 2023, and November 07, 2023, to discuss the regulations for Special Occupancy Parks. In the prior Planning Commission discussions, Staff was presented with a potential State law (SB620) would allow or prescribe for the permitting of commercial campgrounds on a local level. Upon further research from our legal team, it has been discovered that this proposed bill is not up for consideration in this legislative session. Therefore, Staff has not included this information in our recommendations to the Planning Commission. The direction from the Commission was to separate regulations for Recreational Vehicle Parks and campgrounds and to research the regulations of other municipalities. Staff and the City Attorney's office have conducted the research and have found no other jurisdictions that have regulations for private commercial campgrounds of this nature. Several other jurisdictions have similar regulations to Twentynine Palms with regards to RV parks. Page 7 of 26 Chafee County, Colorado is the only jurisdiction that Staff has found so far that allows for commercial campgrounds on private lands. Their regulations have very low densities of use, only one tent for every five acres. To Staff’s knowledge, campgrounds are primarily developed and managed by Federal, State or County agencies. The Commission discussed the matrix below at the meeting of November 7th and added the items highlighted in red. In particular, the “dry” or “primitive” camping category that does not have sanitary or access to water services is not desirable within the City limits. Based upon the research conducted and further review of the standards and proposed permitting processes, together with community feedback, it is staff's recommendation that commercial campgrounds not be allowed within the City limits and that the Development Code be amended to allow only Recreational Vehicle Parks within the Tourist Commercial and Public zoning districts. Alternatively, if the Planning Commission wishes to allow for commercial campgrounds, Staff would recommend that they be located only in the CT (commercial tourist) and P (public) zones with a conditional use permit. It is the opinion of Staff that these types of activities are not appropriate in residential zones. ORDER OF PROCEDURE: ATTACHMENTS: Request Staff Report Commission Questions of Staff • Vacation Home Rental Request Public Comment Violations Database Commission Discussion Motion/Second Discussion of Motion • Violation Charts Call the Question • VHR Violation Matrix BACKGROUND: On May 24, 2022, the City Council approved Ordinance No. 299 which was the amendment to the Development Code Chapter 19.41 Vacation Home Rental. The City Staff has followed the direction of the City Council and has kept a database for Vacation Home Rental Violations to understand any trends or needs that may arise. The City Code Enforcement Department has created a database with information that has been provided by multiple sources. The Building and Safety Department, the Citizenserve Code Enforcement Online Compliance Portal and Southwest Security Services, the City's weekend complaint response unit, has helped to establish a database listing all currently approved Vacation Home Rental with their violations and dispositions. The City has a total of 439 Vacation Home Rental permits issued to date, and 10 Vacation home rental permits pending out of the 500 allowed by City code. While number of permits has declined over time, the Code Enforcement Department continues to receive complaints on a weekly basis. The creation of a database has shown that there are areas of concerns which may require further amendments to the Development Code. The complaints received range from noise, night sky ordinance violations, number of vehicles, trash receptacles, unpermitted short-term rentals, illegal campgrounds and signage. The Code Enforcement Department investigates each complaint to ensure they are legitimate, actionable and verifiable. These complaints must have complete details, including timelines and, when possible, photos or videos of the issue at hand; the reporting party is interviewed to ensure they understand the appropriate procedures in reporting the complaints. Questions such as did they contact the 24-Hour Contact number on the sign? Was there a response? Did they call the City code compliance number (if the disturbance occurred during normal business hours), the Southwest Security Page 9 of 26 Compliance Number or the Sherriff's department? After careful investigation, the Code Enforcement Department contacts the property owner to discuss the concern to try to find a resolution to the matter at hand. Some property owners have installed decibel readers, cameras and other monitoring systems at their properties where multiple noise complaints have been reported, so that they can provide evidence to Code Enforcement as to the reality on the ground. The Code Enforcement Department has reviewed all the Vacation Home Rental violations to establish the database and have included the spreadsheet, and charts to visually show the areas of concern or common trends amongst the violations. There are two (2) types of violations: Buidling and Safety and Code Enforcement. Each one has a specific process to achieve compliance and guidelines to bring the property up to code. The charts attached shows the City has received 183 Code Enforcement complaints and 53 Building and Safety referrals. It has been identified from the 183 complaints there are several which are submitted by the same person on the same day multiple times making the numbers inflated. The Building and Safety referrals are primarily from the safety inspections which are due every three (3) years upon renewal. The Inspectors come across a number of unpermitted improvements and modifications that have taken place after the initial approval. The top three complaint types are noise (parties, people in pools and music), Red Tags (unpermitted conversions and modifications), Unpermitted improvements (cowboy pools, spas, mini splits, etc.). These violation types are found during the Safety Inspections and/or come in as resident complaints. The charts also show the resolutions for the concerns received. The totals are: 37% non-actionable, 31% no violation, 25% unverifiable and 7% result in citations. Some residents have been clear on their opposition to Vacation Home Rentals in the City, and at times resolve to submit complaints to hinder the Vacation Home Rentals or skew complaint numbers. The Code Enforcement Department has worked with both residents and Vacation Home Rentals property owners to separate the perceived negative impacts from the real issues. The Code enforcement Department has found that most of the residents and property owners, when educated on what constitutes a violation, are able to report accordingly and able to maintain the property in compliance. Educating the public about the process of submitting a concern, what is an actual violation, who to contact based on the concern and how to be a responsible property owner helps create an accurate database. The creation of this database helps the City's official understand the needs and issues which enables them to create effective policy that supports the trends/changes in the community. The matrix of Vacation Home Rental License Violations and Punishments (attached) has been created to address the most common concerns and the proposed outcomes for the violations based on their severity and where the responsibility lies. It should be understood that the issuance of the Vacation Home Rental License can be obtained by providing all the requirements documentation and it requires the property owner to comply with all Codes. The approval of the license requires the property owner to maintain compliance throughout the term of the license and the failure to do so may have consequences ranging from administrative citations up to the revocation of their Vacation Home Rental license. ENVIRONMENTAL: None ALTERNATIVES: The Planning Commission may request additional information to be added to the current database.
