Twin Valley City Council Minutes | November 2024 | Page 1 TUESDAY, NOVEMBER 12, 2024 – TWIN VALLEY CITY COUNCIL REGULAR MONTHLY MEETING Twin Valley Community Center – 7:00 PM MEMBERS: Mark Askelson, Paul Bekkerus, Michael Bolton, Tracy Christianson, Mike Lampton OTHERS: Harold Allrich, Kerry Askelson, Prestin Douville, Ben Fall, Toni Nysetvold, Jess Riepe, Matt Wagner PURSUANT DUE TO CALL and notice thereof the Twin Valley City Council held its regular monthly meeting on Tuesday, November 12, 2024. Mayor Bolton called the meeting to order at 7:00PM. MONTHLY BUSINESS Minutes—TC/ML-m/s/p to approve the minutes for October as written. Disbursements—MA/ML-m/s/p to approve the disbursements totaling $706,439.90. A full copy of claims and payroll disbursements is available at the Clerk’s office. SEWER PROJECT—Received payment request #3 from Selling Brothers for a total of $791,983.36. MA/ML-m/s/p to approve payment. No update from engineers. Askelson informed Council that all in town work should be completed, with the exception of some seeding which will be done in the spring. New pumps and electrical panel for the lift station are not expected to arrive until December. COMMUNITY—TC/ML-m/s/p to approve demolition incentive request for $1,000 from Brent Solseng for the removal of the dilapidated house at 408 Herold Ct S. ML/PB-m/s/p to approve $100 donation to the Twin Valley Community Booster Club for holiday events, Askelson abstained. LIQUOR—October gross sales $53,311.91, ATM revenue $542.50. Nysetvold requested Council approval to hire Dylan Moothart as a part-time bartender. PB/ML-m/s/p to approve pending a background check. Brief discussion on how background checks will be completed without an officer, Johnson has reached out to Sheriff Fall to see if the County can be of assistance, waiting on confirmation. Nysetvold updated Council on previous and upcoming events happening at the TVLS. Was an issue with a $2 pull-tab jar behind the bar, a check for the underage was written to the American Legion to correct, Nysetvold has spoke with her bartenders about this issue. Discussion on children in the bar after 8PM, Nysetvold will address with bartenders again. PUBLIC WORKS—City received an easement request from the Dollar General to run water and sewer lines through City property to connect to the main. Motion by Councilmember Askelson, second by Councilmember Bekkerus to approve utility easement as requested. With all councilmembers voting in the affirmative the following resolution was adopted. RESOLUTION 2024—17 GRANTING UTILITY EASEMENT TO DGOGTWINVALLEYMN03132024, LLC FOR THE PURPOSE OF WATER AND SEWER LINE INSTALLATION AND OPERATION WHEREAS, the City is the owner of real property in Twin Valley described as Lot 3, Block 1, Herold’s Addition; and WHEREAS, DGOGTWINVALLEYMN03132024,LLC has requested the following easement A 15.00-FOOT-WIDE EASEMENT FOR THE PURPOSES OF A SANITARY SEWER LINE BEING 7.50 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE LOCATED IN LOT 3, BLOCK 1 OF HEROLD'S ADDITION TO THE CITY OF TWIN VALLEY, NORMAN COUNTY, MINNESOTA: COMMENCING FROM THE NORTHEAST CORNER OF LOT 4; THENCE N87°28'24"W, ASSUMED BEARING, ALONG THE NORTH LINE OF SAID BLOCK 1 A DISTANCE OF 233.47 FEET TO THE POINT OF BEGINNING; THENCE S0l034'43"W A DISTANCE OF 263.04 FEET TO THE NORTH LINE OF THE 20 FOOT UTILITY AND DRAINAGE EASEMENT AS PLATTED ON HEROLD'S ADDITION TO THE CITY OF TWIN VALLEY, THERE TERMINATING. SAID TRACT OF LAND CONTAINS ±3,946 SQUARE FEET, MORE OR LESS, AND IS SUBJECT TO EASEMENTS AND RIGHTS OF WAY OF RECORD. 1 Twin Valley City Council Minutes | November 2024 | Page 2 THEREFORE, BE IT RESOLVED, by the Twin Valley City Council that said easement request is accepted and granted, with a full copy of the easement available for review in the City Clerk’s Office. Upon a roll call vote taken thereon the following voted in favor of said resolution: Mark Askelson, Paul Bekkerus, Tracy Christianson, & Mike Lampton; Michael Bolton abstained from vote, and the following voted against: None. WHEREUPON said resolution was duly adopted this 12th day of November, 2024. ___________________________________________________ _____________________________________________________ RACHEL JOHNSON, CLERK-TREASURER MICHAEL BOLTON, MAYOR Discussed having an online auction to sell some older City equipment, including a snow plow and the 2014 squad vehicle. ML/TC-m/s/p to have Kerry prepare a listing of items that can be sold and start the auction process. EDA/PARKS—There has been some recent vandalism at Heiberg Park, including damage to playground equipment and a porta potty. Hopes are that the County can patrol this area under a contract with the City in the future to hopefully minimize this. Discussed the $10,000 Joseph Urdahl grant the EDA/Parks received in 2022 to go towards the moving of the skating rink. No liner has been purchased or placed at this time. Clerk asked to review grant funds and any applicable disbursements the City has made in the meantime. A reimbursement to the fund may be necessary. POLICE—Sheriff Fall and Chief Deputy Wagner distributed a draft law enforcement services agreement to the Council. Fall paged through the contract with the Council highlighting important information. Reviewed the scope of services, payment, term, and responsibilities. The proposed agreement is for 40 hours of coverage weekly for two years, to begin January 1, 2025 with the option to review the contract after the first year. Proposed payment would be $159,265.60 in 2025 and $166,432.55 in 2026. Discussed currently inventory at the police department office. It was requested that admin staff take account for what the City currently possesses, what will remain with the City, and what will be transferred to the Sheriff’s department upon acceptance of contract. Bolton inquired to whether any members of the Council had any current questions or concerns and if all members were in favor of the agreement in hand. All Councilmembers vocalized agreement. It was requested that the Council be given a couple weeks to review the contract in full and ask any questions or concerns with the agreement to the sheriff’s department before formal acceptance. Council agreed to allow Sheriff’s Department to take 2023 Dodge squad vehicle immediately to begin equipping as needed. Final discussion on services agreement is set for December 2nd. The POST board has reached out to the City requesting that the Council formally either disband or make inactive the Twin Valley Police Department. Council in agreement that in moving forward with a contract with the Sheriff’s Department the City would disband. PB/TC-m/s/p to disband the Twin Valley Police Department. FIRE/RESCUE— Lampton reported 2 fire and 15 rescue calls for the last month. An application for a volunteer to the rescue squad as been received and given to the Sheriff’s Department to complete a background check. Elections for 2025 have been held for the Fire Department—Pete Pazdernik has been elected Fire Chief. MA/PB- m/s/p to approve this appointment. Still working on FEMA grant for equipment. FINANCE—Statement of Accounts for October 31, 2024 distributed to Council. No questions or comments. ELECTION RESULTS—The results for the 2024 General election for City Offices have been received. Motion by Councilmember Askelson, second by Councilmember Lampton to accept the results, acting as the canvassing board and certify the results. RESOLUTION 2024—18 A RESOLUTION TO CERTIFY RESULTS OF THE TUESDAY, NOVEMBER 5, 2024 GENERAL ELECTION (CANVASSING OF THE GENERAL ELECTION RESULTS) WHEREAS, the City of Twin Valley held a Municipal Election for the office of Mayor and three Council Members on Tuesday, November 5, 2024, during the General Election. Upon a roll call vote the following members voted in favor: Mark Askelson, Paul Bekkerus, Michael Bolton, Tracy Christianson, Mike Lampton and the following voted against the same: None. WHEREUPON, said resolution was duly adopted this 12th day of November, 2024. ___________________________________________________ ___________________________________________________ RACHEL JOHNSON, CLERK-TREASURER MICHAEL BOLTON, MAYOR Council given a model ordinance created by the Minnesota Office of Cannabis Management for the regulation of cannabis business to review as well as a copy of the ordinance up for adoption for Norman County. Discussed if the City would delegate the authority to Norman County or not. TC/PB-m/s/p to table discussion on the adoption of a new ordinance to regulate cannabis business in the City of Twin Valley for a future meeting. TC/ML-m/s/p (Bekkerus opposing) to approve two off-site gambling requests—American Legion to host pull-tabs during the Moonshiner membership supper 11/23/2024 and T.I.P to host pull-tabs/raffles during the Wild Rice Conservation Club supper 01/25/2025. A special meeting to discuss the law enforcement services agreement and review the budget for 2025 was called for Monday, December 3, 2024 at 5:30PM.
