CALL TO ORDER II. INVOCATION III. PLEDGE OF ALLEGIANCE IV. PUBLIC COMMENTS: Comments are limited to three (3) minutes. Please state your name & address. Comments that require a response may not be answered during this time. The Council or staff may respond at a later date. Mayor Dial announced that anyone in attendance who wished to speak regarding items 4 and 5 should comment during the public hearing section. V. APPROVAL OF AGENDA Mayor Dial stated that item number 6 should read Section 4-72(a), not 4-74(a). A motion was made to approve the agenda with the change. Motion made by Council Member Furr, Seconded by Council Member Campbell. Voting Yea: Council Member Whelan, Council Member Hunter. VI. CONSENT AGENDA: All matters listed under this item are considered to be routine by the Town Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. 1. Approval of meeting minutes from May 2, 2024. 2. Approval of project PW-2024-27, the 2024 Pavement Inspection Services project, and award FirstStep Management Techniques, LLC for $5,950.00. PRESENTATIONS 3. Presentation of a proclamation in recognition of May 19 - 25, 2024 as National Public Works Week. Eric Dial, Mayor Mayor Dial read the proclamation. He added that Council was proud of their Public Works team, and they were very grateful for their hard work. VIII. PUBLIC HEARINGS 4. Consideration of a rezoning petition from applicant Clarendon Place, LLC to rezone a 32.949-acre tract with parcel number 0738-156 from C-1 (Community Commercial) to TCMU (Town Center Mixed-Use). Phillip Trocquet, Community Development Mr. Trocquet informed everyone that applicant Clarendon Place, LLC had requested the item be tabled. Staff would readvertise. A motion was made to table the rezoning petition from applicant Clarendon Place, LLC for a 32.949-acre tract with parcel number 0738-156 until the July 18th meeting. Motion made by Council Member Campbell, Seconded by Council Member Hunter. Voting Yea: Council Member Whelan Voting Abstaining: Council Member Furr. 5. Consideration of a rezoning petition from applicant Clarendon Place, LLC to rezone a 21.887-acre tract with parcel number 0738-158 from AR (Agricultural Residential) to TCMU (Town Center Mixed-Use). A motion was made to table the rezoning petition from applicant Clarendon Place, LLC to rezone a 21.887-acre tract with parcel number 0738-158 until the July 18th meeting. Motion made by Council Member Campbell, Seconded by Council Member Whelan. Voting Yea: Council Member Hunter. Voting Abstaining: Council Member Furr. IX. OLD BUSINESS X. NEW BUSINESS 6. Consideration of a revision to Section 4-72(a) of the Town's Code of Ordinances pertaining to public hearings for alcohol license applications. Dee Baker, Town Clerk Ms. Baker stated that the item was to consider removing language in the alcohol ordinance that stated that a request for an alcohol license could only be heard at the first regular meeting of the month. She added that the process took at least 4 weeks including advertising and legal review. One hearing a month limited the time frame for the applicant. A motion was made to revise Section 4-72(a) of the Alcohol Ordinance pertaining to public hearings for alcohol licenses. Motion made by Council Member Whelan, Seconded by Council Member Campbell. Voting Yea: Council Member Furr, Council Member Hunter. XI. PUBLIC COMMENTS: The second public comment period is for any issue. Comments are limited to three (3) minutes. Mr. Christopher Marosy who lives on Alison Way spoke regarding the tabled public hearing items. He understood that mixed-use was approved in 2017. He stated that the “lose use zoning” was too close to his home, who was winning? The proposed development was not good for anyone. He believed that no one in the area wanted the “lose use zoning”, or high or medium density. He asked Council to reevaluate and to consider what was happening in Fairburn. It all began with a Chick-fil-A, a Waffle House, and a BP. We do not want that type of growth; we need to look at zoning that was approved in the past with good intentions. We do not want fast growth, who would be the winner? He posed, do the developers live in Tyrone? When we bring in a lot of people, we have increased crime and traffic. XII. STAFF COMMENTS Ms. Baker informed everyone that tomorrow was the last day for early voting for the May 21st General Primary. Voting was from 9 a.m. to 5 p.m. Early voting was at 945 Senoia Rd. She added that Election Day was next Tuesday from 7 a.m. to 7 p.m. and voters would vote at their precincts according to their voter registration cards or MyVoterPage.com Mr. Langford stated that paving in the Laurelwood area was slated to begin next week which included Laurelwood, Laurel Lake, Ridge Road, Strawberry Lane, Foxford, and the area by the railroad tracks at Senoia Road and Tyrone Road. XIII. COUNCIL COMMENTS  Council Member Hunter asked for prayers for Lt. Philip Nelson as he was recovering. Mayor Dial recognized Ms. Edith McGuire Duvall who was in attendance. She was a Gold Medal winner of the 1965 Tokyo Olympics and won two Silver Medals for the 100 and 400-meter relay. XIV. EXECUTIVE SESSION A motion was made to approve the Executive Session minutes from May 2, 2024. Motion made by Council Member Campbell, Seconded by Council Member Furr. Voting Yea: Council Member Whelan, Council Member Hunter. XV. ADJOURNMENT A motion was made to adjourn. The meeting adjourned at 7:19 p.m. Motion made by Council Member Campbell.
