Tyrone Town Council Meeting Minutes Thursday March 16, 2017 7:00 PM Present: Mayor Eric Dial Mayor Pro Tem Furr Council Member Ken Matthews Council Member Ryan Housley Council Member Linda Howard Town Manager Kyle Hood Town Clerk Dee Baker Town Attorney Dennis Davenport Mayor Dial called the meeting to order. Mayor Dial performed the Invocation; it was followed by the Pledge of Allegiance. Public Comments Public Comments Approval of Agenda Council Member Matthews made a motion to approve the agenda. Council Member Housley seconded the motion. Motion was approved 4-0. Consent Agenda: All matters listed under this item are considered to be routine by the Town Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. Approval of minutes, March 2, 2017 Consideration to approve the contract for CSRA Probation Services, Inc. Kathy Bright, Court Clerk Council Member Howard made a motion to approve the consent agenda. Council Member Housley seconded the motion. Motion was approved 4-0. Old Business: New Business: Page 1 of 4 1. Consideration for the Sandy Creek Jazz Band to use Shamrock Park on April 27 th for “Jazz in the Park.” Jazz Band Representative Council Member Matthews made a motion to approve the use of Shamrock Park on April 27, 2017 for Jazz in the Park. Council Member Housley seconded the motion. Motion was approved 4-0. 2. Consideration to approve Resolution No. 2017-03 to appoint Alisha Thompson as the Prosecuting Attorney of the Municipal Court. Kathy Bright, Court Clerk Ms. Bright stated that former Prosecuting Attorney Adam Shoemaker has resigned and Alisha Thompson has since performed the duties as Solicitor. Ms. Bright recommended approval to appoint Alisha Thompson as the Tyrone Prosecuting Attorney and added that upon approval all appropriate paperwork would be filled. She ended by informing Council that Judge Pierce would perform the oath. Council Member Furr made a motion to approve the Resolution appointing Alisha Thompson as the Prosecuting Attorney through December 31, 2017. Council Member Matthews seconded the motion. Motion was approved 4-0. 3. Consideration to move forward with the execution of an Intergovernmental Agreement with Fulton County Board of Commissioners for the purchase of .4MGD waste water treatment capacity. Kyle Hood, Town Manager Mr. Hood brought to Council the final draft copy of the Intergovernmental Agreement with Fulton County for additional waste water treatment capacity with a few minor changes approved by the legal department. He added that the agreement was approved unanimously by Fulton County on March 15th. The agreement asks for an upfront, capital commitment of $1.700,100.79 for the reservation of 400,000 gallons per day (.4MGD) of treatment capacity from the Camp Creek reclamation facility. Mayor Dial asked for the cost difference between acquiring capacity from Peachtree City in relation to Fulton County. Mr. Hood stated that connecting to Peachtree City would have cost over $2MM in construction costs plus any necessary capital commitments for the capacity, while Fulton County is asking $1,700,000 with no additional construction costs. Council Member Housley made a motion to approve the IGA with Fulton County Board of Commissioners for the purchase of .4MGD waste water treatment capacity. Council Member Matthews seconded the motion. Motion was approved 3-1. Council Member Furr in opposition. Page 2 of 4 Public Comments Staff Comments Mr. Hood stated that last year Council amended the Winfair Road, pipe replacement and resurfacing LMIG project to include additional items. One item not included due to time constraints was the turn lane from Tyrone Road onto Highway 74. This item was bid out separately due to the state requiring some modifications to the red light signaling system. He stated that the time has come to award the bid to begin the project. He recommended approval of the contract to the low bidder with Town-requested changes. Council Member Matthews made a motion to approve the award to low bidder McCoy Grading Inc in the amount not to exceed $231,080.00 and to authorize the Town Engineer to issue a Notice of Award and for the Town Attorney to draft a contract. Council Member Furr seconded the motion. Motion was approved 4-0. Mr. Hood stated that the project should commence upon procurement of materials and two minor land acquisitions. Ms. Baker recognized and thanked Mr. Hood for his service and tasked Mayor and Council with finding another Town Manager as well-versed, forward thinking and open as he. Mr. John Woody, former Fayette County Development Authority Representative, thanked Mr. Hood and stated that for the four years that he worked with Mr. Hood, he found him to be a most capable, cheerful and helpful individual and he made his life easier. Council Comments Council Member Housley stated on behalf of Council he would like to thank Mr. Hood for making the Town significantly better and as Ms. Baker stated, if we can find someone half as good as Mr. Hood we will be ok. Executive Session Council Member Matthews made a motion to move into Executive Session for 2 items for real- estate acquisition. Council Member Housley seconded the motion. Motion was approved 4-0.
