Tyrone Town Council Meeting Minutes October 5, 2017 Present: Mayor Eric Dial Mayor Pro Tem Gloria Furr Council Member Ken Matthews Council Member Linda Howard Town Manager Jonathan Lynn Police Chief Brandon Perkins Planning & Development Coordinator Phillip Trocquet Town Clerk Dee Baker Council Member Ryan Housley was absent Mayor Dial called the meeting to order and Mr. Dial (Mayor Dial’s Father) gave the Invocation which was followed by the Pledge of Allegiance. Public Comments Approval of Agenda Council Member Furr made a motion to approve the agenda. Council Member Howard seconded the motion. Motion was approved 3-0. Consent Agenda: All matters listed under this item are considered to be routine by the Town Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. Approval of minutes, September 21, 2017 Council Member Matthews made a motion to approve the consent agenda. Council Member Howard seconded the motion. Motion was approved 3-0. Page 1 of 4 Public Hearing: 1. Consideration of a request from applicant John Temple to rezone a 2.58 acre property located at address 1445 Senoia Road, Tyrone GA with parcel number 072604004. The request is to rezone the property from C-1 (Downtown Commercial) to C-2 (Highway Commercial). Phillip Trocquet, Planning & Development Coordinator Mr. Trocquet introduced the item and stated that the applicant, John Temple had applied for the rezoning at 1445 Senoia Road from C-1 Downtown Commercial, to C-2 Highway Commercial. He added that the property which was formally a gym; abuts the Millbrook Village subdivision on the west side with a rear seventy-five foot buffer. Mr. Trocquet stated that he informed the applicant that there could be no outdoor storage and that the future zoning would be compatible with the future land use and zoning ordinance. He stated that Planning Commission voted 2-1 approval with Mr. Nebergall in opposition. His concern was for what may be placed there in the future; staff recommended approval. Council Member Furr asked for clarification on “auto storage”. Mr. Trocquet stated that classic/exotic cars would be stored there. Mayor Dial asked for clarification regarding the buffer. Mr. Trocquet explained that the seventy-five foot buffer was made up of dense woods that should remain undisturbed. Mayor Dial made the point that the tenant could not have a drive way located in the back of the building. Mr. Trocquet concurred. Council Member Furr asked for clarification on “mechanical work” verbiage. He stated that the applicant stated that no work would be performed; however in C-2 light mechanical work is allowed, inside only. A discussion took place regarding the Powers Court business park. Mr. Trocquet stated that the business park does have more of a light industrial feel; however, there are certain conditions that are currently not being followed and should be reported to the Code Enforcement Officer as a high-priority. Mayor Dial clarified that in the past, the Town made a decision to allow something that was thought to be a similar use. The company worked on racing engines that cause loud noises which neighbors have to now deal with. Mr. Trocquet stated that the property was unique in that there was no provision for buffers when that property was zoned years ago. Mayor Dial opened the Public Hearing and asked if anyone was in support of the item. Mr. Temple stated that he was from Fayetteville, and the extent of work being performed within the building; the cars would be dusted and waxed. Many people have several nice cars and have no place to store them. My establishment will be a nice place to store, with limited signage outside for security purposes. Tom Fulton from Peachtree City spoke. He stated that he was Mr. Temple’s Real Estate agent and that this business would have little traffic and would be a positive addition to the neighborhood. Page 2 of 4 Mayor Dial asked if anyone wished to speak in opposition of the item. No one spoke. Mayor Dial stated that the issue with the aforementioned business was due to sub-leasing a space. He asked the applicant if he had any foresight of renting part of the space in the future. Mr. Temple stated that due to the nature of what was being stored, he would not want any other business within the building. Mayor Dial asked Mr. Temple how can we be assured that if within five years he had a major turn-over he would not decide to sell the building to someone more obtrusive. Mr. Temple assured Mayor Dial that he was in the business for the long haul; and may want or have the need to expand. Council Member Furr made a motion to approve the rezoning of 1445 Senoia Road from C-1 Downtown Commercial to C-2 Highway Commercial. Council Member Howard seconded the motion. Motion was approved 3-0. Public Comments Staff Comments Mr. Lynn stated that staff had received two bids for the Request for Proposal (RFP) for Sanitation Services and that he should have them ready for review by the next meeting. He added that the RFP requested for costs including the Town performing the sanitation billing and also the cost for the contractor to assume billing duties. He added that staff was also in the process of hiring an Office Coordinator; formerly, Administrative Assistant position at Town Hall. We will not be reviewing applications until October 16th. It has been posted for two weeks on the Town’s website and Facebook page and on the Georgia Municipal Association’s website. He stated lastly, that Tyrone’s Recreation Department was recognized by the State as the top Recreation Department in the Region. Mr. Bowman will attend a banquet on October 18th to receive the top award in our class. Mayor Dial stated that it is well deserved. Council Comments Council Member Furr asked Chief Perkins if tires were still located on the corner property located at Arrowood Road and Spencer Lane. Chief Perkins stated that the tires were still on the overgrown property. Chief Perkins explained that the perpetrator from dumping on said property went to jail in Clayton County for dumping a much larger amount. We were anticipating restitution; however our case died due to the severity of the Clayton County charges. Chief Perkins stated that he was to assume that there were currently approximately 400 tires on the property. He was never informed that they were disposed of properly. Council Member Matthews stated that the Hobgood family has indicated that they have not had the tires removed. Page 3 of 4 Council Member Furr asked if there were any measures the Town could take to have them removed. Chief Perkins stated that staff could contact the Code Enforcement Officer to have the Hobgoods remove the tires. The Hobgoods are however, the victim in this case. Council Member Furr stated that there are other properties in Town that have tires and the Town is asking them to clean up, everyone should be treated the same. We should ask the Hobgoods as well. Mr. Lynn stated that staff would start the process. Mayor Dial thanked the Founders Day Committee and all volunteers regarding the Festivities that have already taken place. He stated that he has heard good news regarding the festivities on Saturday. Sunday had a more diverse group this year with five different church groups performing at Shamrock Park and Jazz in the park was on Monday and the Lego Batman movie was played at Shamrock Park on Tuesday. Council Member Howard stated Saturday’s attendance was three times as large as last year. Executive Session Council Member Furr made a motion to move into Executive Session to review the Executive Session minutes from August 17, 2017. Council Member Matthews seconded the motion. Motion was approved 3-0. Council Member Matthews made a motion to reconvene. Council Member Howard seconded the motion. Council Member Matthews made a motion to approve the August 17, 2017 Executive Session minutes with one aforementioned revision. Council Member Howard seconded the motion. Motion was approved 3-0. Adjournment Council Member Matthews made a motion to adjourn. Motion was approved 3-0.
