Public Comments
Mr. Tracy Young who lives on Magnolia Drive congratulated Mayor Dial, Council Member
Howard and Council Member Elect, Melissa Hill for their win. His reason for speaking was in
regards to burning leaves in neighborhoods. He stated that his neighbor had been burning all day
and that there should be an ordinance against it. He added that leaves do not burn they smolder.
He added that his wife had asthma and the Town should consider restrict burning leaves.
Approval of Agenda
Council Member Matthews made a motion to approve the agenda.
Council Member Housley seconded the motion. Motion was approved 4-0.
Consent Agenda: All matters listed under this item are considered to be routine by the Town
Council and will be enacted by one motion. There will not be separate discussion of these items.
If discussion is desired, that item will be removed from the consent agenda and will be considered
separately.
Approval of minutes, November 21, 2019
Council Member Housley made a motion to approve the consent agenda.
Council Member Howard seconded the motion. Motion was approved 4-0.

New Business:
1. Consideration to adopt the updated noise ordinance. Brandon Perkins, Town Manager
Mr. Perkins informed Council that the current noise ordinance was approved in 1983 with very
little, if any, changes. The ordinance also only addressed residential zoning districts. He added that
it was his experience that when citizens complained, the current ordinance could not provide any
power for action. He stated that he researched several options and found that the current Fayette
County noise ordinance best matched our needs and was more robust. If adopted, the new
ordinance would also require the Town to purchase a couple of decibel meters which cost
approximately $100 each. The new ordinance would also include a decibel chart for different
zoning districts. Occasionally residential areas abut commercial or industrial zoning districts. Mr.
Perkins shared that officers would need to be properly trained on the decibel meter. He stated that
Federal law regarding fireworks had recently gone through some changes. He explained that
during certain holidays fireworks were permitted within reason. If fireworks were used during non-
holiday times, the decibel meter would be an asset. Discussion ensued regarding calibration.
Mayor Dial suggested that Council remain flexible if the ordinance was approved in case
amendments needed to be made. Mayor Dial informed everyone that dogs were also listed in the
new ordinance. Mr. Perkins stated that aircraft and most farm animals were not included as a source
for complaint.
Council Member Furr made a motion to approve the updated noise ordinance.
Council Member Housley seconded the motion. Motion was approved 4-0.
2. Consideration to approve the Guaranteed Maximum Price (GMP) of the new municipal
complex. Brandon Perkins, Town Manager
Mr. Perkins stated that after meeting with Goodwyn, Mills, and Cawood and Parrish Construction
regarding the guaranteed maximum price for the municipal complex, the cost fluctuated between
$5 million and $4.5 million. He stated that several options were presented and changes were made
including the addition of a $5,000 HVAC component. The final cost that was agreed upon was not
to exceed $4,396,529. He added that after approval, the notice to proceed would be sent. The set
price states that any additional costs, not initially approved by the Town, would fall directly on the
Construction Manager at Risk.
Council Member Housley made a motion to approve the Guaranteed Maximum Price of the new
municipal complex not to exceed $4,396,529.
Council Member Howard seconded the motion. Motion was approved 4-0.

Mayor Dial shared that Council did everything they could to get the cost as low as possible without
compromising the integrity of the building. He thanked Mr. Perkins for his hard work and for
having the same mindset as Council regarding the project.
3. Consideration to amend the FY 2018/19 Budget. Sandy Beach, Finance Manager
Ms. Beach stated that the auditors had finished their review and it was that time of year for small
adjustments to be made. She explained that by law each department was not allowed to exceed
their budgets. She added that a few unforeseen items such as the land for the new complex and
police radios were not initially in the budget. She reminded Council that the police radios had been
purchased early for a cheaper price. She stated that another adjustment was the Briarwood Road
paving project. The project took longer than was anticipated and ran into the new budget year.
Items such as these require an annual adjustment. She recommended approval of the submitted
amendments.
Council Member Howard made a motion to accept the Journal Entry as presented for the Fiscal
Year 2018/2019 Budget.
Council Member Matthews seconded the motion. Motion was approved 4-0.
Staff Comments
Mr. Perkins announced that the anticipated marking of silt fencing, set-up of equipment, and
location of an office trailer for the new Town Hall Complex would be next Monday. He added that
a few trees may need to be removed and potentially dirt would be moved by January 2nd.
Mr. Perkins also announced that downtown sewer preconstruction would begin on January 20 th.
Executive Session
Council Member Matthews made a motion to move into Executive Session to review the Executive
Session minutes from November 21, 2019.
Council Member Furr seconded the motion. Motion was approved 4-0.

Council Member Howard seconded the motion. Motion was approved 4-0.
