AN ORDINANCE AMENDING CHAPTER 334, RENT 17 CONTROL TO PROVIDE FOR SUCCESSION RIGHTS OF FAMILY 18 MEMBER TO REMAIN IN RENT CONTROLLED APARTMENTS 19 UNDER CERTAIN CONDITIONS.) 20 21 MS. ROSARIO: Second item on the agenda 22 is two ordinances for introduction. Adoption on 23 first reading authorizes the Municipal Clerk to 24 advertise the ordinance with a notice of the 25 introduction, together with a notice of the time  8 1 and place when the ordinance will be considered 2 for final passage. The ordinance will be further 3 considered at a meeting of the Board of 4 Commissioners to be held on Tuesday, October 18, 5 2022, at the William V. Musto Cultural Center, 420 6 15th Street. 7 First ordinance, an ordinance amending 8 Chapter 334, rent control to provide for 9 succession rights of family member to remain in 10 rent controlled apartments under certain 11 conditions. 12 MAYOR STACK: So this is a really 13 important ordinance. This ordinance basically if 14 you had -- we had a couple in the City that there 15 was a boyfriend and girlfriend that lived in an 16 apartment together from the beginning. And they 17 were in the apartment 30 years. The girlfriend 18 passed away, they lived in common law. 19 The girlfriend passed away and they 20 tried to evict the boyfriend after being in the 21 apartment 30 or 31 years at the time, I forget the 22 exact circumstances. And they had been together 23 all that time, even longer than that, before they 24 moved into the apartment together. And there 25 should have been succession rights.  9 1 This is a case we had to argue through 2 the court system, it's only fair. Not only did he 3 lose his partner and his -- the love of his life, 4 he then had to fight, at 78 years old, being 5 disabled, to stay in that apartment. That's 6 something that just should not be, it should not 7 be. In my view, in a sense of justice, that's 8 just not the way we should be treating people. 9 So hopefully, this ordinance will clear 10 that up. I'm more than happy to move it. 11 MS. They would be portable traffic 4 lights that we would be able to put in the 5 intersection. 6 This isn't an original idea of mine or 7 anything, I saw it in another municipality in 8 Bergen County and I actually saw it in another 9 municipality and I thought it was a great idea. 10 They're just very, very expensive. You can see 11 it's $98,000, but we have a capital ordinance 12 we're taking this from of money we've had set 13 aside. But I think this is something when it 14 comes to public safety, you can't put a value on 15 that, especially in a densely populated city like 16 Union City, with the number of children we have 17 going to stool and number of residents we have out 18 there. When a traffic signal is down, it's a big 19 deal. I just came down 27th and Kennedy and there 20 was a traffic signal on flash. As soon as we see 21 something like that, we call it out to get it 22 repaired because you just never know, somebody's 23 crossing the street, somebody comes too far out, 24 you can have a major accident on your hands and a 25 fatality. It will provide 5 additional parking spaces and it will also provide 6 a seating area for residents to go. 7 This is something that the Commissioners 8 and I, all of us, have worked on to really make 9 this a reality. We do have 13 two matters. One is resolved and this was on at 14 the last meeting, we had proposed a suspension on 15 Maria Mentiras Bar and Grill located at 328 32nd 16 Street. Today, we've reached a resolution on this 17 matter where it would be a 45 day suspension, 15 18 of those days would be held in abeyance, but there 19 would be a 30 day straight suspension that would 20 be required. 21 The reason we're proposing this is 22 because by accepting the plea, we don't have to 23 have all the police officers come in and give 24 testimony. I have Lieutenant Dunlay here, who's 25 been instrumental in understanding what happened  39 1 at this location and Sergeant Zeron, who's also 2 been working on this particular file, as all the 3 files. 4 But at this time, it's my understanding 5 that they wish to accept that and they are 6 represented by Anna Noris. 7 MS. NORIS: I have a had an opportunity 8 to speak to my client, as well as the ABC 9 prosecutor. We are going to be accepting the 10 recommendation. My client, though, however, would 11 like to be heard by the Board if she can make a 12 statement. 13 MAYOR STACK: Absolutely. 14 MS. NORIS: Thank you. 15 MR. I 6 just want to make sure that you guys understand 7 that we did not let it escalate because they were 8 not drunk. I have the receipts and, you know, we 9 keep notes of what happened every night. And they 10 had good meals that night, both parties, party A 11 and party B, they all ate. There was no bottle 12 service, nothing like that. 13 It was an ego matter that it could 14 happen at church, that it's not just because of 15 the alcohol. The aggravation, they said things. 16 On their own, they left the place and they got 17 into a fight outside. Obviously, I understand it 18 started at the premises. But it's the first time 19 actually we have a violence event. And I 20 understand that I didn't have my license with me 21 that day and that's also not following the rules, 22 but 30 days is a lot. So I don't know if maybe, 23 there's a chance, a possibility. I know I 24 shouldn't even be standing up here, I couldn't 25 make it last time because I was out of the  41 1 country. But I'm just begging right now. I know 2 it's -- it's a completely different matter. We 3 resolved the other and I know you're looking at me 4 again like really you again, I understand, but 5 it's completely different. 6 The other one was noise, neighbors, and 7 all of that. This is the first time we have 8 violence event that it wasn't -- I'm not going to 9 say it wasn't violent because I don't want to say 10 it. But it didn't escalate because we don't 11 over -- we don't get people drunk there. It's 12 very family oriented. We don't want a place where 13 people go get wasted. People come here to eat, 14 they like the food. It's just an ego where it can 15 happen even here. 16 So it's not about the alcohol, that's 17 what I'm saying. The situation, it was something 18 from the past because the husband and the wife, 19 they -- 20 MAYOR STACK: Who called the police that 21 night? 22 MS. GUTIERREZ: I don't know, it wasn't 23 us because they went outside. As I read the 24 report, I don't remember because I didn't have 25 time to read it again today.  42 1 MAYOR STACK: But nobody from the 2 establishment knew that they were outside, that 3 there was an issue? 4 MS. GUTIERREZ: Yeah, yeah, but the 5 three -- it was a party of three and a party of 6 two. So the party of three left first. And as 7 they were leaving, he called out the party of two 8 to come fight him outside. So they actually went 9 out and I went out and I told the party of two, 10 "it's not worth it, you have family, you have 11 kids", because they're regulars in the restaurant, 12 "it's not worth it to get in trouble. You do 13 something to that person, you're going to go to 14 jail, so think of your family." 15 I even addressed them and they told me, 16 the wife told me that he approached them to say 17 something about her and he got pissed. So, you 18 know, it's an ego think about men that they want 19 to defend their women. So if they -- and they can 20 correct me if I'm wrong, they saw blood on a 21 person as they were walking and they asked them 22 where they were coming from and they said Maria 23 Mentiras, right, that's what happened? 24 MAYOR STACK: But you saw the fight take 25 place?  43 1 MS. GUTIERREZ: Inside, I didn't see. 2 MAYOR STACK: No outside. 3 MS. GUTIERREZ: Yeah, yeah, that's when 4 I came out. 5 MAYOR STACK: But why wouldn't you, 6 Maria, have called the police? 7 MS. GUTIERREZ: Because when I came out 8 and I told him, "stop, it's not worth it", the 9 other three left. And that's when the police came 10 because they left when I came out to approach my 11 customer, that is always there with his wife, 12 saying "it's not worth it." The three individuals 13 they can see from the door, the three are calling 14 the party of two. And the wife is holding him 15 back. And I'm telling him, "don't, let them go, 16 it's just words. What are words going to do to 17 you." He gets up and he still goes outside. I go 18 out, and I'm telling him that it's not worth it -- 19 MAYOR STACK: But at the point that they 20 left your establishment, somebody should have just 21 contacted Union City Police, maybe it could have 22 been avoided, the whole thing. Say, look, I'm the 23 owner, I'm the manager of the restaurant, I need 24 to -- I have a couple going outside, they look 25 like they're going to begin a fight right now. I  44 1 mean it would have been pretty simple. 2 MS. GUTIERREZ: No, because if they did 3 fight in front of me, like while I was outside, I 4 was just holding him, so he wouldn't go after the 5 three that had already left. And when I was 6 holding him -- 7 MAYOR STACK: But at that point, when 8 you were trying to talk to him, why didn't 9 somebody just call Union City Police? 10 MS. GUTIERREZ: Because we were holding 11 him. And then they came while we were holding 12 him. 13 MAYOR STACK: Lieutenant, Sergeant, do 14 you have any comment on this? 15 LIEUTENANT DUNLAY: Yes, sir, I'm sorry. 16 Ms. Gutierrez is being in fact truthful. She 17 saying that the incident did escalate outside, 18 however it did occur inside. So there's a level 19 of fault that the licensed establishment needs to 20 take is that some type of scuffle, verbal 21 argument, whatever you want to call it, did take 22 place inside the establishment. 23 At that point, it's your duty and 24 responsibility to either completely separate them, 25 take action, or notify us the police department,  45 1 which did not happen. When the police responded 2 to the location and wanted to inquire further, 3 further investigate the matter -- 4 MAYOR STACK: Where did the call come 5 from? 6 LIEUTENANT DUNLAY: I think it was an 7 officer driving by, sir. 8 MAYOR STACK: An officer driving by. 9 What about if somebody got shot, somebody got 10 stabbed? That's the issue here. 11 LIEUTENANT DUNLAY: When the officers 12 went to try to investigate further, the 13 establishment wasn't very truthful in the matter 14 initially. When the initial -- 15 MAYOR STACK: What do you mean not 16 truthful, in what way? 17 LIEUTENANT DUNLAY: "Oh, nothing 18 happened here, nothing happened here." 19 MS. GUTIERREZ: No. I'm sorry, but the 20 same thing that I'm telling you is what I told 21 them. That they said, oh, so nothing happened in 22 here, it was only, you know, like words. 23 MAYOR STACK: Maria, you're in business 24 long enough to know, you pick up the phone and you 25 call us. We take that into consideration every  46 1 single time. 2 MS. GUTIERREZ: I understand -- I was to 3 say your Honor. Mr. Stack, I understand that. 4 But by the time the police came, I was still 5 outside with the gentleman so he wouldn't -- 6 MAYOR STACK: But the manager, somebody 7 inside call. You're not a bouncer, you're not 8 going to go out there -- what effect are you going 9 to have on that fight? What if they pulled out a 10 knife or a gun and you were in harms way? 11 I mean I'll go with a 25 day suspension, 12 that's it. You got to call the police department, 13 25 days. 14 MR.
