AN ORDINANCE AMENDING CHAPTER 334, RENT 9 CONTROL TO PROVIDE FOR SUCCESSION RIGHTS OF FAMILY 10 MEMBER TO REMAIN IN RENT CONTROLLED APARTMENTS 11 UNDER CERTAIN CONDITIONS.) 12 13 MS. ROSARIO: There are two ordinances 14 for adoption. The first ordinance for hearing and 15 adoption is an ordinance amending Chapter 334 rent 16 control to provide for succession rights of family 17 members to remain in rent controlled apartments 18 under certain conditions. 19 MAYOR STACK: This ordinance basically 20 would allow -- we've had this situation happen 21 before. We had a couple that lived in the City, 22 they lived together for many, many years in an 23 apartment on 36th Street and several others in the 24 City that were living together for 18, 19 years. 25 In one case, we had a couple living together  15 1 almost 30 years and the woman died -- they didn't 2 get married over those years, they lived together 3 in common law. And she didn't get married, they 4 decided not to get married for whatever reason. 5 And the landlord tried to come in, after knowing 6 that they were both occupants in the apartment, 7 and tried to evict the gentleman who was living 8 there with her. 9 We've had issues also in the City where 10 you had a husband and wife legally married under 11 the law, and the husband passed away, wife passed 12 away, and they tried to evict them in a rent 13 controlled building. This will clear that up and 14 give them succession rights to the apartment. 15 This is not giving a free pass to 16 anyone, but just giving somebody rights that 17 first, in a case that I was personally involved 18 in, the gentleman lost the woman, they were 19 together for 30 years. Then losing her, whether 20 they were married or not, losing her was 21 devastating to him. And then he had to face 22 eviction. And we were successful in keeping him 23 in the unit, but it took a lot of work in the 24 court system by the City attorneys to keep him in 25 the apartment. AN ORDINANCE AMENDING CHAPTER 4, ARTICLE XIII, 19 SECTION 65, TO UPDATE THE TABLE OF ORGANIZATION 20 FOR THE UNION CITY POLICE DEPARTMENT TO ADD POLICE 21 OFFICERS POSITIONS.) 22 23 MS. ROSARIO: The second ordinance is an 24 ordinance amending Chapter 4, Article XIII, 25 Section 65, to update the table of organization  18 1 for the Union City Police Department to add police 2 officers positions. 3 MAYOR STACK: So this ordinance would 4 add several positions to the police department 5 police officers. It would eliminate the rank of 6 an inspector. The inspector position is between 7 the chief and a captain, that would eliminate that 8 position. Instead of having three captains, we'll 9 go to four captains, but eliminating the one rank 10 of inspector, which we felt wasn't needed at this 11 time. 12 This will allow a captain to be working 13 seven days a week in the City. It's not adding 14 any additional supervisor except the rank of a 15 captain and eliminating the rank of an inspector. 16 Anyone wishing to comment on this 17 ordinance at this time, please step forward, state 18 your name and address for record. ROSARIO: Yeah, sure. 12 MAYOR STACK: Anyone wishing to comment 13 at this time, please step forward, state your name 14 and address for the record. 15 I would also like to thank the 16 Commissioners for moving 100 percent of our 17 meetings throughout the community. We moved them 18 to each neighborhood of the community on a 19 rotating basis. They're always held in the 20 evening hours and it's something we've continued 21 to do. So I'd like to thank the Commissioners for 22 keeping this philosophy of keeping municipal 23 government transparent, keep it accessible to 24 everyone throughout the community. But 12 before I do, I want to commend the Mayor. I think 13 I speak on behalf -- in all honesty, I think I 14 speak on behalf of the Commissioners, thank you 15 for the incredible job you're doing in the 16 infrastructure of our City. Union City has never 17 been more beautiful, more together than ever. 18 Having grown up in Union City, it's 19 turned into a hugely beautiful City. I want to 20 mention Peter Street alone, because Peter Street 21 is an example of how you've taken a blighted area, 22 an area that was really dark and ugly and it's 23 turned that area beautiful, it added 28 parking 24 spaces, it added a dog run, a passive area for the 25 residents to sit in an area that we didn't have  22 1 anything like that. And I really have to commend 2 you. This is -- you know, I think I speak on 3 behalf of all of us. 4 COMMISSIONER VALDIVIA: Especially the 5 parking it created. 6 COMMISSIONER FERNANDEZ: It's 7 beautifying an area that was blighted. And your 8 vision to do that is just unbelievable, so thank 9 you. 10 MAYOR STACK: Thank you, Commissioners. 11 Thank you, Lucio. 12 MS. We 6 suspected it was going to be a hearing, we did not 7 reach a resolution at the last meeting that we had 8 outside of the -- at the police department at the 9 record room. 10 But this afternoon probably around 5:00, 11 I received a call from Steven Cocci, who has been 12 retained by The Hub and was seeking an adjournment 13 on this matter. I think it's appropriate that we 14 give him the adjournment. I think we can resolve 15 this with Mr. Cocci without the need to have a 16 trial. 17 MAYOR STACK: Okay, perfect.
