That will add to the several 24 thousand trees we planted already and probably 25 10,000 more trees that we need to do.  17 1 On the other one, the road surfacing 2 programs, that’s various roads; 15th Street, 3 Bergenline to Kennedy Boulevard. These, too, 4 will be brand new sidewalks, decorate street 5 lighting, tree planting, road paving, some speed 6 bumps -- especially around the school area. 7 Similar to what we did on New York Avenue, these 8 projects will be -- maybe a little bit different. 9 That will be 15th, Bergenline to Kennedy 10 Boulevard; 22nd, Palisade to Kennedy Boulevard; 11 43rd, Park to Kennedy; 48th and 49th, Park to 12 Bergenline. 13 In addition to that we’ll also be doing 14 15th Street to 32nd on Summit Avenue; 19th and 20, 15 Summit to Kerrigan. 16 So there will be a lot of work going on 17 this summer in the City. Between the spring and 18 the summer that should be taking place. 19 In addition to that we’ll also be putting 20 callbox stations in all the parks. There’s one 21 at the high school park right now on 24 th and 22 Kennedy. It’s got the blue light on top. You 23 can press it; you’ll get the Police immediately. 24 We feel, especially in some of our larger 25 parks such as Duarte Park, Ellsworth Park, that’s  18 1 a nice addition to the park for residents to have 2 that level of security. Should something happen 3 to a child running in the park, they can press 4 it, you’ll get the Police Department immediately. 5 I know most people have cell phones today 6 but for those that don’t, if it services one 7 child, it’s well worth it. 8 On the City Street Striping Program for the 9 whole City, the entire City will be restriped, 10 the centerlines. We’re looking at doing bus 11 stops. All the street -- all the crosswalks in 12 the City at one time. Usually when you use the 13 machine that these large companies come in with, 14 the crosswalks and the striping should last from 15 anywhere from three to five years. So it helps 16 us to stay on top of it. Makes it safer for 17 residents when their out and about walking 18 through the City. 19 On the decorative street lights that have 20 been in place -- some of them have been in place 21 about 14, 15 years. Even the ones right here on 22 Bergenline Avenue have been in place before I 23 became the Mayor. We’re going to go back and red 24 lead them and paint them to keep them nice. It’s 25 great that we’re refurbishing and going in and  19 1 putting in new parks and new streets but you have 2 to maintain them. 3 Maintenance is the most important part. 4 Anyone can build a new park or pave a street; 5 it’s maintaining it. That’s what we’re doing 6 with these items. 7 Our parks, which we went out to bid on some 8 of it already, some of it we’re still looking to 9 do, every park in the City will be touched in one 10 way or the other. 11 At Duarte Park we’re going to be putting in 12 some new spray equipment, a pirate ship and some 13 other helicopter equipment for the kids to enjoy. 14 Knowing that it’s a poorer community, we want to 15 make sure the kids have a safe place to play over 16 the summer. 17 Having said that would anybody like to 18 comment on the Consent Agenda? 19 Please step forward; state your name and 20 address for the record. 21 Libero? 22 MR. But 3 I do believe, like the Mayor said, that Girl 4 Scouts are a great example for the other children 5 in the City. 6 They also participate in the events that we 7 do. They come and help us when we have our 8 senior dinners or luncheon. And our crime 14 went down. 15 I’m not one to run around bragging about 16 when crime goes down because it’s -- you never 17 know with crime, where things go. And typically that 16 generates anywhere from five to -- in the past 17 it’s been about 23 to 25 percent savings on 18 electricity. 19 The hope, of course, is that it’s on the 20 higher end but that is what this will enable us 21 to do. 22 MAYOR STACK: And it’s only for the 23 municipality to -- only for the municipal 24 government end to reap the benefits from? 25 Or is it for all residents to have an  37 1 opportunity? 2 MS. And 18 because of that support I’m here this evening 19 because I’m very, very much disappointed in and I 20 take offense to the actions of the Board of 21 Adjustment in this City. And the Board of 22 Adjustment is giving this Administration a black 23 eye. 24 I don’t know if any of you attend the Board 25 Meetings but for years I attended them, then I  39 1 stopped attending them, now I start going back 2 again and I just want to give you an example of a 3 recent Board Meeting that I went to. 4 An expert goes up there and his testimony 5 is that I was born and raised in Union City, I 6 went to school in Union City, I live in Union 7 City, I love Union City and I only design things 8 that are beautiful for Union City. 9 And then he says -- and I quote -- I think 10 this Board knows that I reject clients on a daily 11 basis -- closed quote. 12 I asked the Board how do they know that he 13 rejects clients? Unless he’s talking to the 14 Board before there’s a hearing. I find that 15 absolutely amazing and disgraceful. 16 And then he says I deny crazy variances and 17 the variances that I give, if you notice -- he 18 says to the Board -- the variances that I request 19 all have substantial grounds and they’re all 20 favorable -- closed quote. 21 Well, I said to the Chairman, I said, look, 22 he doesn’t ask for crazy variances, -- 23 MAYOR STACK: Who was this, Libero, that 24 said this? Who was this? 25 MR. MAROTTA: Excuse me?  40 1 MAYOR STACK: Who -- I’m sorry to interrupt 2 you. 3 MR. MAROTTA: The architect. The architect 4 from -- 5 MAYOR STACK: Okay. 6 MR. MAROTTA: -- downtown Union City. 7 MAYOR STACK: Okay. 8 MR. MAROTTA: All right? 9 I said to the Board -- the Zoning Board 10 members, I said look, whenever this architect 11 comes here you don’t have to have the hearing 12 because he only gives you good variances; he 13 doesn’t enter crazy things. So all you have to 14 do is let his sister, the lawyer, introduce the 15 project and then the Chairman you make your 16 motion to approve and bing, bing, bing down the 17 line they all approve it. 18 I asked him that night on the project, I 19 asked him do you need a density variance. He 20 said, no I don’t, not as far as I know; am I 21 correct, Mr. Kauker? 22 Now Mr. Kauker is the planner. All right? 23 He said it’s better that you ask the 24 planner that question; don’t ask me that 25 question.  41 1 But you know what? I asked the planner 2 that question. You know what the planner said? 3 He said to be compliant with the standard in the 4 ordinance and meet the density -- effective 5 density requirement we would need 7,500 square 6 feet. They don’t have that. We’re asking for a 7 density variance because we only have 6300 feet. 8 The architect jumps in and he says, we are 9 not asking for a density variance. 10 Who does the -- who does the Board believe? 11 You know when they approved it, no density 12 variance. The architect says don’t believe -- 13 don’t take my word, you got to listen to the 14 planner. But when the planner disagrees with you 15 he jumps in and disagrees with them and the Board 16 goes along with it. 17 Well, then I got to -- I got to sit there. 18 You know I -- you know I was born in this City 19 too, raised in this City, I still live here. 20 It’s quite a few years I think. All right? I 21 got to sit there and listen to a Board -- 22 extremely negative. 23 This is a zoning board. You ask zoning 24 questions. I know a little bit about zoning. 25 All right? You don’t ask the size of units. The  42 1 material you’re using. The color of the brick. 2 What’s that got to do with zoning? Stucco? The 3 material for the façade. All right? 4 On this particular project, it’s in a low 5 density area; one, two and three family homes. 6 The developer wants to build a four-story nine- 7 unit building. My reading of the zone says you 8 need 10,000 square feet. 9 So I asked the planner, you need 10,000 10 square feet? 11 He says for a low rise apartment building. 12 That’s his words. 13 I said, right. Isn’t this a low rise 14 apartment building? 15 What do you think his answer was? 16 Quote, I don’t know. 17 You believe a planner doesn’t know? Why 18 did he say he doesn’t know? Because you need 19 10,000 square feet and they only have 6300. 20 That’s a 59 percent difference. You don’t meet 21 the test. So not to meet the test he doesn’t -- 22 he says I don’t know. 23 Now the Chair comes in to the picture. He 24 starts throwing the softballs to him. 25 The argument given by the planner that you  43 1 could permit this building here in this low 2 density district is because down the street you 3 have a five story building. Up the street you 4 have a five story building. And the Chairman 5 says, well yeah, yeah, that’s right, you have a 6 five story building there. Well, that five story 7 building was built maybe 80 or 90 years ago. 8 That’s a pre-existing non-conforming use. 9 I’m going to read you something that this 10 planner said that’s absolutely amazing. Okay? 11 Absolutely amazing. 12 Just bear with me one minute. 13 He says that this building, quote, 14 according to planner, I think the benefits that 15 are generated by changing this non-conforming 16 use -- 17 There happens to be a building on there 18 that’s a pre-existing non-conforming use. 19 So he doesn’t say pre-existing non- 20 conforming use. He says by changing this non- 21 conforming use condition -- 22 Listen to this. 23 -- to a more highly conforming use. 24 That’s a lie. You put a four story 25 building in a low density, that’s not a  44 1 conforming use; that’s a non-conforming use that 2 you’re creating. 3 But he calls it a more highly conforming 4 use. And the Zoning Board accept it. Not one 5 question. 6 In all the years I’ve gone to that meeting, 7 never is there a question from a member of the 8 Board or from the professionals. Why? 9 The role of a zoning board is to protect 10 the zoning. To protect the people of the City. 11 I tell you why I’m here. Two years ago, 12 all right, when I was attending these meetings 13 the lawyers for developers and the developers 14 they were bitching all the time we need a new -- 15 a new master plan. We need a new master plan. 16 We can only build on 60 percent; we need a new 17 master plan. 18 Well two years ago we spent a couple of 19 hundred thousand dollars for a new master plan 20 for a new Zoning. But the Zoning Board doesn’t 21 respect it. They violate it all the time. 22 Why is it necessary for a citizen like 23 myself or Larry Price to challenge the Zoning 24 Board? Why? 25 Why doesn’t the Zoning Board deny when they  45 1 violate the zone and let the developer challenge 2 it and go to court? 3 You know I did a little study. Of all the 4 challenges that were made to the decisions of the 5 Zoning Board, 75 percent were sustained in the 6 Appellate Division or Superior Court. And when I 7 challenge a decision of the Board, there’s a 8 presumption, a presumption that the Board was 9 correct. So therefore the proof in challenging 10 it becomes very difficult. In spite of that 75 11 percent of the challenges were sustained or 25 12 percent of the Board decisions were sustained. 13 You know if we excluded one and two and 14 three family homes and there were challenges to 15 every development in the City, 75 percent 16 wouldn’t be there; only 25 percent. I think 17 that’s a pretty poor record. 18 So I think something should be done about 19 the Zoning Board. About the members, the 20 Chairman and the professionals. They’re giving 21 this Board -- this Commissioner Board a black 22 eye, believe me when I tell you. Because the 23 problems we have in this City, the -- you don’t 24 build on a hundred percent. 25 You go to 25th Street and Bergenline  46 th 1 Avenue, a hundred percent; 27 Street and Summit 2 Avenue, a hundred percent. Just recently 6th 3 Street and Palisade Avenue, a hundred percent; 4 41st Street and Palisade Avenue, a hundred 5 percent. 6 The homes next to it, they got windows, 7 they look out their window they see a building 8 three or four feet away. Air space, light, it’s 9 a quality of life. 10 This Commission prides itself and I 11 compliment in improving the quality of life and 12 the Board of Adjustment destroys the quality of 13 life of the City. 14 Something’s got to be done. 15 I don’t even want to get into the traffic 16 situation. 17 You know in the last dozen years this Board 18 is granting variances for off-street parking to 19 let them go on -- we have approximately 800 20 vehicles parked in the streets of this City that 21 shouldn’t be there because of the Board of 22 Adjustment. 23 Just think for a minute; 800 cars, take 24 them off the streets, we wouldn’t need the 25 ordinance to park in bus stops. We wouldn’t have  47 1 cars parking on sidewalks. We wouldn’t have cars 2 parking in intersections. 3 You know, I see -- one time I saw a woman 4 carrying a child. Because a car was blocking the 5 sidewalk she had to walk in the street. It’s not 6 right. 7 Don’t let them destroy what you’ve been 8 doing.
