CALL TO ORDER AND ROLL CALL There being a quorum, Mayor Prussing called the meeting of the Urbana City Council to order at 7:34 p.m. *This meeting started late due to prior Cunningham Town Board meeting and Close Session. Urbana City Council Minutes: February 02, 2015 Page 2 of 5 B. APPROVAL OF MINUTES OF PREVIOUS MEETING Alderman Roberts made a motion to approve minutes from meeting held on January 20, 2015 and January 26, 2015(Special). Alderman Madigan seconded. Motion carried by voice vote. C. ADDITIONS TO THE AGENDA Mayor Prussing asked to move appointment for Division Chief to the beginning of the agenda. Alderman Madigan made a motion to accept this change. Alderman Smyth seconded. Motion carried by voice vote. Mayor Prussing asked for a moment of silence in honor of Fire Division Chief Russell Chism who passed away last week. Brian Nightlinger, Fire Chief presented the appointment of Mr. Derrick Odle to Fire Division Chief. After presentation Alderman Smyth made a motion to approve the appointment of Derrick Odle as Fire Division Chief. Alderwoman Marlin seconded. Motion carried by voice vote. D. PETITIONS AND COMMUNICATIONS Scott Dossett addressed the council with concerns and suggestions to language modification to Ordinance No. 2015-01-003 regarding Tasers. Mark Dixon and Dean Jansen addressed the council in favor of Ordinance No. 2015-01-010. Brigitte Pieke, owner of Klose Knit addressed the council to express her concerns regarding parking enforcement issues during business hours around her place of business. Bishop King James and Rev. Dr. Evelyn Underwood did not wish to speak but wanted noted on record that they are still concerned about the Dr. Ellis Subdivision sewer Problems. The following residents addressed the council to vote against Tasers Belden Fields; Saba Manetti-Testaye; Stacy Gloss; Charles Suggs; Martel Miller; Rev. Dr. Evelyn Miller Burnett Underwood; Benjamin Stone; Marina Manetti; Brian Dolinar; Chris Evans; Ryan Koester; Danielle Chynoweth; Durl Kruse; Ivan Ruiz. E. UNFINISHED BUSINESS 1. Ordinance No. 2015-01-004: An Ordinance Amending Urbana City Code Chapter 3.7, Section 3.7-15(Increasing number of licensed premises that may display video gambling terminals/2015) [council 01/20/15] Alderman Smyth made a motion to send Ordinance No. 2015-01-004 back to committee for further discussion. REPORTS OF STANDING COMMITTEES 1. Committee of the Whole: a. Ordinance No. 2015-01-008: An Ordinance Approving a Redevelopment Agreement with Stephens Building LLC (218 W Main St – Norm Baxley) Alderwoman Marlin made a motion to approve Ordinance No. 2015-01-008. Alderman Roberts seconded. Motion carried by roll call. Ordinance No. 2015-01-009: An Ordinance Revising the Annual Budget Ordinance, FY2014-15 (Redevelopment Agreement with Stephens Building LLC) Alderwoman Marlin made a motion to approve Ordinance No. 2015-01-009. Alderman Roberts seconded. Motion carried by roll call. Ordinance No. 2015-01-010: An Ordinance Amending Urbana City Code Chapter 3, Section 3-43 (Increasing number of Class R-1 liquor licenses for SOILL Restaurant Systems, LLC, d/b/a Dotty’s, 2740 S. Philo Road, Ste. B) Before voting on this item Ms. Clark made a correction to the Ordinance Number it should read 2015-01-010 instead of 2015-01-0010. After correction Alderwoman Marlin made a motion to approve Ordinance No. 2015-01-010. Alderman Smyth seconded. Motion carried by roll call vote. Votes were as follows: Prior to voting Alderman Madigan recuse himself from 8:32- 8:34pm due to conflict of interest as a liquor license holder. Ordinance No. 2015-01-003: An Ordinance Authorizing the Urbana Police Department to Purchase Tasers and for Civilian Police Review Board Oversight over Deployment and Use of Tasers (TASER Ordinance) Alderwoman Marlin made a motion to approve Ordinance No. 2015-01-003. Alderman Roberts seconded. Motion carried by roll call vote. Votes were as follows: After public input and council discussion. Alderman Roberts made a motion to add the following wording “The aspect of the ordinance as it relates to bundling of incidences and review should come before the CPRB on a case by case basis”. Alderman Ammons seconded. Motion carried by voice vote. Mayor Prussing relinquished chair to Alderman Smyth to join discussion from 9:59-10:03pm. Addition to the Agenda) ** b. Public Arts Commission – Jason Patterson term ending June 30, 2015 Alderman Smyth Made a motion to approve the appointment of Jason Patterson to the Public Arts Commission as presented. Resolution No. 2015-02-004R: A Resolution Approving and Authorizing the Execution of a Promotional and Marketing Agreement for the Annual Urbana Sweetcorn Festival (Urbana Business Association, Calendar Year 2015) Alderman Madigan made a motion to approve Resolution No. 2015-02- 004R. Alderman Smyth seconded. Motion carried by roll call.
