CITY OF URBANA COMMITTEE OF THE WHOLE – November 9, 2015 – 7:00 P.M. CITY COUNCIL CHAMBERS – 400 S. VINE STREET, URBANA, IL The City Council Committee Of The Whole of the City of Urbana, Illinois, met in regular session Monday, November 9, 2015 in the Council Chambers of the Urbana City Building. Marlin; Charles Smyth; Laurel Lunt Prussing; Phyllis Clark ELECTED OFFICIALS PRESENT VIA TELECONFERENCE: There were none. ELECTED OFFICIALS ABSENT: Bill Brown; Eric Jakobsson; Dennis Roberts STAFF PRESENT: Pat Connelly; William Gray; Elizabeth Hannan; Mike Monson; Brian Nightlinger; Matt Rejc; James Simon; Elizabeth Tyler OTHERS PRESENT: Bishop King James Underwood and Reverend Dr. Evelyn Underwood 1. CALL TO ORDER AND ROLL CALL There being a quorum, Chair Diane Marlin called the meeting of the Committee of the Whole to order at 7:03 p.m. 2. ADDITIONS TO THE AGENDA AND STAFF REPORT 1. Community Development Director Elizabeth Tyler informed the Committee that the last Saturday Market at the Square took place on Saturday, November 7. She also announced some upcoming events: Holiday Market inside Lincoln Square from November 14 through December 19; the second annual Market at the Square Community Supported Ag Fair on December 14 from 4pm – 7pm at the Urbana Civic Center; several upcoming Habitat for Humanity home dedications. Ms. Tyler also announced that the new director for the Urbana Business Association is Paris Blalock, who will present a report to the Council in December or January. 2. Mayor Prussing spoke about the proposed increase in the Homestead Exemption and how it would affect Urbana’s share of property tax. 3. APPROVAL OF MINUTES OF PREVIOUS MEETING 1. October 26, 2015: Alderman Ammons made a motion to approve the October 26, 2015 minutes. Chair Alderman Smyth seconded. The motion carried by voice vote. 4. PUBLIC INPUT l. Chair Marlin acknowledged a card from Bishop King James and Reverend Dr. Evelyn Underwood, and further acknowledged that neither wanted to verbally express their concerns regarding Dr. Ellis Subdivision sewer issues, but asked that these issues be mentioned for the record. City of Urbana Committee Of The Whole Minutes: November 9, 2015 Page 2 of 5 5 RESOLUTION NO. 2015-11-060R: A Resolution Authorizing The City of Urbana, Champaign County, Illinois, To Issue Its Revenue Bond (Clark- Lindsey Village Project), Series 2015, For the Purpose of Providing Funds to Finance The Costs of A Project For Clark-Lindsey Village, Inc.; Authorizing And Approving Certain Documents In Connection With The Issuance of Said Bond; And Authorizing Certain Other Actions in Connection With The Issuance of Said Bond – [FIN] Finance Director Elizabeth Hannan presented Resolution No. 2015-11-060R for approval. She introduced Tim Mast, the Chief Financial Officer for Clark Lindsey Village and Carl Webber, Attorney who gave a brief overview of the Clark Lindsey Village Project. After discussion, Alderman Smyth made a motion to send this item to Council with recommendation for approval. Alderman Madigan seconded the motion. Motion was carried by voice vote. 6. RESOLUTION NO. 2015-11-061R: A Resolution Deeming Certain Funds In The Special Tax Allocation Fund For the Downtown Urbana Tax Increment Redevelopment Project Area As “Surplus” Funds and Directing Payment and Distribution Thereof (2015) – [FIN] Finance Director Elizabeth Hannan presented Resolution No. 2015-11-061R for approval. After discussion, Alderman Smyth made a motion to send this item to Council with recommendation for approval. Alderman Madigan seconded the motion. Motion carried by voice vote. 7. RESOLUTION NO. 2015-11-062R: A Resolution Determining the Amounts of Money Necessary To Be Raised By The Tax Levy (2015)-[FIN] Finance Director Elizabeth Hannan presented Resolution No. 2015-11-062R for approval. After discussion, Alderman Smyth made a motion to send this item to Council with recommendation for approval. Alderman Ammons seconded the motion. Motion carried by voice vote. 8. ORDINANCE NO. 2015-11-110: An Ordinance Revising The Fiscal Year 2015- 2016 Annual Budget (Human Relations Officer) [MAYOR] Mayor Prussing presented Ordinance No. 2015-11-110 for approval. After discussion, Alderman Ammons made a motion to send Ordinance No. 2015-11-110 to Council with recommendation for approval. The motion was seconded by Alderman Smyth. RESOLUTION NO. 2015-11-063R: A Resolution Approving an Agreement For Federal Participation With the Illinois Department of Transportation (IDOT/CITY Agreement: Lincoln Avenue Right-Of-Way Acquisition) – [PW] Public Works Director William Gray presented Resolution No. 2015-11- 063R for approval. After discussion a motion to send this item to Council with recommendation for approval was made by Alderman Madigan. Alderman Ammons seconded the motion. Motion carried by voice vote. 10. RESOLUTION NO. 2015-11-064R: A Resolution for Improvement by Municipality Under the Illinois Highway Code (Lincoln Avenue Improvement Right-Of-Way - Purchase with MFT Funds) – [PW] Public Works Director Bill Gray presented Resolution No. 2015-11-064R for approval. Alderman Madigan made a motion to send this item to Council with recommendation for approval. Motion seconded by Alderman Smyth and motion was carried by voice vote. 11. RESOLUTION NO. 2015-11-065R: A Resolution Approving An Amendment to An Urbana Home Consortium Community Housing Development Organization Agreement With Champaign County Neighborhood Alliance For Habitat (CHDO Operating FY 2012-2013) – [CD] Community Development Specialist Matt Rejc presented Resolution 2015- 11-065R, 2015-11-066R, 2015-11-067R, 2015-11-068R and 2015-11-069R in omnibus fashion for approval. Alderman Smyth made a motion to approve the items in omnibus fashion. Alderman Madigan seconded the motion. Motion carried by voice vote. 12. RESOLUTION NO. 2015-11-066R: A Resolution Approving An Amendment To An Urbana Home Consortium Community Housing Development Organization Agreement With Habitat For Humanity of Champaign County (CHDO Operating FY 2013-2014) – [CD] Voted in omnibus fashion with Ordinance No. 2015-11-065R, Ordinance No. 2015-11-067R, Ordinance No. 2015-11-068R and Ordinance No. 2015-11- 069R. 13. Motion seconded by Alderman Madigan and carried by voice vote. 16. ORDINANCE NO. 2015-11-111: An Ordinance Amending Urbana City Code Chapter Twenty-Two, Article VI, Section 22-90 (c)(4) (Amendment to food & Beverage Tax Ordinance to clarify Tax obligations for Persons Hiring Urbana-Based Caterers) City Attorney James Simon presented Ordinance No. 2015-11-111 to the Committee for approval. Alderman Smyth made a motion to send Ordinance No. 2015-11-111 to Council with recommendation for approval. Alderman Ammons seconded the motion. Motion carried by voice vote. 17. ORDINANCE NO. 2015-11-112: An Ordinance Amending Urbana City code Chapter Two, Article IX, Sections 2-171 Through and Including 2-176 and Adding New Section 2-177 for Compliance With new State Statute Concerning Legal Defense and Indemnification for City Employees and Officials (State Statutory Bar for Providing Legal Defense and Indemnity for Employees Unlawful Criminal, Intentional, Willful, Wanton, Grossly Negligent Conduct) City Attorney James Simon presented Ordinance No. 2015-11-112 for approval. After discussion, Alderman Ammons made a motion to send Ordinance No. 2015-11-112 to Council with recommendation for approval.
