The City Council Committee Of The Whole of the City of Urbana, Illinois, met
in regular session Monday, March 14, 2016 in the Council Chambers of the
Urbana City Building.

1. CALL TO ORDER AND ROLL CALL
There being a quorum, Chair Michael P. Madigan called the meeting of
the Committee of the Whole to order at 7:36 p.m.*
*Late start for meeting due to closed session of City Council.
2. ADDITIONS TO THE AGENDA AND STAFF REPORT
a. Grants Management Manager Kelly Mierkowski gave an update on the
2016 Regional Neighborhood Networks Conference. She introduced John
Ruffin, Neighborhood Coordinator with the Neighborhood Services
Department at the City of Champaign. Ms. Mierkowski and Mr. Ruffin
presented an overview of the conference, which will take place in
Champaign-Urbana. September 29 through October 1, 2016.
b. The Mayor updated the committee on the hospital property tax
situation, stating that the Supreme Court granted a stay to the
hospitals, with the provision that they issue a bond to the county
in the amount of taxes owed.
c. Alderwoman Marlin proposed dividing agenda item number 16 into two
agenda items. She made a motion to make “Process for Implementation
of Recommendations from the Task Force on Traffic Stops” agenda item
number 16 and “Cannabis Fines” agenda item number 17. Motion was
seconded by Alderman Roberts and carried by voice vote.
3. APPROVAL OF MINUTES OF PREVIOUS MEETING
Alderman Ammons made a motion to approve the minutes from the February
22, 2016 meeting. Alderman Jakobsson seconded the motion. Motion
carried by voice vote.

4. PUBLIC INPUT
Bishop King James Underwood and Rev. Dr. Evelyn Underwood did not wish
to speak but wanted their concerns noted on record about the Dr. Ellis
Subdivision Sewer Problems.
Durl Kruse presented the committee with the reasons he opposes the new
downtown TIF district.
5. Ordinance No. 2016-03-017: An Ordinance Revising The Fiscal Year
2015 – 2016 Annual Budget (Meijer Development Agreement – Final
Payment) – FIN
Finance Director Elizabeth Hannan presented this ordinance.
Alderwoman Marlin made a motion to send Ordinance No. 2016-03-017 to
council with recommendation for approval. Motion seconded by Alderman
Smyth and carried by voice vote.
6. Ordinance No. 2016-03-018: An Ordinance Authorizing the Acquisition
of Certain Real Estate Property by Eminent Domain for the Extension of
North Lincoln Avenue from Saline Court to Olympian Drive (Acquisition
of right-of-way for Constructing the North Lincoln Avenue Extension) –
PW
Public Works Director William Gray presented this ordinance. Alderman
Jakobsson made a motion to send Ordinance No. 2016-03-018 to council
with a recommendation for approval. Motion seconded by Alderman Roberts
and carried by voice vote.
7. Ordinance No. 2016-03-019: An Ordinance Authorizing the Purchase of
Certain Real Estate (A Portion of a Real Estate Parcel with Permanent
Index Number 25-15-29-300-004) – PW
Public Works Director William Gray presented this Ordinance. Alderman
Jakobsson made a motion to send Ordinance No. 2016-03-19 to council
with recommendation for approval. Motion seconded by Alderwoman Marlin
and carried by voice vote.
8. Resolution No. 2016-03-011R: A Resolution Amending resolution Number
2016-01-005R, Approving a Local Agency Agreement for Federal
Participation with the Illinois Department of Transportation (Lincoln
Avenue Construction from Olympian Drive to Saline Court Section Number
11-00334-01-PV) – PW
Mr. Gray presented this resolution. He stated that the resolution
should be corrected to: “A Resolution Approving a Local Agency
Agreement for Federal Participation with the Illinois Department of
Transportation (Lincoln Avenue Construction from Olympian Drive to
Saline Court Section Number 11-00334-01-PV)”. After discussion
Alderman Smyth made a motion to send Resolution No. 2016-03-011R to
council with recommendation for approval. Motion seconded by Alderman
Roberts and carried by voice vote.
9. Resolution No. 2016-03-016R: A Resolution for Improvement by
Municipality under the Illinois Highway Code (North Lincoln Avenue
Improvements – Construction, Engineering and Utilities) – PW
Mr. Gray presented this resolution. Alderman Smyth made a motion
to send Resolution No. 2016-03-016R to council with recommendation
for approval. Motion seconded by Alderman Roberts and carried by
voice vote.

10. Resolution No. 2016-03-012R: A Resolution Approving an
Amendment to a Subrecipient Agreement between the Urbana Home
Consortium and Habitat for Humanity of Champaign County (FY 2014-
2015) – CD
Ms. Mierkowski presented this resolution. Alderman Ammons made a
motion to send Resolution No. 2016-03-012R to council with
recommendation for approval. Motion seconded by Alderman Roberts
and carried by voice vote.
**NOTE: Chair Madigan recused himself and gave the chair to
Alderwoman Marlin prior to the presentation of the following two
items, from 8:14pm to 8:24pm, due to possible conflict as he is a
liquor license holder in the City of Urbana, Illinois.**
11. Ordinance No. 2016-03-020: An Ordinance Amending Urbana City Code
Chapter Three, Section 3-43 (Increasing number of Class C liquor
licenses for UM, Inc., d/b/a Mr. Gas Plus, 808 E. Main Street) – Mayor
Mayor Prussing presented Ordinance No. 2016-03-020. After discussion,
Alderman Jakobsson made a motion to send this ordinance to council with
recommendation for approval. Motion seconded by Alderman Roberts and
carried by voice vote
12. Ordinance No. 2016-02-014: An Ordinance Amending Urbana City
Code Chapter Three, Article III, Section 3-40 and Adding New
Section 3-51 Providing for Compliance with New State Statute
Concerning Responsible Alcoholic Beverage Server Training – Mayor
[COW 02/15/16]
Mayor Prussing presented Ordinance No. 2016-02-014. After discussion
Alderman Smyth made a motion to send this ordinance to council with
recommendation for approval. Motion was seconded by Alderman Jakobsson
and carried by voice vote.
13. Resolution No. 2016-03-013R: Resolution to Support Reform of
Binding Arbitration in Illinois – Mayor
Mayor Prussing presented Resolution No. 2016-03-13R. After
discussion Alderwoman Marlin made a motion to send this
resolution to council with recommendation for approval.
Motion seconded by Alderman Smyth and carried by voice vote.
14. Resolution No. 2016-03-014R: Resolution in Support of Funding for
Higher Education in Illinois – Mayor
Mayor Prussing presented Resolution No. 2016-03-14R. After discussion
Alderman Roberts made a motion to send this resolution to council with
recommendation for approval. Motion seconded by Alderman Ammons and
carried by voice vote.
15. Resolution No. 2016-03-015R: A Resolution Approving an
Intergovernmental Agreement Regarding Intervention in a Proposed
Illinois-American Water Company Water and Sewer Rate Increase Case
(Docket No. 16-0093) – Chief of Staff
Chief of Staff Mike Monson presented Resolution No. 2016-03-15R. After
discussion Alderwoman Marlin made a motion to send this resolution to
council with recommendation for approval. Motion seconded by Alderman
Smyth and carried by voice vote.

16. Discussion – Cannabis - Process for Implementation of
Recommendations from Task Force on Traffic Stops [COW 1/25/16; CC
03/07/16]
Mayor Prussing suggested that committee members go through the
worksheet to review and prioritize the list of recommendations.
Human Relations Officer Alex Bautista presented his ideas and
responded to concerns and questions from committee memebers. It
was decided that Mr. Bautista would send a survey with the
information to be prioritized to committee members. Mr. Bautista
will then send the results to Alderman Roberts to be distributed
to the rest of the committee members. Alderman Smyth stated he
would like to keep this discussion on a monthly basis to be held
every other committee meeting.
17. Discussion – Cannabis Fines
Mayor Prussing gave background information to the committee
about the penalties for cannabis possession. Mr. Bautista and
Police Chief Patrick Connolly addressed questions and concerns
of committee members. After discussion Alderman Ammons made a
motion to recommend that staff draft an ordinance lowering the
fine for possession of 30 grams or less of cannabis to $5.00.
Motion was seconded by Alderman Jakobsson and carried by voice
vote.
18. Adjournment: There being no further business to come before the
Committee, Chair Madigan declared the meeting adjourned at 10:43pm.
