CITY OF URBANA COMMITTEE OF THE WHOLE – May 9, 2016 – 7:00 P.M. CITY COUNCIL CHAMBERS – 400 S. VINE STREET, URBANA, IL The City Council Committee Of The Whole of the City of Urbana, Illinois, met in regular session Monday, May 9, 2016, in the Council Chambers of the Urbana City Building. ELECTED OFFICIALS PHYSICALLY PRESENT: Aaron Ammons; Bill Brown; Eric Jakobsson; Diane W. Marlin; Dennis Roberts; Charles Smyth; Phyllis D. Clark; Laurel Lunt Prussing ELECTED OFFICIALS PRESENT VIA TELECONFERENCE: None ELECTED OFFICIALS ABSENT: Michael P. Madigan STAFF PRESENT: Elizabeth Beaty; Patrick Connolly; William Gray; Elizabeth Hannan; Mike Monson; Brian Nightlinger; Derrick Odle; Craig Shonkwiler; James Simon; Scott Tess; Elizabeth Tyler OTHERS PRESENT: Seth Fein; Durl Kruse; Esther Patt; Patrick Singer; Rev. CALL TO ORDER AND ROLL CALL There being a quorum, Chair Bill Brown called the meeting of the Committee of the Whole to order at 7:00 p.m. 2. APPROVAL OF MINUTES OF PREVIOUS MEETING Alderwoman Marlin made a motion to approve the minutes from the meeting held on April 25, 2016. Alderman Roberts seconded the motion, which was carried by voice vote. 3. ADDITIONS TO THE AGENDA Alderman Brown added a change per staff to move switch order for item 11 to item number 9. 4. PUBLIC INPUT Esther Patt addressed the committee regarding her concerns about the paraphernalia fine and time period for paying fines. Bishop King James and Rev. Dr. Evelyn B. Underwood did not wish to speak, but asked that their position be entered into the record regarding the Dr. Ellis Subdivision sewer issues. Mayor Prussing read a proclamation, proclaiming May 26, 2016 as Historic Preservation Day. 5. Presentations a. A Historic Perspective of TIF 1 & TIF 2: Implication for the future – Durl Kruse. Mr. Kruse gave a PowerPoint presentation regarding TIF 1 and TIF 2. Mr. Kruse also addressed questions from the committee. Discussion ensued. Committee of the Whole May 9, 2016 Page 2 of 4 6. Staff Report a. Capital Improvement Plans – Roads Public Works Director William Gray and Assistant City Engineer Craig Shonkwiler gave a PowerPoint presentation showing the current status of all city roads. Mr. Shonkwiler also advised the committee that all infrastructures are aging, funds are declining and repair cost is going up. He also gave an overview of all projects. Mr. Gray and Mr. Shonkwiler addressed questions from committee. Discussion ensued. Community Development Director Elizabeth Tyler announced various events in observance of Historic Preservation month. These events will be held at the Urbana Free Library. 7. Resolution No. 2016-05-027R: A Resolution Approving and Authorizing the Execution of a Promotional and Marketing Agreement for Pygmalion Festival (Fein-Bursoni, Inc., FY 2016-2017) Community Development Director Elizabeth Tyler presented Resolution No. 2016-05-027R to council with recommendation for approval. Applicants Seth Fein and Patrick Singer were available for questions. Discussion ensued. After presentation Alderman Jakobsson made a motion to send Resolution No. 2016-05-027R to council with recommendation for approval. Alderwoman Marlin seconded. Motion carried by voice vote. 8. Resolution No. 2016-05-028R: A Resolution Amending the City of Urbana Municipal Electric Aggregation Plan of Operation and Governance (Plan of Operations and Governance/2016) Environmental Sustainability Manager Scott Tess presented Resolution No. 2016-05-028R to council with recommendation for approval. Mr. Tess is proposing 4 changes to the current agreement as follows: 1. Clarity and consistency with the language. 2. Remove the beat or meet clause. 3. Remove an obligation for the city to send a mail notification if the city decides not to enter into a municipal electric aggregation agreement in the future. 4. Enable the mayor with staff support to make minor amendments such as this and notify the council. Discussion ensued. After presentation and addressing questions from committee Alderman Smyth made a motion to send Resolution No. 2016-05- 028R to council with recommendation for approval. Alderman Roberts seconded. Motion carried by voice vote. 9. Ordinance No. 2016-05-035: An Ordinance Amending Urbana City Code Chapter 3.5 (Amendments to Ambulance Services Ordinance) Fire Chief Brian Nightlinger and Division Chief Derrick Odle presented Ordinance No. 2016-05-035 to council with recommendation for approval. Mr. Nightlinger and Mr. Odle addressed questions and concerns from committee. Discussion ensued. Committee of the Whole May 9, 2016 Page 3 of 4 Alderman Brown relinquished the chair to Alderman Roberts to join discussion from 9:49-9:52pm. After discussion Alderman Smyth made a motion to send Ordinance No. 2016-05-035 to council with recommendation for approval. Alderman Jakobsson seconded. Motion carried by voice vote. 10. Ordinance No. 2016-05-034: An Ordinance Amending Urbana City Code Chapter Fourteen, Section 14-7, Regarding Schedule of Fees Subsections B Through P – “Licenses and Permits,” Excluding Liquor (July 1, 2016 through June 30, 2017) Collector's Office Supervisor Elizabeth Beaty presented Ordinance No. 2016-05-034 with recommendation for approval. Ms. Beaty reminded the committee that this ordinance will be going to council for final approval on June 13, 2016. Public Works Assistant City Engineer Brad Bennett presented the new changes to the sewer use and stormwater utility fees changes as stated in the proposed schedule of fees. Discussion ensued. After presentation and discussion Alderman Roberts made a motion to send Ordinance No. 2016-05-034 to council with recommendation for approval. Alderman Jakobsson seconded. Motion carried by voice vote. 11. Ordinance No. 2016-05-033: An Ordinance Amending Urbana City Code Chapter Fourteen, Section 14-7, Regarding Schedule of Fees Subsection A – “LIQUOR LICENSES” (July 1, 2016 through June 30, 2017) Ms. Beaty presented Ordinance No. 2016-05-033 with recommendation for approval. No discussion. Alderman Roberts made a motion to send Ordinance No. 2016-05-033 to council with recommendation for approval. Alderman Jakobsson seconded. Motion carried by voice vote. 12. Ordinance No. 2016-05-036: An Ordinance Amending Urbana City Code Sections 15-67 and 1-18-Possession of Cannabis Paraphernalia and Penalty (Reduction of Fine for Cannabis Paraphernalia Possession from $300 to $25) Alderman Ammons presented Ordinance No. 2016-05-036 with a motion to add an amendment to reduce fee from $ 50.00 to $ 25.00. Alderman Jakobsson seconded. Motion carried by voice vote. Discussion ensued. After discussion and clarification from Police Chief Patrick Connolly Alderman Smyth made a motion to send Ordinance No. 2016-05-036 as amended to council with recommendation for approval. Alderman Ammons seconded. Motion carried by voice vote. At 10:30pm Alderman Ammons made a motion to extend the meeting in order to address the following two items. Alderman Jakobsson seconded. Motion carried by voice vote. 13. Ordinance No. 2016-05-037: An Ordinance Amending Urbana City Code Section 1-17 – Settlement of Violations Prior to Suit Being Filed (Increase in Time for Settling Violations from 14 Days to 28 Days) Mayor Prussing presented Ordinance No. 2016-05-037 with recommendation for approval. Discussion ensued. Committee of the Whole May 9, 2016 Page 4 of 4 After discussion Alderman Smyth made a motion to amend the ordinance to increase time for settling violations from 14-25 days to 28-35 days. Alderman Roberts seconded the motion. Motion carried by voice vote. Alderwoman Marlin made a motion to send Ordinance No. 2016-05-037 as amended to council with recommendation for approval. Alderman Roberts seconded. Motion carried by voice vote. 14. Ordinance No. 2016-05-038: An Ordinance Amending Urbana City Code Chapter 1 and Chapter 3 (Notice Requirement for Hearing on Class G-2 Liquor License Application, Fine for Basset Violation) - Mayor Mayor Prussing presented Ordinance No. 2016-05-038 with recommendation for approval. Discussion ensued. After discussion Alderman Jakobsson made a motion to amend the ordinance to say that the proprietor should be fined not the server. Due to lack of votes motion failed. Alderman Brown relinquished the chair to Alderman Roberts to join discussion from 10:38-10:39p.m Alderman Roberts made a motion to send Ordinance No. 2016-05-038 to council with recommendation for approval. Alderman Smyth seconded. Motion carried by voice vote. 15. Adjournment There being no further business to come before the Committee, Chair Brown declared the meeting adjourned at 10:39pm. _ Wendy M.
