CITY OF URBANA COMMITTEE OF THE WHOLE – Monday, July 9, 2018 CITY COUNCIL CHAMBERS - 400 SOUTH VINE STREET, URBANA, IL The City Council Committee of The Whole of the City of Urbana, Illinois, met in regular session Monday, July 9, 2018, in the Council Chambers of the Urbana City Building. Call to Order and Roll Call There being a quorum, Chair Jared Miller called the meeting of the Committee of the Whole to order at 8:55pm, following a meeting of the Cunningham Township Board. 2. Approval of Minutes of Previous Meeting Alderman Dean Hazen made a motion to approve the minutes from the meeting held on June 25, 2018. Motion seconded by Alderman Dennis Roberts and carried by voice vote. 3. Additions to the Agenda There were none. 4. Public Input There was none. 5. Presentations There were none. 6. Staff Report There was none. 7. Ordinance No. 2018-06-047: An Ordinance Amending Urbana City Code Chapter 23 (Operation and Parking of Dockless Bicycles on City of Urbana Rights-of-Way and Property) Planner Kevin Garcia presented this ordinance. This ordinance allows the City Engineer to identify where dockless bikes can be parked on city property where parking is allowed, including the public right-of-way. It will allow him to respond to problems that might arise without having to amend the City Code. It also specifies how private property owners can prevent parking of dockless bikes on their property, and how to establish areas where they can be parked. There was discussion during which Mr. Garcia and City Attorney made clarifications. Some of the points of the discussion were: Committee of the Whole Monday, July 9, 2018 Page 2 of 4 • Dockless bicycles can be parked on city property only if it has been designated as parking for Dockless Bikes. The City has the right to remove or relocate bikes from non-designated locations to a location designated for Dockless Bike parking. • Dockless Bikes cannot be parked on private property without owner’s or tenant’s consent. Dockless Bikes parked without permission can be removed from property by property owner or tenant. • Dockless Bike companies are responsible for use and location of their bikes. Companies will be licensed on an annual basis and must provide a security deposit. They will be required to have general liability insurance, workers’ compensation coverage, and vehicle insurance. After discussion, Alderman Bill Brown made a motion to send Ordinance No. 2018-06-047 to council with recommendation for approval. Motion seconded by Alderman Aaron Ammons and carried by voice vote. Ordinance No. 2018-07-049: An Ordinance Amending Urbana City Code Chapter 20, Articles II and V Assistant City Engineer Brad Bennett presented this ordinance. He explained this is for small cell technology installations that are located in the public right-of-way (ROW). The state passed Public Act 100-0585 in April 2018, and requires that certain amendments be made to the City Code. Those changes include: new definitions pertaining to small wireless facilities, revised permit/license application and review process; revised requirements on smart wireless facility height limitations, spacing and installation locations; and new limits on permit/license fees. After discussion, Alderwoman Maryalice Wu made a motion to send Ordinance No. 2018-07- 049 to council with recommendation for approval. Motion seconded by Alderman Roberts and carried by voice vote. 9. Ordinance No. 2018-07-050: An Ordinance Amending Urbana City Code Chapter 14, Section 14-7, Regarding the Schedule of Fees Assistant City Engineer Brad Bennett presented this ordinance, and said this will revise the Schedule of Fees to reflect the fees set by the new regulation act. There was a motion made by Alderman Brown to send Ordinance No. 2018-07-050 to council with recommendation for approval. Motion seconded by Alderwoman Wu and carried by voice vote. 10. Resolution No. 2018-07-029R: A Resolution Authorizing Entry Into Inter local Agreement (Cooperative Purchasing Program with Region VIII Education Service Center, Pittsburg, Texas) Finance Director Elizabeth Hannan presented this resolution. She said this would allow the city to enter into purchase cooperatives, which is allowed by Illinois law. This cooperative has pricing available through Enterprise Fleet Management, which the city may choose to use for the vehicle leasing program. There are other products that can be purchased through this cooperative, as well. Committee of the Whole Monday, July 9, 2018 Page 3 of 4 Alderman Dennis Roberts made a motion to send Resolution No. 2018-07-029R to council with recommendation for approval. Motion seconded by Alderman Hazen and carried by voice vote. 11. Resolution No. 2018-07-030R: A Resolution Authorizing Entry Into Purchasing Alliance Agreement (National Intergovernmental Purchasing Alliance Company) Ms. Hannan presented Resolution No. 2018-07-030R, and said that through this cooperative agreement, the city could purchase office furniture at a discount, and installation would be done by a Champaign business. Alderman Aaron Ammons made a motion to send Resolution No. 2018-07-030R to council. Motion seconded by Alderman Eric Jakobsson and carried by voice vote. 12. Resolution No. 2018-07-031R: A Resolution Approving And Authorizing The Execution of an Intergovernmental Agreement with the Housing Authority of Champaign County Grants Manager Kelly Mierkowski presented this resolution. She told committee members that if this is awarded by the Illinois Housing Development Authority, it would be used to create up to 24 units of permanent supportive housing at 1606 E. Colorado Avenue. The city and the Housing Authority will work together to secure all necessary city approvals and financing commitments. The city will contribute direct or indirect financing, which would include waiver of certain fees, permits and costs. John Daily, with the Champaign County Housing Authority was present to answer questions. After discussion, Alderman Brown made an amendment that was suggested by Mayor Marlin to insert a number 4 in the draft intergovernmental agreement as follows: “In the eventual operation and leasing of the new development at 1606 E. Colorado Avenue in Urbana, HACC shall comply with Sections 12-37 and 12-64 of the City of Urbana Human Rights Ordinance”. This would be included as number 4, and number 5 would be “Miscellaneous”. Alderman Roberts made a motion to send Resolution No. 2018-07-031R to council with recommendation for approval. Motion seconded by Alderman Hazen. Alderman Brown made a motion to amend the intergovernmental agreement included with Resolution No. 2018-07- 031R, as suggested by Mayor Marlin, with the following: “In the eventual operation and leasing of the new development at 1606 E. Colorado Avenue in Urbana, HACC shall comply with Sections 12-37 and 12-64 of the City of Urbana Human Rights Ordinance”. Motion to amend the agreement was seconded by Alderwoman Wu. Motion to amend the agreement was carried by voice vote. Motion to send the amended Resolution No. 2018-07-031R to council with recommendation for approval was carried by voice vote. 13. Resolution No. 2018-07-032R: A Resolution Certifying a Community Housing Development Organization for the Urbana Home Consortium (Habitat July 2018) Chair Miller suggested passing Resolution No. 2018-07-032R, Resolution No. 2018-07-033R and Resolution No. 2018-07-034R in omnibus fashion. Ms. Mierkowski presented these resolutions and said the Urbana HOME Consortium must commit 15% of its FY 2017 HOME allocation to eligible CHDO projects by September 30, 2019. The proposed amount of the project agreement is $94,467.90 if the total amount of the 15% CHDO set aside for PY 2017. The proposed projects are included in the goals and strategies of the City of Urbana and Urbana Home Consortium Consolidated Plan FY 2015- 2019. The funds cannot be used for any other program or activity. Alderman Brown made a motion to consider Resolution No. 2018-07-032R, Resolution No. Committee of the Whole Monday, July 9, 2018 Page 4 of 4 2018-07-033R and Resolution No. 2018-07-034R in omnibus fashion. Motion seconded by Alderman Roberts and carried by voice vote. Alderman Brown made a motion to send Resolution No. 2018-07-032R, Resolution No. 2018- 07-033R and Resolution No. 2018-07-034R to council with recommendation for approval. Motion seconded by Alderwoman Wu and carried by voice vote. 14. Resolution No. 2018-07-033R: A Resolution Approving and Authorizing the Execution of an Urbana Home Consortium Community Housing Development Organization Agreement (Habitat CHDO Developer PY 2017) See Resolution No. 2018-07-032R. 15. Resolution No. 2018-07-034R: A Resolution Approving and Authorizing the Execution of an Urbana Home Consortium Community Housing Development Organization Agreement (Habitat CHDO Operating PY 2017) See Resolution No. 2018-07-032R. 16. Adjournment With no further business before the committee, Chair Miller adjourned the meeting at 10:03pm.
