The City Council of the City of Urbana, Illinois, met in regular session April 13, 2020, at 7:00 p.m.
in the Council Chambers at the Urbana City Building. *Due to Coronavirus, this meeting was held
virtually via Zoom to maintain social distancing as required per Governor’s State Order.

A. CALL TO ORDER AND ROLL CALL
There being a quorum virtually present, Mayor Marlin called the meeting of the Urbana City
Council to order at 7:12pm following Cunningham Township Board and City Council Public
Hearing.
B. APPROVAL OF MINUTES OF PREVIOUS MEETING
CM Wu made a motion to approve minutes from the March 23, 2020. Motion seconded by
CM Roberts and carried by unanimous voice vote.

Mayor Marlin read a proclamation declaring the week of April 13-17, 2020 as Community
Development week. Additionally, Mayor Marlin acknowledged and thanked Community
Development staff for maintaining the day-to-day operations during this critical times.

I. NEW BUSINESS
1. Resolution No. 2020-04-018R: Resolution for Improvement Under the Illinois Highway
Code for the Allocation of Motor Fuel Tax Funds
City Engineer Justin Swinford presented Resolution No. 2020-04-018R with the
recommendation for approval. This resolution will allow allocation of Motor Fuel Tax
(MFT) to MCORE projects.
Mr. Swinford gave a background summary of intergovernmental agreements between the
City, the City of Champaign, Urbana Mass Transit District, and the University of Illinois,
to participate in the Multimodal Corridor Enhancement Project (MCORE). This
resolution will allow an allocation from the state motor fuel tax (MFT) to MCORE.
After presentation and discussion, CM Hursey made a motion to approve Resolution No.
2020-04-018R as presented. CM Miller seconded. Motion carried by roll call vote. Votes
were as follows: (7-Aye:0-Nay)

2. Ordinance No. 2020-04-017: An Ordinance Revising The Annual Budget Ordinance
(Budget Amendment #7 – Capital Improvement Plan)
City Administrator Carol Mitten and City Engineer Justin Swinford presented this item.
The budget amendment will allocate State Motor Fuel Tax (SMFT) to projects that already
require Illinois Department of Transportation (IDOT) review. The two projects are
MCORE Project 5 and the Vine and Washington Resurfacing Project.
Ms. Mitten and Mr. Swinford addressed all questions and concerns about the proposed
changes to each fund. They also explained that to offset the transfer from the MCORE
Project 5 account in the General Fund, transfers within the City’s SMFT will be necessary,
but will not affect the projected schedule for construction of the projects with depleted
balances.
After presentation, CM Roberts made a motion to approve Ordinance No. 2020-04-017 as
presented. CM Jakobsson seconded. Motion carried by roll call vote. Votes were as

3. Ordinance No. 2020-04-018: An Ordinance Authorizing the Lease of Certain Real Estate
(A Portion of a Real Estate Parcel with Permanent Index Number 91-21-10-151-007,
Located at 901 N. Smith Rd. / Solar Star Urbana Landfill Central, LLC)
Environmental and Sustainability Manager Scott Tess presented Ordinance No. 2020-04-
018 and 2020-04-019 with recommendation for approval. Mr. Tess said that at the March
23, 2020 the City Council approved these items under resolutions. However, before
approving a lease of more than two years involving City real property, Urbana City Code
Section 2-118 requires a public hearing to consider such a lease and publication of a 15-
day notice of the hearing.
Mr. Tess addressed questions and concerns about Plan Commission approval, expected
construction date, ground lease and incentive term length.
After presentation and discussion, CM Miller made a motion to approve Ordinance No.
2020-04-018 as presented. CM Brown seconded. Motion carried by roll call vote. Votes

4. Ordinance No. 2020-04-019: An Ordinance Authorizing the Lease of Certain Real Estate
(Portions of Real Estate Parcels with Permanent Index Numbers 91-21-10-151-006 and
91-21-10-151-007, Located at 901 N. Smith Rd. / Solar Star Urbana Landfill East, LLC)
Environmental and Sustainability Manager Scott Tess presented this item. No additional
discussion.
CM Miller made a motion to approve Ordinance No. 2020-04-019 as presented. CM
Brown seconded. Motion carried by roll call vote. Votes were as follows: (7-Aye:0-Nay)

5. Ordinance No. 2020-04-020: An Ordinance Approving a Special Use Permit (1906
Federal Drive Champaign Social Equity Growers – Plan Case 2397-SU-20)
Katherine Trotter, Associate Planner, presented Ordinance No. 2020-04-020 with
recommendation for approval. Tamala Green of Champaign Social Equity Growers
requested a Special Use Permit to allow a craft grower cannabis business at 1906 Federal
Drive. A Special Use Permit is required when the location is within 300 feet of residential
zoning.
Clark Solutions and Investment President Byron Clark and Associate Tamala Green were
present to address questions and concerns from council. Some of the concerns voiced by
council were the statics of the location, security procedures, staffing levels, and
commercial traffic.
After presentation, CM Wu made a motion to approve Ordinance No. 2020-04-020 as
presented. CM Miller seconded. Motion carried by roll call vote. Votes were as follows:

6. Ordinance No. 2020-04-021: Ratification of Emergency Order 20-02 Ambulance
Services Staffing and Response Times Issued on March 31, 2020
Mayor Marlin presented Ordinance No. 2020-04-021 with recommendation for approval.
She said that ambulance services are required to staff an ambulance with one Emergency
Medical Technician (EMT) and one Advanced Provider or two Advanced Providers.
Currently, two ambulance services alternate their time stationed at the Urbana Fire Station
at the city building. This ordinance will give these providers flexibility during the Covid-19
Pandemic. Typically, the ambulances are required to respond to 90% of their calls within
8-12 minutes, and if they do not, they are subject to a penalty fee. This ordinance will
waive any penalty fees during this time.
After presentation and discussion, CM Wu made a motion to approve Ordinance No.
2020-04-021 and to change the language from section one to be consistent with the
language of the original emergency order ordinance in section three. Motion carried by
roll call vote. Votes were as follows: (7-Aye:0-Nay)

account is transmitted to all council members, the mayor, city administrator, and city clerk. Email must
be received by the start of public input at the meeting and will only be taken during the public input
portion of the agenda.
Providing Public Input from a computer browser or the Zoom app on a mobile device:
· The link to join by computer is listed on the agenda.
· You do not need to install software on a computer to use Zoom. You can click “Join from your
browser.” It appears Zoom prefers for users to download and install their meeting client software on
your computer. Choose the option you are comfortable with and note, these may be browser specific.
There is a Zoom app for smartphones.
· Make sure you have a microphone on your computer if you wish to speak. Please identify yourself
with first and last name in Zoom for the record if you wish to speak*. FCC Guidelines will be
followed.
· Please turn-off any sound from other sources such as UPTV or cable, as there will be a lag in the audio
if you are also watching the meeting. You should see the meeting video stream through Zoom, see the
staff presentation slides, and hear people talking.
· We will be muting participants except during public input, when they will be recognized to speak
after raising their hand (see the next bullet point). Video will remain off for all members of the
public, even while they are speaking.
· Per council rules you must identify yourself to provide public input with your first and last name*.
During Public Input, if you wish to speak, please “Raise your hand” using the option as shown
in the Participant window (if using the Phone App, this option is shown by touching your
name). When called on by the chair or host, you will be un-muted and you should state your
name for the record per city code*.

Providing Public Input by phone:
· Please turn-off the sound from watching the meeting on the TV or streaming service, as there will
be a lag in the audio. Join by calling the phone number shown in the agenda.
· Callers will then be asked to enter the Meeting ID number followed by the # key. The Meeting ID
number is listed on the agenda.
· All callers are muted by default.
· If you wish to speak, please “Raise your hand” by pressing *9 once - this toggles the
raise/lower hand option. When called on by the chair or host by your phone number, you will
be un-muted and you should state your name for the record per city code*. When you are done,
the host will “lower your hand” and mute you - there is no need to press any more buttons.
As a reminder, public input can be received and is encouraged before the meeting via email as listed above. The
video recording will be available on UPTV’s YouTube channel and via the Meetings Calendar on the city’s
website, usually by the following day at noon.
