The City Council of the City of Urbana, Illinois, met in special session Monday, October 5, 2020, at
6:45 p.m. via Zoom. Urbana City Council Chambers, 400 S. Vine St., Urbana, IL 61801
ELECTED OFFICIALS PHYSICALLY PRESENT: Mayor Diane Wolfe Marlin, Phyllis D. Clark,
City Clerk
ELECTED OFFICIALS PRESENT VIA ZOOM: City Council Members (CM) Bill Brown, Bill

I. CALL TO ORDER AND ROLL CALL
There being a quorum virtually present, Mayor Marlin called the meeting of the Urbana City
Council to order at 6:47pm

There was none
III. Ordinance No. 2020-10-052: An Ordinance Settling Dispute over Post-Judgment Interest due on
the Carle Foundation Litigation
City Attorney James Simon presented this item with the recommendation for approval. He said
that in January 2020 following a lengthy trail, the court entered judgment in favor of the Carle
Foundation. The County tendered to Carle the post-judgment interest it believed was due and
owed to them. However, a dispute arose between the City and the County that involved in part
which post-judgment interest statute to apply and the fact that Urbana submitted the required
amount in time. Instead of litigating the dispute, City staff recommends accepting the reduced
amount proposed by the County.
Mayor Marlin added that the original amount was $ 19,539.08 and the settlement amount was
reduced to $10,749.49.
After presentation and brief discussion, CM Colbrook made a motion to approve Ordinance No.
2020-10-052 as presented. Seconded by CM Wu and carried by roll call vote as follows:
Aye: Wu, Hursey, Brown, Colbrook, Miller
Nay: None
IV. ADJOURNMENT
With no further business to come before the council, Mayor Marlin adjourned the virtual
meeting at 7:01 p.m.

Public input will be taken in the following ways:

record, with personal identifying information redacted. Copies of emails will be posted after
the meeting minutes have been approved. We cannot guarantee that all emails will be read
aloud, due to variation in the volume of mail and time available.
