MEMORANDUM OF AGREEMENT
This Memorandum of Agreement (hereinafter the "MOA") is made and effective as of the I st day of
April, 2026 by and between the City of Utica (hereinafter the "Employer") and the Civil Service
Employees Association, Inc., Local 1000, AFSCME, AFL-CIO (hereinafter the "Association").
RECITALS:
WHEREAS, the Employer and the Association are parties to a collective bargaining agreement effective
April l, 2020 to March 31, 2025 setting forth terms and conditions of employment for bargaining unit
employees and continuing until execution of the succeeding collective bargaining agreement effective
April l , 2025 to March 31, 2029 to be entered into pursuant to the parties Memorandum of Agreement,
dated March 3, 2026, which was subsequently ratified by the Association's membership (collectively
hereinafter the "CBA");
WHEREAS, the competitive civil service titles of Receptionist and Real Property Data Clerk are
recognized in the Association bargaining unit in accordance with Article I
("Recognition") of the CBA and included and allocated Grades 5 and 3, respectively, in Appendix "A"
("Classifications Included Under Article I — Recognition Clause") thereof;
WHEREAS, the Employer and Association recognize and acknowledge that between said titles in the
Assessor's Office, the Real Property Data Clerk is of at least equal if not greater responsibility; and
WHEREAS, the Employer also desires to retain the employee presently provisionally appointed to the
Real Property Data Clerk title (date of hire: 03/13/23).
NOW THEREFORE, in consideration of the mutual considerations and understanding set forth herein, the
parties agree and stipulate as follows:
AGREEMENTS:
l . The Employer and Association agree that said competitive civil service title of Real Property Data
Clerk shall be reallocated a Grade 5 in Appendix "A" of the CBA and paid in accordance with the
salary tables for said grade set forth in Appendix "D" ("Schedule A-I, CSEA Salary Table") thereof.
2. The Employer and Association also agree that employee presently provisionally appointed to the
Real Property Data Clerk title (date of hire: 03/13/23) shall also remain at the "12 Month" (Step
2) rate for the above reallocated Grade. This provision shall not apply to any subsequent person
filling this title.
3. The terms of this MOA shall bc incorporated into the succeeding collective bargaining agreement.
4. This MOA constitutes the full and complete agreement of the parties with respect to the matters
contained herein and no verbal statement or other agreement, except as an amendment in
writing annexed hereto and designated as an amendment to this MOA shall supersede or vary
the provisions herein, including any subsequent amendment changing the Grade allocated to said
civil service competitive class title.

remaining NYS Opioid Settlement into the 2026-2027 City budget as follows:

EXPLANATION: To incorporate the remaining NYS OASAS Opioid Settlement funds received from the

training to persons in treatment for, or recovering from, Opiate Use Disorder (OUD). The City contracts
with Cornerstone Community Church to provide these services.
