N Date of Legislation: 01 / 19 / 22 Explanation provided to council on: / / ________________________________________________________________________________________________________________________________________ CITY OF UTICA Department of Legislation Common Council Sponsored by: Councilmembers Meola, Williamson RESOLUTION WAIVING THE APPLICATION FILING REQUIREMENTS FOR THE GRANTING OF REAL PROPERTY TAX EXEMPTIONS FOR THE DISABLED (SECTION 459-C) OR THE AGED (SECTION 467) IN 2022 WHEREAS, Governor Kathy Hochul issued Executive Order 11.1 on December 26, 2021; and WHEREAS, Executive Order 11.1 permits the governing body of an assessing unit to waive certain exemption mailing and filing requirements for the 2022 assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Utica, pursuant to the authority granted by Executive Order 11.1, hereby directs the City assessor to grant exemptions pursuant to Sections 459-c and 467 of the Real Property Tax Law on the 2022 assessment roll to all property owners who received that exemption on the 2021 assessment roll, thereby dispensing with (1) the need for impacted property owners to file renewal applications and (2) the requirement for the assessor to mail renewal applications to such persons. BE IT FURTHER RESOLVED, that the City Council directs the assessor to require a property owner to file such a renewal application in instances when the assessor has reason to believe that an owner who qualified for the exemption on the 2021 assessment roll may have since changed their primary residence, added another owner to the deed, transferred the property to a new owner, or died. N Date of Legislation: 01 / 19 / 22 Explanation provided to council on: / / ________________________________________________________________________________________________________________________________________ CITY OF UTICA Department of Legislation Common Council Sponsored by: Councilmembers Moody, Meola, Williamson ORDINANCE ESTABLISHING A CIVILIAN PUBLIC SAFETY BOARD AND AUDITOR BE IT ORDAINED, that ARTICLE VII, Chapter 2-2 of the Utica Code of Ordinances shall be amended by adding DIVISION 4, entitled “Civilian Safety Board and Auditor,” to read as follows: DIVISION 4 Civilian Public Safety Board and Auditor Sec. 2-2-220. Purpose. The City of Utica shall establish public safety oversight that couples an audit function with citizen oversight in an effort to improve accountability and transparency. The purpose of this model is to ensure that complaint resolution, citizen interactions and adherence to policies are monitored continuously, not just when a problem arises. It will allow the identification of patterns, cultures and practices that may be modified to improve relations between public safety departments and the residents of Utica. Further, this model will assist the City in tracking the progress and efficacy of recently implemented reforms and to look beyond just citizen complaints, into any area that can impact overall safety and wellness. This oversight mechanism shall give community input when making or revising department policies and discuss current police practices and strategies with the ability to make suggestions for improvement. The Board shall work in conjunction with and not adversarial to the City of Utica Police and Fire Departments. Sec. 2-2-221. Membership. The Civilian Public Safety Board shall consist of seven members for a term of two-years. The initial terms shall expire on June 1, 2024 and on June 1 of every two years thereafter. (a) Two members shall be appointed by the Mayor of the City of Utica. (b) Two members shall be appointed by majority vote of the City of Utica Common Council. (c) One member shall be appointed by the local chapter of the NAACP. (d) Two members shall be nominated by local 501 (c) IRS tax designated not-for-profit organizations. Each interested group shall nominate a potential board member using criteria set forth by the Public Safety Commissioner. Initially, the Police Reform Advisory Committee will select two of these members, and every selection thereafter shall be made from non-profit nominations by the preceding Civilian Public Safety Board. Section 2-2-222. Limitations on Membership. All Board members shall reside in the City of Utica and shall include representation from traditionally disenfranchised groups. Board members may be privy to confidential records, as such, they will agree to sign non-disclosure agreements drafted by the Commissioner of Public Safety concerning said records. Failure to sign such non-disclosure agreements will preclude the Board member from sitting on the Board. Section 2-2-223. Term Limits. Mayoral or Common Council appointed positions can serve no more than three consecutive terms, while members from non-profit and advocacy groups can only serve consecutive terms if there are no-other applicants deemed eligible. Section 2-2-224. Training. Board members should undergo training provided by the City of Utica. Failure to complete the training will preclude the Board member from siting on the Board. Section 2-2-225. Organization. (a) The Board shall meet at least eight times each year, while exercising its prerogative and discretion to meet more if deemed necessary by its members. (b) The Board shall host or attend at least two town hall-style Public Input Meetings per year. These meetings shall involve at least one active member of the Utica Police Department and the Utica Fire Department and shall be designed to hear and record resident concerns regarding public safety. (c) The City of Utica shall provide meeting space and/or office space when requested and clerical support for the Civilian Public Safety Board. Section 2-2-226. Powers. (a) The Board has the power to appoint outside legal counsel, an outside auditor, or other professional(s) as appropriated by the budget. The Board will not be represented by the City of Utica, Corporation Counsel, Law Department. (b) The Board shall appoint an outside auditor. The Board shall outline the scope of work to be examined by the auditor. The scope of work outlined by the Board should be designed to examine practices, identify areas of strength, flag areas where improvement is needed, and ensure that citizen complaints are being handled in an expeditious and transparent fashion. Board members should work to ensure that citizens are treated equally under the law regardless of race, religion, disability, sexuality, gender or class and that City departments engage with the public in a transparent fashion. (c) The Board shall not impose nor recommend discipline in any specific case, nor shall the Board issue any findings of fact nor conclusions of law in any specific case. (d) The Police nor Fire Department shall not disclose to the Board any documents or other evidence in any case that has an open civil and/or criminal investigation or adjudicatory process. (e) The Board shall have the power to establish its own by-laws as well as operating policies and procedures to carry out its responsibilities as defined in Section 2-2-227. Said by-laws will address any potential conflicts of interest of Board members and the expulsion of a Board member. (f) The advice and recommendations made to police leadership are non-binding and advisory only. Section 2-2-227. Responsibilities. (a) The Board may receive citizen complaints and, thus, develop a clear and coherent manner for doing such. It shall forward those complaints to Police Chief or the Fire Chief as appropriate and ensure the findings of investigations into those complaints are shared with the Board in a reasonable manner.  (b) Review the quality of civilian complaint investigations that are completed by the Professional Standards Unit of the Utica Police Department. (c) The respective department Chief or an appropriate designee shall respond to any concerns or questions raised by the Board after an investigation’s findings are initially shared. (d) The Board shall receive progress updates from the auditor as to initial findings, timeline updates, emergency concerns and cooperation with the audit process. All City Departments shall cooperate fully and completely with said audit and any refusal to do so shall be noted in the final audit report. (e) When the final audit is received, the findings shall be made available to the public, in accordance to Article 6 of Public Officers Law, in the City Clerk’s office or in another reasonable manner. (f) The Police and Fire Chiefs shall meet with the Board to discuss and answer questions in regards to annual audit results. (g) The Board shall send an un-redacted annual report on its activities to the Mayor, Police Chief and Fire Chief and the Common Council. The report should include recommendations based on audit findings. Section 2-2-228. Auditor. The Board shall appoint a qualified person, who is not a City of Utica employee, or agency to perform an annual public safety audit. The Auditor shall have significant relevant experience with the New York State Division of Criminal Justice Services and hold relevant credentials to perform said audit. The auditor’s responsibilities shall be as follows: (a) The Auditor shall thoroughly and completely examine all areas directed by the Civilian Public Safety Board. This examination may include documents, interviews, observations and any other fact-finding means necessary to obtain pertinent information. (b) The Auditor shall present progress updates to the Civilian Public Safety Board that includes progress being made, initial findings, emergency concerns and departmental cooperation with the audit process. (c) The Auditor shall produce an annual report that is thorough, clear and presented in a manner accessible to members of the public, media and Board. The audit will be made available to the public, in accordance to Article 6 of Public Officers Law, in the City Clerk’s office or in another reasonable fashionable manner. Composition of Bureau of Police. (b) The above composition includes the addition of 5 additional positions for police officers. It is not intended to permanently increase the composition of the Bureau of Police. After December 31, 2024, as vacancies occur in the Bureau by retirement or otherwise, the complement of police officers shall be reduced by attrition until it returns to the level of 106 positions. Y Date of Legislation: 01 / 19 / 22 Explanation provided to council on: / / ________________________________________________________________________________________________________________________________________ CITY OF UTICA Department of Legislation Common Council Sponsored by: Councilmembers DiBrango, Betrus, Williamson A RESOLUTION ENCOURAGING THE MAYOR OF THE CITY OF UTICA TO APPLY FOR FUNDS PROVIDED UNDER THE AMERICAN RESCUE PLAN OF 2021 TO ALLOCATE PREMIUM PAY TO FIRE/EMS PERSONNEL WHO ENGAGED IN PERFORMING ESSENTIAL WORK DURING THE COVID-19 PANDEMIC WHEREAS, on March 6, 2021, the Federal Government enacted the American Rescue Plan of 2021; and WHEREAS, said plan provided for funds to be used by governments facing fiscal shortfalls for services rendered during the pandemic, such as Fire/EMS personnel; and WHEREAS, the Treasury Department has issued guidelines with regard to applying for and utilizing funds provided in said Act as set forth in Paragraph 3, entitled “Premium Pay;” and WHEREAS, Paragraph 3 of the Treasury guidelines provides as follows: Fiscal recovery funds may be used to provide premium pay to eligible workers, including public safety (Fire/EMS) workers during the COVID-19 public health emergency. Premium pay is defined as an amount up to $13/hour in addition to wages or remuneration the worker otherwise receives and in an aggregate amount not to exceed $25,000 per eligible worker; THEREFORE, BE IT RESOLVED, that the Common Council of the City of Utica encourages the Mayor to submit an application pursuant to the American Rescue Plan Act to identify any public safety needs and possible assistance regarding available Federal funds to the City to Fire/EMS personnel who qualify and would lessen the financial burden upon the City for these services.
